tance remained doubtful; moft, if not all, of these have been decided in cafes which have fince occurred; the alterations rendered neceffary by thefe decifions have been made in the prefent edition, and the author is not aware that any thing material has been omitted which might be found useful in such a work. FIRST EDITION.

WO Treatifes are already before the public on the fubject of the following fheets: Without attempting to appreciate the refpective merits of these performances, or to compare them particularly with his own, the author of the prefent publication feels it neceffary to obferve, that the plan of his work differs very materially from either of the others. He has endeavoured to produce a compofition, which, without disgusting the profeffional reader, may be eafily comprehended by men of business, and ferve As an elementary treatife to the ftudent. In executing this plan, he has given, under each divifion, an hiitorical deduction of the opinions which have been held on the point immediately under difcuffion, and concluded with the law as fettled by the latest decifions, where, in fact, it has been fettled. Where the point remains ftill in doubt, he has ftated the arguments on both sides of the queftion. How far he has fucceeded in the execution, the public only can decide.
