CHAPTER 547

AN ACT to amend the charter of the city of Oneida, in relation to excluding water bonds from the ten per centum limitation of indebtedness, and legalizing acts of the city authorities in reference to city bonds.

Became a law April 9, 1925, with the approval of the Governor. Passed, by a two-thirds vote on emergency message.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

Section 1. Section seventy-seven of chapter six hundred and L. 1911, forty-eight of the laws of nineteen hundred and eleven, entitled $ 77 "An act to revise, consolidate and amend generally chapter two amended. hundred and twenty-five of the laws of nineteen hundred and one, known as the charter of the city of Oneida, and the several acts amendatory thereof, and repealing certain acts," is hereby amended to read as follows:

§ 77. Limitation of city indebtedness. The city of Oneida shall not incur indebtedness if thereby its total contract indebtedness, exclusive of the amount of water bonds issued by the village of Oneida, and exclusive of the amount of water bonds heretofore or hereafter issued by the city of Oneida1 and exclusive of liabilities for which taxes have already been levied, shall exceed ten per centum of the assessed valuation of the real property of said city, subject to taxation, as it appeared on the last previous assessmentroll. The aggregate for the annual tax levy for all purposes mentioned in section forty-four of this act excepting subdivisions seven, ten and thirteen shall not exceed the rate of one per centum of the assessed valuation of the real and personal property liable to taxation in said city, as the same shall appear from the assessment-roll of said city for the current year.

CHAPTER 548

AN ACT to amend chapter six hundred and forty-six of the laws of nineteen hundred and twenty-one, entitled "An act creating and establishing a department of charities in the county of Oneida, defining its powers and duties and providing for its operation and maintenance," in relation to relief granted by the board of child welfare.

Became a law April 9, 1925, with the approval of the Governor. Passed, three-fifths being present.

§ 4. Apportionment of expense. Each town and city of the county of Oneida shall be liable to the county of Oneida for all moneys expended for the purposes and uses enumerated in this act for the relief of persons having a settlement in such town or city, 'except relief granted by the board of child welfare pursuant to article seven-a of the general municipal law, as added by chapter two hundred and twenty-eight of the laws of nineteen hundred and fifteen, which shall be a county charge, at the end of each fiscal year the moneys so expended and for which the town is liable during such year for and on behalf of the persons having settlements in any of the towns or cities of the county shall be apportioned and charged back to such town or city and levied and collected in the same manner as other town or city charges. After the apportionment to each of the towns and cities of such amounts as shall have been expended for and on behalf of persons having settlements in such towns or cities the amount remaining shall be a county charge and borne by the county. § 2. This act shall take effect immediately.

CHAPTER 549

AN ACT to legalize a special election held in the city of Olean, December thirty-first, nineteen hundred and twenty-four, for authorizing issuance of city bonds for constructing an outlet sewer and a sewage pumping plant, respectively, together with proceedings relating to such authorization, and to authorize the issuance of bonds of such city for such purposes.

Became a law April 9, 1925, with the approval of the Governor. Passed, by a two-thirds vote on emergency message.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

Section 1. All acts and proceedings of the city of Olean, its officers, agents and voters, leading up to, including and subsequent to the special election held in such city on December thirty-first, nineteen hundred and twenty-four, whereat there was in form submitted two propositions, one for the raising of one hundred and twenty thousand dollars by the issuance and sale of bonds of such city for the purpose of constructing an outlet sewer from Johnson street to the Allegany river, and the other for the raising of twenty thousand dollars by the issuance and sale of bonds of such city for

the purpose of building and equipping a pumping plant at the Allegany river for the purpose of caring for and raising the discharge of said outlet sewer, are hereby in all things legalized, ratified and confirmed, notwithstanding any legal defect, omission or irregularity or lack of lawful authority in or relating to such proceedings, submission or election, and particularly notwithstanding the failure to specify in the published statement, or notice, of such election the time of payment of such bonds and the rate of interest thereon as provided in section one hundred and six of the charter of such city; and such acts and proceedings, and the majority vote whereby such propositions were adopted shall be given the same full force and effect as though done in full and strict compliance with law; and the common council of such city is hereby Issue and authorized to issue and sell bonds of such city to the amounts and bonds for the purposes, respectively, specified in such propositions, as sub- authorized, mitted, which shall become due and payable at a time or times to be fixed by such common council, subject to any legal limitation as to the time of maturity of a city debt of such city, or last installment thereof, secured by bonds, and which shall bear such rate of interest, not exceeding five per centum per annum, as such common council shall determine.

§ 2. For the purpose of raising money to pay the principal and Tax for interest of such bonds as they severally mature there shall be raised annually in such city by tax upon taxable property in such city pursuant to the provisions of law applicable thereto, in each and every year during the term of said bonds, a sum sufficient to pay the principal and interest of said bonds and certificates as they shall fall due and be payable.

CHAPTER 550

AN ACT to amend chapter five hundred and thirty-five of the laws of nineteen hundred and fifteen, entitled "An act to consolidate and revise the several acts, relative to the city of Olean," in relation to the extending of the boundaries of the city and changing the ward boundaries thereof. Became a law April 9, 1925, with the approval of the Governor.

All that part of the town of Olean in the county of Cattaraugus bounded as follows: Commencing at the intersection of the west line of town number one in the fourth range of townships of the Holland Land Company's survey with the south bank of the Allegany river at low water mark; thence easterly along the south bank of said river to a point where said south bank of said river intersects the west line of lot fifteen, section seven, town one, range four of the Holland Land Company's survey; thence south on the west line of lot fifteen in section seven, town one, range four, aforesaid, to the southwest corner of said lot fifteen; thence east along the south line of said lot fifteen and the south line of lots thirteen and fourteen in the same section, town and range to the southeast corner of said lot thirteen; thence north on the east line of said lot thirteen to a point distant twenty-eight hundred and fifty feet south from the south bank of the Allegany river; thence east at right angles to the last mentioned boundary and parallel to the south line of lots eleven and twelve to a point on the east line of lot eleven, section seven, town one, range four of the Holland Land Company's survey; thence north along the east line of lot eleven to a point on the south bank of the Allegany river at low water mark; thence east along the low water mark on the south bank of said river to the point where the east line of lot four, in section four, town one, range four aforesaid, intersects said south bank of said river; thence north along the east lines of lots four and ten in said section four to a point in said east line of lot ten, two hundred feet north of the north line of Park avenue; thence west on a line parallel with the north line of Park avenue two hundred feet distant at right angles north therefrom, to the east line of lot nine in said section four; thence north along the east line of lot nine in said section four to the north line of said town one; thence west along the north line of said town one, range four aforesaid to the southeast corner of lot one, section five, town two, range four of the Holland Land Company's survey; thence north along the east line of lots one, three, five and seven to the northeast corner of lot seven, section five, town two, range four of the Holland Land Company's survey; thence west along the north line of lot seven to a point on the east bank of the Olean creek; thence northerly along the east bank of the Olean creek to a point south, at right angles to, and distant two hundred and ninety feet from the north line of lot nine, in section five, town two, range four of the Holland Land Company's survey; thence west on a line parallel with the north line of lot ten and two hundred and ninety feet distant at right angles south therefrom to the west right of way line of The Western New York and Pennsylvania Railway Company; thence southwesterly on a straight line crossing diagonally portions of lots ten and eight in section five and portions of lots one, two, three and five in section nine to a point in said lot five at the intersection of the center line of Buffalo street with the continuation northerly of the west line of lot thirteen in section eleven, town one, range four; thence south along said continuation of the west line of lot thirteen in section eleven, town one, range four to

WARD BOUNDARIES.

§ 3. The said city shall be divided into eleven wards as follows:

FIRST WARD.

The first ward shall comprise all that part of said city bounded east by the center line of Union street; north by the center line of State street; west by the center line of Sixth street; and south by the south bank of the Allegany river.

SECOND WARD.

The second ward shall comprise all that part of said city bounded on the east by the west bank of the Olean creek; north by the center line of East State street; west by the center line of South Union street; and south by the south bank of the Allegany river, also all that part of said city lying south of the Allegany river.

THIRD WARD.

The third ward shall comprise all that part of said city bounded east and north by the west bank of the Olean creek; south by the center line of East State street; west by the center line of North Union street and a line drawn in continuation of the center line of Union street to intersect the east bank of the Olean creek.

FOURTH WARD.

The fourth ward shall comprise all that part of said city bounded east by the center line of Union street; north by the center line of Sullivan street; west by the center line of Seventh street and south by the center line of State street.

FIFTH WARD.

The fifth ward shall comprise all that part of said city bounded east by the center line of Union street; north by the north line of town one, range four of the Holland Land Company's survey; west by the center line of Seventh street and south by the center line of Sullivan street.

SIXTH WARD.

The sixth ward shall comprise all that part of said city bounded east by the center line of South Sixth street and a continuation thereof south to the south bank of the Allegany river and the center line of North Seventh street, north by the center line of Washington street and the center line of State street between South Sixth street and North Seventh street; west by the center line of Eleventh street and a continuation of the center line of South Eleventh street to the south bank of the Allegany river; south by the south bank of the Allegany river.
