The following communication was received from the Board of Armory Commissioners relative to bill of Messrs. Horgan & Slattery, architects, for professional services in the erection of the armory building for the First Battery, N. G., N. Y. :

DECEMBER 23, 1901.

SIR-At a meeting of the Armory Board, held December 18, 1901, the following resolution was adopted:

"Resolved, That the Armory Board does hereby approve the bill and expense for the "survey of the site for the Second Naval Battalion Armory, on the west side of First avenue, "from Forty-third to Forty-fourth street, Borough of Brooklyn, by Henry Mesa, Civil Engineer "and City Surveyor, amounting to one hundred and fifty dollars ($150), and that the Commissioners "of the Sinking Fund be requested to concur, and the Comptroller be authorized to pay the "same." "

In reply, I would report that I consider the bill excessive. In my opinion, $85 would be full compensation for the work done; hence I cannot recommend the concurrence by the Commissioners of the Sinking Fund in the above resolution.

Resolved, That the Armory Board does hereby approve the bill and expense for the survey of the site for the Second Naval Battalion Armory, on the west side of First avenue, from Forty-third to Forty-fourth street, Borough of Brooklyn, by Henry Mesa, Civil Engineer and City Surveyor, amounting to one hundred and fifty dollars ($150), and that the Commissioners of the Sinking Fund be requested to concur and the Comptroller be authorized to pay the same.

Resolved, That the Commissioners of the Sinking Fund hereby concur in the said resolution to the extent of paying the sum of eighty-five dollars ($85) in full for said bill, and the Comptroller be and is hereby authorized and directed to pay to Henry Mesa the sum of eighty-five dollars ($85) in

full for his bill for making a survey of the site for the Second Naval Battalion Armory on the west side of First avenue, from Forty-third to Forty-fourth street, Borough of Brooklyn.

The report was accepted and the resolution unanimously adopted.

The Comptroller presented the following statement and resolution relative to a refund of $95.89 to Messrs. Weber & Bunke, being amount of rent overpaid for use of pier at the foot of West Ninety. sixth street, Borough of Manhattan:

DECEMBER 24, 1901.

SIR--It appears from letter from the Department of Docks and Ferries, herewith submitted, that Messrs. Weber & Bunke, under permit from said Department, occupied berth at the foot of West Ninety-sixth street, for which they paid rental of $250 in advance for the quarter ending August 31, 1901. On June 27, 1901, the permit was revoked in order that the Department might proceed with the construction of a new pier at the foot of Ninety-sixth street, depriving the lessee of one month and four days of time for which rent had been paid.

Messrs. Weber & Bunke, through the Department of Docks and Ferries, ask for a refund of the pro rata of rent thus overpaid by surrender of permit as stated.

The amount so overpaid, $95.89, was deposited in the Sinking Fund for the Redemption of the City Debt No. 1, June 21, 1901.

The Comptroller presented the following statement and resolution relative to a refund of $150 to Caroline M. Von Wallbrunn and Mary II. de Garmendia, being amount of rent paid in error on certain lots taken for a public park on West Fifty-second street, Borough of Manhattan : DECEMBER 24, 1901.

Hon. BIRD S. COLER, Comptroller:

SIR-In settlement of an award made to Caroline M. Von Wallbrunn and Mary H. de Garmendia for certain premises taken for public park, Eleventh and Twelfth avenues, Fifty-second and Fifty-fourth streets, the said parties paid the City $150 for rent of ten lots on West Fiftysecond street, occupied by lessees of premises after title vested in the City.

Demand has been made upon the City for the return of said rent so paid and collected. The Corporation Counsel, under date of December 17, 1901, states that under decisions of Court said rent was wrongfully collected and should be refunded.

The amount paid was deposited in the City Treasury, to the credit of the Sinking Fund for the Payment of the Interest on the City Debt, November 9, 1901.
