Tusket Wedge, in said County, were in favor of becoming incorporated; And whereas, as a result of said poll, a majority of said voters were in favor of incorporation; And whereas, it is deemed desirable that the boundaries of the said proposed incorporated town, as made by the Sheriff, under the provisions of said act, be altered, so as not to include all or part of the several islands named and included in the boundaries fixed and determined by said Sheriff before said poll was taken, all of which said islands are uninhabited; And whercas, it has been made to appear that all the proceedings connected with such incorporation have been legal and fair, and there are no just grounds to impugn the same; And whereas, it is further desirable and necessary that the said boundaries be so changed before the proclamation shall issue, declaring said town to be incorporated; Be it therefore enacted by the Governor, Council, and Assembly, as follows: how fixed 1. The Governor-in-Council is hereby authorized Boundaries, and empowered by Order-in-Council, to amend or alter the boundaries fixed and determined by the Sheriff of the County of Yarmouth, for the purposes of incorporating the Town of Tusket Wedge or Wedgeport by excluding from the limits of said town, any one or more of the several islands named and included therein; and said boundaries, when so fixed by said Order-in-Council, shall be the boundaries of said proposed town, to the same extent, and for the same purposes, as though so fixed and determined by the said Sheriff in the first instance, under the provisions of Section Six of said Act. proceedings 2. All proceedings taken in connection with the Incorporation incorporation of said proposed town, notwithstanding legalized. the foregoing premises, are hereby declared to be legal, and are hereby ratified and confirmed. CHAPTER 116. Name changed. An Act to Change the Name of a Town in the County of Yarmouth. (Passed the 23rd day of April, A. D. 1909.) SECTION 1. Name changed. Be it enacted by the Governor, Council, and Assembly, as follows:- 1. The town in the County of Yarmouth, heretofore known as Tusket Wedge, shall hereafter be known as Wedgeport. CHAPTER 117 An Act to Enable the Town of Yarmouth to Borrow Power to borrow. Be it enacted by the Governor, Council, and Assembly, as follows:— 1. The town of Yarmouth is hereby authorized and empowered to expend a sum of money, not exceeding six thousand dollars, for the purpose of building and furnishing a new engine house at Milton, in the said town; and, to raise the funds therefor, the town of Yarmouth is hereby authorized and empowered to borrow, from time to time, upon the security of this act, and the credit of the town, such sums, not exceeding the sum of six thousand dollars, as shall be sufficient for the purpose aforesaid; and in order to secure the money so borrowed, to make and issue from time to time debentures bearing interest payable semiannually, at a rate not exceeding four and one-half per centum per annum; and such debentures, with interest coupons attached, shall be for such sums, and payable at such times and within such periods, and at and within the same or different times or periods not exceeding twenty years from the date of issue thereof, as the town council of the said Town of Yarmouth shall by resolution determine. Such debentures shall be sealed with the town seal, and signed by the mayor and countersigned by the clerk of the town, and such interest coupons shall be signed by the clerk of the town. provided. 2. The town council shall annually place in the Interest, how estimates and add to the other amounts to be assessed and levied on the town, a sum sufficient to pay the semi-annual interest coupons and all and any of the said debentures maturing during the current year, with expenses of collection, and such sums shall be assessed, levied and collected at the same time and in like manner as the other sums provided for in said estimates now are or hereafter may be assessed, levied and collected; and if any of the said semi-annual interest coupons or debentures are not paid upon demand at or after maturity, a Judge of the Supreme Court may amerce the town for the amount due thereon. 3. In order to provide a sinking fund for the pay-Sinking fund ment of the debentures authorized to be issued under this act, the town council shall annually add to the general assessment to be levied upon the ratepayers of said town, subject to assessment, such sum, as may by resolution be determined by the town council, not, however, to be less than two per cent. of the amount borrowed under the provisions of this act, and such sum shall be rated and collected in the same manner and with the same remedies as other rates and taxes in said town are rated and collected. 4. This act shall not take effect until the same Town meeting. is adopted by the ratepayers of the said Town of Yar mouth, by resolution passed at a meeting duly convened 31 Evidence of adoption of act. Municipal Debentures to apply in accordance with the provisions of sections 143 and 144 of "The Towns' Incorporation Act.' 5. A certificate, under the hand of a mayor and town clerk, and under the corporate seal of the said town of Yarmouth, of a resolution passed under the next preceding section of this act, shall be conclusive evidence of the adoption of the act and of the passing of the resolution provided for in said section. 6. The provisions of "The Municipal Debentures, Act, 1902," and amendments thereto, shall apply to this act in so far as the same are consistent herewith. CHAPTER 118. An Act to Enable the Town of Yarmouth to Borrow Power to borrow. 3. Sinking fund. Be it enacted by the Governor, Council, and Assembly, as follows: 1. The Town of Yarmouth is hereby authorized and empowered to expend a sum, not exceeding eighty thousand dollars, for the purpose of continuing the laying of the twin main from where the work ended in 1906 southwardly to the Pumping Station in the town, and the taking up, cleaning and relaying the old main between such points, as a part of the water system of the town instituted under Chapter 139 of the acts of 1893; and to raise the funds therefor the Town of Yarmouth is hereby authorized and empowered to borrow, from time to time, upon the security of this act, and the credit of the town, such sums, not exceeding eighty thousand dollars, as shall be sufficient for the purpose aforesaid; and in order to secure the money so borrowed, to make and issue from time to time debentures bearing interest, payable semi-annually, at a rate not exceeding four per centum per annum, and such debentures, with interest coupons attached, shall be for such sums, and payable at such times and within such periods, and at and within the same or different times or periods, not exceeding thirty years from the date of issue thereof, as the town council of the said Town of Yarmouth shall by resolution determine. Such debentures shall be sealed with the town seal, and signed by the mayor and countersigned by the clerk of the town, and such interest coupons shall be signed by the clerk of the town. income. how 2. The moneys accruing from the annual income Water supply of the water supply of the town, from whatever source, appropriated. shall be appropriated and applied in the first place to discharge the current expenses incurred in the execution of the requirements of Chapter 139 of the acts of 1893, and in the next place toward the payment of the half-yearly interest of the debentures issued under the authority of the said Chapter 139 of the acts of 1893, and in the next place towards the payment of the half-yearly interest of the debentures issued under the authority of Chapter 104 of the acts of 1895, and in the next place towards the payment of the halfyearly interest of the debentures issued under the authority of Chapter 107 of the acts of 1900, and in the next place towards the payment of the half-yearly interest of the debentures issued under the authority of this act; and in case the whole income shall not be sufficient for the purposes before mentioned, the deficiency shall be made good and supplied by an annual assessment; and the town council shall place in the estimates and add to the amounts to be assessed and levied on the town a sufficient sum to make good and pay the said annual deficiency, and also to pay all and any of the debentures issued under the authority of this Act and maturing during the current year, with the expenses of collection, and the same shall be assessed, levied and collected at the same time and in like manner as the other sums provided for in said estimates now are or hereafter may be assessed, levied and collected; and if any of the said annual |
