Be it enacted by the Governor, Council, and Assembly, as follows: Incorporation. 1. Arthur S. Barnstead, John H. Bentley, Ernest F. Doyle, Walter C. Murray, Kate MacKintosh, I. Maud Bowden, Alexander McKay, Silvanus A. Morton, of Halifax, in the county of Halifax, and their successors in office, are hereby constituted a body corporate by the name of the Board of Management of the Halifax Teachers' Pension System. Objects. Powers. "General powers. 2. The objects and powers of the corporation hereby created are to administer the funds of the Halifax Teachers' Pension System, and to carry out the purposes of such system as now established. 3. The successors to the members of the corporation shall be elected according to the provisions of the Halifax Teachers' Pension System. The corporation shall have power to make and adopt rules and regulations for the governing of its business and the management of the affairs of the Halifax Teachers' Pension System, and from time to time to repeal, alter and add to such rules and regulations, provided that the said rules and regulations, and every amendment, repeal and re-enactment shall be submitted to, and approved of by the Council of Public Instruction. 4. The corporation shall have power to make contracts for the purposes of the Halifax Teachers' Pension System, and to take, receive and hold real and personal property, and to sell, mortgage, lease and convey, or otherwise dispose of the same for the benefit of said corporation. No member of the corporation shall be liable for the debts and liabilities of the Halifax Teachers' Pension System. . CHAPTER 80. An Act in respect to Certain Claims for Damages in connection with the Halifax and South Whereas, the property of Patrick Kehoe, situated at or near the Dutch Village Road, in the County of Halifax, is alleged by the owner thereof to have been injuriously affected by the construction, through them, of the line of the Halifax and South Western Railway; And whereas, the amount awarded as compensation for the injuries done to the said property by the arbitrators appointed under the provisions of chapter 75 of the Acts of 1903, is, in the opinion of the owner of said property, grossly inadequate, and the said owner has declined to accept payment of the same; Be it therefore enacted by the Governor, Council, and Assembly, as follows: 1. The City Council of Halifax city and the Municipal Commissioner. Council of the municipality of the county of Halifax shall appoint a person to be Commissioner to enquire into and report to the said City Council, and the said Municipal Council, upon the nature and extent of the injuries done by the passage of the said line of railway through the property of the person mentioned in the preamble to this Act, both in respect to the land actually taken by the said railway and the extent to which the remainder of the said property are injuriously affected, and also upon the amount of compension awarded, as aforesaid, and whether the same is sufficient or not, and if not sufficient, what, in the opinion of the Commissioner, would be a sufficient and proper amount of compensation for such injuries. 2. The Commissioner so appointed shall have all the Powers. powers conferred upon a Commissioner under chapter 12 of the Revised Statutes, "Of Enquiries Concerning Public Matters." Notice of hearing. Agreement. 3 Due notice shall be given by him of the time and place appointed by him for a hearing, and any person interested may appear in person or by counsel. 4. The Commissioner may, if he deems fit, view the property aforesaid. 5. If the Commissioner reports that the amount already awarded for the compensation of the injury done to any of the said property is insufficient, the said City Council and Municipal Council shall pay to the owner of such property, or property respectively, the difference between the amount already awarded for compensation and the amount which the Commissioner reports as sufficient. 6. The amount, if any, payable by the municipality and the city shall be rated upon the assessable property of the municipality and city respectively, and shall be collected in the same manner, and with the same remedies, as other rates and taxes. 7. In place of appointing a Commissioner, as herin before provided, the Council of the city of Halifax may come to an agreement with the said Patrick Kehoe for an amount to be paid him as additional compensation, and any such amount so agreed upon may be paid to him in full satisfaction of all claim and demand by him. Any amount so paid may be borrowed from a bank, and, with interest, included in the next year's assessment. In the absence of such an agreement the other provisions of this Act shall apply. Sec. 320 repealed and substituted. CHAPTER 81, An Act to amend Chapter 174, Acts of 1903, entitled “An Be it enacted by the Governor, Council, and Assembly, as follows: 1. Section 320 of said chapter 174, of the Acts of 1903 is repealed, and the following section substituted therefor: 320. The police force in and for the city of Sydney, shall be under the entire control and management of a board of police commissioners, which shall consist of the Mayor of the city, who shall be chairman, and five aldermen, to be selected by and from the City Council, within one month after the date of the passing of this Act, and annually thereafter at the first regular meeting of each newly elected Council. The Stipendiary Magistrate shall act as secretary of the board. and substituted. 2. Section 324 of said chapter 174 of the Acts of 1903, Sec. 324 repealed is hereby repealed, and the following substituted : 324. "Any two members of the Board of Police Commissioners dissenting from the decision of the said board upon any of the matters mentioned in the preceding section, may appeal to the City Council at the next ensuing meeting thereof, upon giving notice to the said board of such appeal at the meeting at which the decision appealed from was arrived at."
