CHAPTER 54.

An Act to amend Chapter 28, Revised Statutes, 1900, "The Sheriffs' Act."

(Passed the 25th day of April, A. D., 1907.)

Be it enacted by the Governor, Council, and Assembly, as follows::

1. Section 35 of chapter 28 of the Revised Statutes 1900, "The Sheriffs' Act," is repealed, and the following substituted therefor:

35. Where any personal property of any person against whom any writ of execution or attachment, replevin order, or other process has been issued, is claimed by any person other than the person against whom such process is issued or proceedin5s taken, it shall not be compulsory on any sheriff or his deputy, to levý upon, seize, attach, take or hold any of such property until a bond of indemnity, sufficient against all actions, damages and costs occasioned by reason of such levy, seizure or attachment, is given to such sheriff, or his deputy, by or on behalf of the person in whose behalf the said execution, writ of attachment, replevin order, or other process is issued, and no action shall be brought against any sheriff for or on account of not levying, seizing, attaching, taking or holding any property so claimed by any other person as aforesaid, unless such bond was given or tendered.

Be it enacted by the Governor, Council, and Assembly, as follows:

1. Section 71 of Chapter 71 of the Revised Statutes, 1900, "The Towns' Incorporation Act," is hereby repealed and the following substituted therefor :

71. (1) Every person shall be qualified to vote at an election of mayor or councillor, who,

(a) Is a British subject of the full age of twenty-one
years or upwards, and,

(b) Is registered on the list of voters under the pro-
visions of "The Nova Scotia Franchise Act,"
including women on said list, and,

(c) Had fully paid his rates and taxes of all kinds for
the previous year at least ten days before the day
for nominating candidates.

2. Before delivering a list of voters to a presiding officer Names struck for the purposes of an election of mayor or councillor under the provisions of said Chapter 71, the town clerk shall strike off such list, by scoring the same with red ink, the name of every person who has not complied with sub-section (c) of section 71 of said Chapter 71 as hereby amended, and said list when so corrected by the town clerk shall be filed in the town clerk's office and open to inspection on or before nomination day.

Be it enacted by the Governor, Council and Assembly, as follows:

1. Sub-section 44 of section 263 of chapter 71 of the sunday street Revised Statutes, 1900, "The Towns' Incorporation Act," is cars. amended by adding thereto the following words:-" and regulating the running of street cars on Sunday."

An Act to amend Chapter 71, Revised Statutes, 1900, "The
Towns' Incorporation Act.”

(Passed the 25th day of April, A. D., 1907.)

Be it enacted by the Governor, Council, and Assembly, as follows:

1. Sub-sections eleven and twelve of section two hundred and sixty-three of said chapter 71, Revised Statutes, 1900, "The Towns' Incorporation Act," are repealed, and the foilowing are substituted therefor :

11. Killing (a) dogs running at large contrary to any by-law; and (b) dogs in respect to which the tax imposed by any by-law is not paid, with authority and power to ordain and provide that any constable or peace officer may, without notice to, or complaint against, the owner, possessor, or harborer of any such dog, impound and kill the same, or kill the same on sight without impounding.

12. Imposing fines upon the owners, harborers or possessors of dogs which run at large contrary to any by-law, or in respect to which the tax imposed by any by-law is not paid, or which are fierce and dangerous, or which, without provocation, attack or injure any person or property.

Be it enacted by the Governor, Council, and Assembly, as follows:

1. Section 4 of chapter 71 of the Revised Statutes, is hereby repealed, and the following section substituted therefor:

"4 No town shall be incorporated under this chapter, the population of which does not exceed twelve hundred persons dwelling within an area (reasonably compact) of not more than six hundred and forty acres of land: Provided, that if twelve hundred persons dwell within such an area of six hundred and forty acres, a larger area than six hundred and forty acres may be embraced in the original boundaries of the town."

2. This Act shall not apply to any place which has -applied for incorporation before the passing of this Act.

An Act to amend Chapter 71, Revised Statutes, "The
Towns' Incorporation Act."

(Passed the 25th day of April, A. D., 1907.)

Be it enacted by the Governor, Council, and Assembly, as follows:

Streets for fire

Section 263 of chapter 71 of the Revised Statutes, apparatus. 1900, "The Towns' Incorporation Act," is amended by adding thereto after clause (13), the following clause:

(13A) Giving the right of way or precedence to fire engines, hose reels, ladders, waggons and other apparatus for the extinguishing of fires and the protection and preservation of property from fires, on all streets and roads in the town.

CHAPTER 60.

An Act to amend Chapter 71, Revised Statutes, 1900, "The Towns' Incorporation Act."

(Passed the 28th day of March, A. D., 1907.)

Be it enacted by the Governor, Council, and Assembly, as follows:

1. Section twenty of chapter 71 of the Revised Statutes, 1900, "The Towns' Incorporation Act," is amended, by adding thereto the following sub-section :

(1) The Governor-in-Council shall, by proclamation, make such provision as to the boundaries of polling districts which may be affected by the incorporation of such town as may be necessary, and for that purpose may create a new polling district and fix the representation thereof in the council, or may extend the boundaries of existing polling districts.

CHAPTER 61.

An Act to amend Chapter 151, Revised Statutes, 1900, entitled, "The Trustee Act."

Be it enacted by the Governor, Council, and Assembly, as follows:

1. Section three of chapter 151, Revised Statutes, 1900, is amended by adding thereto thereto the following words:

(f) Or in bonds or debentures secured by a mortgage of real property.

2. Section seven, sub-section one of said chapter is amended by inserting after the word "lend" in the second line thereof, the words "or investing in any bonds or "debentures secured by a mortgage of real property author"ized by this chapter."
