THIS 'HIS Indenture, &c. Between J. C. of, &c. gent. and H. W. of, &c. efq; (the next friend and guardian to the faid 7. C.) of the one part, and W. L. of, &c. London, gent. (one of the attornies of his majefty's court of --) of the other part, Witneeth, That the faid Service J.C. hath, and by these presents doth put and place himself to and with the faid W. L. his master, him to serve as his clerk for the time or space of five years from the day of the date hereof, during all which term he the faid 7. C. as fuch, fhall faithfully and diligently ferve him the faid W. L. his fecrets keep, and his lawful commands obey and perform, and fhall not part or abfent himself from the fervice of his faid master without his leave, during the said term, nor unduly or negligently spend or wafte any of his faid master's monies, goods or chattels, or the monies, goods or chattels of any other person or perfons which fhall be in the cuftody of, or intrufted with him, by his faid mafter, or that shall be delivered or put into the hands of the faid 7. C. or come to his hands by the faid master's order or appointment, or any otherwise on his account, during the said term; but shall and do from time to time during the faid term well and truly account for, deliver and pay to his faid mafter, his executors, adminiftrators or affigns, all and every fuch fum and fums of money, ftamps, writings, and all other things which he the faid J. C. fhall receive, have or take, of or for, or be intrufted for, or on account of his faid mafter; and alfo fhall in all things demean and behave himfelf in all refpects, as a good, true and faithful clerk, during all the faid term; And the faid W. L. (for and in confideration of the fum of Instruction, of lawful money of Great Britain, to him in hand well paid by the faid H. IV. at or before the executing hereof, the receipt, &c.) Doth covenant, promife, grant and agree, to and with the faid L. W. and J. C. and to and with each of them by thefe prefents, in manner as follows, viz. That he the faid W. L. fhall and will from time to time, and at all times during the faid term of five years, in the best manner he can, well and fufficiently inftruct and inform the said 7. C. fhall and will from time to time, and at all times, well and truly account for all fuch monies, ftamps and other things as fhall come to his hands, by the delivery, order, or for the use of his faid mafter the faid W. L. And fhall and will pay and fatisfy to him the faid W. L. his executors, adminiftrators or affigns, from time to time on demand, all and every fuch fum and fums of money as fhall appear to be due to him or them upon the balance of any account which fhall be made by reafon of any deficiency of him the faid F. Liberty to affign.

ROVIDED always, and it is hereby mutually agreed and declared by and between the parties hereto, That it fhall and may be lawful to and for the said W. C. at any time, to affign over unto any other fworn attorney or attornies of the faid court, the fervice and benefit of the clerkship of him the faid R. C. for all or any part of the faid term, in fuch manner as he the faid W. C. aforefaid shall think fit, (fubject ne vertheless to fuch inftructions, provifion and allowance as are hereby made for the faid R. C. in manner as aforefaid;) any thing to the contra ry thereof notwithstanding.

Liberty to put a Clerk away from his Service.

AND lafly, It is agreed by and between the parties to thefe prefents,

that if the faid B. V. fhall be wilfully difobedient to, or flothful or negligent, or shall otherwife mifbehave himself towards his faid mafter during the faid term, that then it may and shall be lawful for the faid G. W. at his difcretion, at any time then after during the faid term to put away the faid B. V. from the said service of the faid G. W. and that the faid G. W. his executors or adminiftrators, in such case shall repay unto the faid W. V his executors, adminiftrators or affigns, the like fum of money as by these presents are payable upon the death of the faid G. W. proportionably to, the time in which the faid G. W. fhall put away the faid B. V. thefe prefents, or any thing herein contained to the contrary thereof in any wife notwithstanding,

AND that he the faid W. V. his executors or administrators, shall

and will, during the faid term, provide for and allow the faid B. V. convenient apparel and washing, and in cafe of fickness or other acci. dent, by reafon whereof the faid B. V. fhall be difabled to ferve the faid G. W. as his clerk, to provide and allow unto the faid B. V. a nurse, and pay the charges of fuch doctors and apothecaries, as fhall be neceflary during fuch fickness.

HEREAS, by articles, &c. (recite the articles.) And whereas the faid E. W. ferved the faid J. B. as his clerk for the term or fpace of, &c. and the faid J. B. dying, the faid recited articles, as to the refidue of the faid term of five years fervice of clerkship to the faid' J. B. is now become void and determined: And whereas the faid E.. W. has, on the day of the date hereof, the term of, &c. to serve, (being the relidue of his faid term of five years clerkship), the refidue of which term of five years he the faid E. W. hath agreed to ferve with the faid A. S. and that he the faid E. W. will find himself with all neceffaries during the faid term, in fuch manner as herein after mentioned: Now thefe prefents witness, That he the faid E. W. (in purfuance of his faid recited agreement, and to the intent that he by his full fervice of five years clerkship may be qualified to be sworn, and act as one of the foli. citors of the faid count of chancery, doth for himself, his executors and adminiftrators, covenant with the faid A. S. his executors, adminiftrators and affigns, by these prefents in manner as follows, viz. That he the faid E. W. shall and will ferve the said A. S. as his clerk, from the day of the date hereof, for and during the faid term of one year, (being the refidue of his faid term of five years clerkship, if they the faid A. S. and D. W. fhall both so long live, and that the faid E. W. during the refidue of his faid term of clerkship, fhall and will in all respects, to the best of his power and ability, ferve the faid A. S. as his clerk, and all and every his lawful commands obey and perform, as a good clerk ought to do; And alfo that he the faid E. . during all the reûdue of his faid term of five years clerkship, fhall and will at his own charge find and provide himself with meat, drink, washing, lodging, and all other Deceffaries; and that he the faid A. S. fhall at all times be and is hereby abfolutely freed and difcharged therefrom. And these prefente further witness, That he the faid A. S. (in pursuance of his faid recited agreement, and in confideration of such fervice of him the said E. IV. as his clerk as aforefaid,) doth hereby for himself, his executors and adminiftrators, covenant with the faid E. IV. his executors and adminiftrators, that, &c.

W love and affection which he hath and beareth for the said J. S. his faid nephew, and for other confiderations him thereunto moving, he the faid E. S hath taken the faid J. S. to be his clerk, with him to dwell for the fpace of five years, to be accounted from the day of the date hereof, and it is covenanted and agreed between the faid parties in manner and form following, (that is to fay,) The faid F. S. doth covenant with the faid E. S. that he the faid F. S. fhall and will faithfully ferve, &c. (as in others.)

Articles, &c. Between T. B. of the Liberty of the Rolls, in the Parih of St. Dunstan in the Weft, in the County of Middlefex, Gent. of the one Part, and T. W. of, &c. Efq; and E. W. (Son of the faid T. W.) of the other Part, as follows, viz.

'HE faid T. B. (for and in confideration of the fum of 210. of, &c. to him the faid T. B. by the faid T: W. in hand paid, at or before the enfealing and delivery of thefe prefents, the receipt whereof the faid T. B. doth hereby acknowledge) Doth (at the inftance of, and by and with the confent of the faid T. W. teftified by his being a party to and executing hereof,) agreed to take and accept of him the faid E. . to be his clerk from the day of the date hereof, for and dur ing, and unto the full end and term of five years next enfuing, fully to be compleat and ended. And the faid T. IV. doth for himfelf, his heirs, executors and adminiltrators, covenant, promise and agree, to and with the faid T. B. his exccutors and adminiftrators, that he the faid E. hall and will continue and abide with the faid T. B. as his clerk for and during de faid term of five years, (if they both fo long live;) and that be the faid E. W. fhall and will during that time, or any further time which he may continue with the faid T. B. render a juft and true account of, and pay and deliver to him the faid T. B. upon demand, all monies and other things, wherewith he the faid E. W. fhall be intrufted by the faid T. D. or which he fhall receive, or may at any time come to his hands, as clerk or agent to him the faid T. B. or to his ufe; and that he the faid E. W. fhall not nor will during his clerkfrip neglect or abfent himself from or leave his faid mafter's butinefs or houfe, without his exprefs confent, but in every refpect, to the best of his power and ability, ferve him the faid TB. and all and every his lawful commands obey and perform, and demean himself faithfully, foberly and dutifully, as a good and diligent clerk ought to do, and shall

not nor will embezle, cancel, alter, obliterate or deface any writings, papers or records of or belonging to the faid T. B. or any of his clients which fhall come to his hands, cuftody or power, or disclose or make known any his faid master's fecrets, in prejudice of him or his clients. And in confideration of the premiffes, he the faid T. B. doth hereby covenant, promife and agree, to and with the faid T. W. his executors and administrators, to educate and inftruct him the said E. W. in the myftery of a folicitor, in the high court of chancery, according to his best skill and ability, and as other clerks who are placed with folicitors of the said court, are ufually educated and inftructed, and to find and provide him the faid E. W. fufficient and neceffary meat, drink and lodging for and during the faid five years, or fo long thereof as he the faid E. W. fhall continue to ferve the faid T. B. as aforefaid, and alfo to pay him the faid E. W. 30s. a term during that time. And the faid T. B. for himself, his heirs, executors and adminiftrators, doth further covenant, promise and agree, to and with the faid T. IV. his executors and administrators, in cafe he the faid T. B. fhall happen to die within the first year of the said term of five years, (the said E. W. him the faid T. B. furviving,) that then his heirs, executors or administrators, fhall and will refund and pay back unto the faid T. W. his executors, adminiftrators or affigns, the fum of 150l. and in cafe the faid T. B. fhall happen to die within the fecond year of the faid term of five years, (the faid E. W. him the said T. B. furviving, that then his heirs, executors or administrators, shall and will refund and pay back unto the faid T. W. his executors, adminiftrators or affigns, the fum of 100%. and in cafe the faid T. B. fhall happen to die within the third year of the faid term of five years, (the faid E. W. him the faid T. B. furviv ing,) that then his heirs, executors or administrators,, shall and will refund and pay back unto the faid T. W. his executors, administrators or affigns, the fum of 50l. but in cafe of the death of the said E. W. during the first three years of the faid term, (the faid T. B. him the faid E. W. furviving,) then no money to be returned by the faid T. B. And lastly, It is agreed by and between the said E. W. and the faid T. B. that in cafe he the faid T. B. fhall at any time during the aforefaid term of five years find it inconvenient to diet and lodge the faid E. W. in his own houfe, that then and in fuch cafe, (notwithstanding any covenant herein contained to the contrary,) the faid T. B. fhall or may be at liberty to diet and lodge him the faid E. W. where he fhall think moft convenient, in which cafe he the faid T. W. doth covenant, promife and agree, to and with the faid T. B. to allow and pay him the faid T. B. after the rate of 10l. per ann. towards the extraordinary expence and charge thereof. In witness, &c.
