AS in the last to the parcels. All thofe 5co oak timber trees and two elm trees marked with the letters E. M. with the boughs, tops and bark to them and every of them belonging, now ftanding, growing and being in or upon the farms and lands of him the faid R. H. lying and being in the parishes of S. and A. in the county of S. To have and to hold all and fingular the faid trees, with the boughs, tops and bark thereof unto the faid E. M. his executors, adminiftrators and affigns, as his and their own proper goods and chattels, and to his and their own Liberty to cut ule and ufes, from henceforth for ever. And the faid R. H. doth hereand carry them by covenant, promife and agree, to and with the faid E. M. his execuaway, &c. tors and aigns, that it fhall and may be lawful to and for the faid E. M. his executors. adminiftrators and affigns, and his and their fervants and workmen, with horfes, carts and carriages, from time to time, and at all convenient times, until the day of which fhall be in the year, &c. to enter and come into and upon the farms and lands where the faid trees or any of them are now ftanding and growing, there to fell, cut down, grub up, hew, faw, work out, convert and carry away all and every the faid trees before hereby bargained and fold, and the boughs, tops and bark thereof; and to dig and make faw-pits in the fame lands for the converting the fame trees, (doing as little hurt, damage or fpoil thereby as poffibly may be :) And that he the faid E. M. his executors, adminiftrators and affigns, fhall and may at all times hereafter peaceably and quietly have, hold, take, poflefs and enjoy all and every the before mentioned trees, and the boughs, tops and bark thereto belonging, without any let, fuit, claim, interruption or disturbance of or by the faid R. II. his heirs, executors or adminiftrators, or any perfon or perfons lawfully claiming, or which fhall or may claim the fame, by, from or under him or them. And the faid E. M. in confideration of the premiffes, doth hereby covenant, promife and agree, to with the faid R. H. his, &c. that he the faid E. M. his, &c. fhall and will well and truly pay, or caufe to be paid, unto the faid R. H. his executors, adminiftrators or affigns, the faid fum of 70%. on the day of - now next enfuing. And alfo that he the faid E. M. his, fuch a day fill &c. fhall and will within the fpace of one month next after the faid up faw-pits, day of, &c. fill up all fuch faw-pits as fhall for the purposes aforefaid have and take away been before that time made by him or his fervants, or workmen, or any ber, bark, &c. of the lazds or grounds aforefaid; and fhall and will by the time aforeor make fatif. faid carry off all the faid trees, and the timber, bark, and other ftuff faction to the thereby arifing, and clear the faid lands and grounds from the fame:

THE
"HE faid P. 7. for the confideration herein after mentioned, doth

Vide the foregoing Precedents.) And the faid L. S. for himself, &c. doth Covenant to covenant, &c. that he the faid L. S. his executors or adminiftrators, in pay the money, confideration of the faid underwoods fo fold as aforefaid, fhall and will truly pay, or caufe to be paid, unto the faid P. J. her executors, adminiftrators or affigns, the fum of of lawful, &c. on the faid, &c. which will be, &c. And likewife that he the faid L. Another for the Sale of a Parcel of Trees, wherein the Purchafors are to provide Veffels to carry them from the Seller's Wharf.

'HE faid T. R. for the confiderations, &c. doth fell, &c. (Vid.
the laft Precedent.) And the faid H. D. and T. C. covenant with
the faid T. R. That they will provide hoys, or veffels, to take and re-
ceive the faid timber trees from the faid T. R.'s wharf, from time to
time, as the fame fhall be ready there, within the time aforefaid.
And the faid H. D. and T. C. or fome or one of them, will pay, or
caufe, &c. unto the said T. R. per load for every load thereof,
fquare meafure, and proportionably for a leffer quantity than a load, as
followeth, &c. thereof on the, &c. on the remainder of the faid
money which the faid timber shall amount unto, by the measure thereof
as aforefaid, on the next following. (Penalty.) In witness, &c.

Agreed, &c. Between E. L. of, &c. of the one Part, and J. T. of the other Part, as follows, viz.

to be chofen by THE faid E. L. &c. in confideration of the fum of, to them the purchafor in hand paid at the fealing and delivery hereof, by the faid 7 T. out of a parcel in part for the timber hereunder mentioned, the receipt, &c. and for on a wharf, an the further confideration hereunder mentioned, do fell unto the faid 7. agreement to T. loads of oak timber, to be taken and chofen by the said J. T. deliver the out of the whole parcel of timber belonging to the faid E. L. and partners, and now lying on (fuch a wharf) belonging to Mr. H. S. at the rate or price of - per load; And doth agree and promife to and with the faid J. T. to deliver all the faid timber to the faid J. T.or affigns at the wharf aforefaid, when and at fuch times as he or they shall Covenant to demand, or think fit to take the fame, or any part thereof. In confipay the pur- deration whereof, the faid J. T. for himself, &c. doth hereby covenant, chafe-money. &c. that he will pay, or caufe to be paid, unto the faid E. L. his executors or affigns, over and above the faid paid at fealing hereof, all the remaining part of the monies which the faid timber fhall amount unto, at the faid price of - per load, as the fame shall measure upon the wharf, as followeth, viz. (fo much on fuch a day, &c.) And it is agreed, that if any of the pieces of the faid timber fhall fall fhort of the faid meafure as they are marked at, the faid E. T is agreed and concluded upon by and between the faid parties hereunto, and the said A. B. Hath bargained and fold, and by these prefents Doth, &c. unto the said C. D. from off the faid premiffes, the moft convenient way leading to the road that leads to — aforefaid. And the faid C. D. doth hereby for himself, his executors or adminiftrators, covenant and promise to and with the faid A. B. his heirs and affigns, that he the faid C. D. his executors or adminiftrators, fhall and will well and truly pay, or caufe to be paid, the full and intire fum of money that the faid cordwood, fo rated as aforefaid, fhall amount unto, to the faid A. B. his executors or affigns, at or upon the — day of next enfuing the date of thefe prefents. Loftly, It is fully concluded and agreed by both the faid parties, that in cafe any difference fhall happen to arife in measuring the faid cordwood, the fame shall be referred to W. P. of, &c. to deter mine and finally compofe the fame.

Articles, &c. Between T. C. of, &c. and J. N. of, &c.

THE faid T. C. for and in confideration of the payments, covenants and agreements herein after mentioned, limited, expreffed and declared, to be paid, done and performed by the faid 7. N. hath granted, bargained and fold, and by thefe prefents doth, &c. unto the faid . N. his executors, adminiftrators or affigns, all the cordwood that fhall or reasonably may be felled down, taken, cut out and cleaved, and arife from and out of one wood or certain woodlands called the F. Wood, being part of a farm and lands called H. Farm; which faid wood or woodlands are now in the occupation of the faid T. C. or his affigns, for and at the rate and price of 7s. the cord, and for every cord of wood that shall be felled, cut out and cleaved, corded up, coaled, converted or carried away, out of the faid wood or woodlands, and fo after the rate for every leffer quantity of the faid cordwood respectively, each cord of wood to be measured out, and to be 14 feet long and 5 feet high, and 3 feet over, according to the cultom of the country; and to be felled down, cut and cleaved, corded up, coaled and converted, and carried away, at the fole and proper colts and charges of the faid J. N. his executors, adminiflrators, fervants, labourers or affigns, at two fe veral fellings to be had, viz. the M. wood to be felled, cut out, cleaved, corded up, coaled, converted and carried away, on or before, &c. and the faid B. — wood, &c. to be felled, cut out, &c. on or be fore, &c. together with the benefit and advantage of colliers lodges and ladders, and liberty to coal out the fame on or in fome convenient place or places in the faid wood and woodlands aforefaid; Except and referved to the faid T. C. his heirs and affigns, fuch and fo much afh, being cop per af, or alders, from or out of any of the faid wood or woodlands, as he the faid T. C. his heirs and affigns fhall think fit and convenient; To have and to hold the faid cordwood, and every part thereof, under the confiderations aforefaid, unto the faid F.
