A Memorandum for a Building Leafe.

Memorandum, It is hereby mutually covenanted and agreed by and between E. P. of, &c. and IV. N. of, &c. Carpenter, as follows, viz.

THAT

"HAT (in confideration that the faid W. N. hath agreed to build two or more new brick meffuages or tenements on the piece of ground herein after mentioned, and in fuch manner as after expreffed) the the faid E. P. as well for herfelf as alfo for and on the behalf of her fon T. P. efq; and for their refpective heirs and affigns, Doth hereby covenant with the said W. N. his executors, administrators and affigns, as follows, (viz) That it fhall and may be lawful to and for the faid W. N. his executors, and affigns. at his or their charge forthwith wholly to pull and take down the two old houfes, and all buildings now ftanding upon the faid piece of ground, and all the timber, bricks, and other materials thereof to carry away, convert, fell or dif pofe thereof, to and for his and their own ufe and benefit, in fuch manner as he or they fhall think fit, without being liable to render or give any account for the fame unto the faid E. P. or T. P. or either of them; And that they the said E. P. and T. P. their heirs or affigns, fhall and will, at the request and charge of the faid W. N. his executors or affigns, make and duly execute and deliver unto him and them, one or more good and fufficient leafe or leafes, whereby the said E. P. and T. P. their heirs or affigns, fhall demite and let unto the said W. N. the said picce or parcel of ground, fituate, &c. containing the dimensions following, viz. on the Eafl fide thereof 48 feet, on the South fide thereof 50 feet, on the Weft fide thereof 38 feet and 6 inches, and in part on the North fide thereof 46 feet and 6 inches, and on the other North part thereof 17 feet and 11 inches, be the fame feveral dimensions refpectively more or lefs, which faid piece of ground, together with the abuttals thereof, are more particularly delineated and defcribed in a plan or ground-plot thereof hereunto annexed; To bold unto the faid W N. his execusors, adminiftrators and affigns, from Lady-day now next enfuing the date hereof, for and during, and unto the full end and term of 6: years from thence next ensuing; Filding and paying there. fore unto the faid E. P. and T. P. their heirs and affigns, for the first year of the said term, the rent of one pepper-corn only, and for the latt 60 years of the faid term the yearly rent or fum of 157. the fame yearly rent to be paid quarterly on the four feafts or quarter-days following, viz. &c. by four equal proportions; the fit of which quarterly pay ments to begin, &c. In which faid leafe or leafes fhall be contained fuch covenants as are ufually inferted in London building leafes, as well on the part of the leffors as of leffees, and alfo the ufual provifo or condition for leffors to re-enter on the faid leafed premiffes in cafe of non-payment of the faid yearly rent of 15. within 21 days next after each quarter's rent due for the fame. And the faid W. N. (in contideration of the premiffes) Doth hereby for himself, his executors, administrators and affigns, covenant and agree with the faid E. P. her heirs

and affigns, in manner as follows, viz. That he the faid W. N. his; &c. fhall and will, at his and their own proper costs and charges, forthwith pull and take down the faid two old meffuages or tenements now flanding on part of the faid ground, and clear away all the old materials thereof; and alfo, That he the faid W. N. his, &c. or fome or one of them, fhall and will, at his and their like proper cofts and charges, on or before the, &c. erect, build, fet up, tile, and in all refpects completely finish in a good workman-like manner, upon the faid piece of ground fo to be demifed as aforefaid, or upon fome part thereof, two or more good and fubftantial new brick meffuages, tenements or dwellinghoufes, with cellars and vaults of fuch proper dimenfions, and with fuch party walls, conveniencies and other neceffaries to the fame as fhall be requifite and fitting, according to the manner of building new houfes, as now used in London; And that the faid two new houses fhall be built in front next the faid court, to range with the faid two new meffuages there now built by the faid, and that as to the uppermost of the faid two houses so to be built, the fame fhall not exceed, extend or be above two feet forward in building than the faid houfe there adjoining on the Weft, and lately purchased by W. W. And alfo that he the faid W. N. his executors, adminiftrators or affigns, on the making to him or them of fuch leafe as aforefaid, fhall at his or their charges then duly execute and deliver a counterpart of fuch leafe to the leffor thereof. And lastly, That fuch leafe fhall be made by fuch perfon or perfons as fuch leffor fhall direct or appoint to make the fame. In witness, &c.

Agreement between a Company in London, and a Bricklayer, for execut ing a Building Leafe.

At a General Court of the Worshipful Company of M. London, held at their Hall on the Day of Anno Domini

IT T is agreed, That 7. L. of, &c. citizen, tiler and bricklayer, of London, fhall have a leafe of the ground and old houfes ftanding thereon, fituate, &c. (late in leafe to S. T. efq;) To hold for fifty-one years from Midfummer 17. Yielding and paying therefore to the faid company, by quarterly payments, the rent or fum of 321. per ann. during the faid term, free and clear of all manner of taxes, affeffed or to be affeffed by authority of parliainent or by any other power or authority whatfoever, which faid taxes are to be paid and difcharged by the tenant during the said term: And the faid J. L. in confideration thereof, doth hereby covenant for himself, his executors, adminiftrators and affigns, to and with the faid company and their fucceffors, that he the faid F. L. his executors, adminiftrators or affigns, or fome of them, fhall and will. within two years from the date hereof, lay out and expend the fum of 700l. of lawful British money, in re-building the faid houses, and also fhall and will employ the old materials in and about rebuilding the fame; and will schedule all the things fixed or fastened to the premiffes when the building is finifhed, and the leafe is to contain thefe and fuch

other covenants as are contained in the last lease made of the premiffet, and will execute a counterpart thereof upon demand, and pay the accuf tomary fees for the fame: And W. R. of, &c. efq; for himself, his heirs, executors and adminiftrators, doth covenant, promife and agree to and with the faid company and their fucceffors, that the faid . L. or the faid W. R. or one of them, or their or fome or one of their executors or administrators, fhall and will expend and lay out the faid 700l. of lawful British money, in rebuilding the faid houfes within two years from the date hereof; and when the building is finished, will schedule all the things to the faid leafe which is to contain these and fuch other covenants as were contained in the laft leafe made of the premiffes: and further, the faid F. L. or W. R. their executors, adminiftrators or af figns, or fome or one of them, fhall and will, during the faid term, pay the faid rent of 321. per ann. as the fame thall become due, in manner aforefaid, and obferve, perform and keep all other the covenants in the faid leafe to be made to the faid J. L. In witness whereof the faid 7. L. and W. R. bind themselves, their heirs, executors and adminiftrators, unto the faid wardens and commonalty and their fucceffors, in the penal fum of 500l. the day and year abovefaid.

An Agreement for the Leffor to make a Leafe of feveral Clofes of Meadow for the Remainder of his Term of Years unexpired, except one Month, the Leffee to pay the Leffor, on being put in Poffeffion, for the Leffor's Improvements; to pay Rent, to dung the Ground, Repair, but not to dig for Gravel, &c. and that if the Leffor takes a new Leafe, he fball likewife make a new Leafe to his Leffee, and to make a Leafe of other Leafebold Premiffes, of which the Tenant is ejected. Habend. from the Time of his being reflored, he having for Non-payment of Rent filed a Bill in Chancery, for Relief; the Tenant's Leffee to pay off the Arrears to the Origi nal Landlord; Liberty to dig for Gravel, &c.

K. hath improved the faid lands by laying dung thereon and otherwife: Now it is agreed by and Agreement to between the faid parties to thefe prefents, and the faid B. whereas the said B. K. or those under whom he claims, have built and
erected upon part of the faid premiffes, a meffuage, tenement or inn,
now called, &c. And whereas the faid M. W. and R. W. have lately but the tenant
entered upon and taken poffeffion of the faid premiffes by virtue of a judg- is ejected for

time to time with good earth or foil, at his own charge, and to pay of or allow out of the rent of the faid clofes yearly for every acre that he fhall fo dig, or caufe to be dug for gravel; fo proportionably for a greater or leffer quantity than an acre, until the fame fhall be filled up again. And it is further agreed, that the faid M. L. fhall have ready and pay down —— 1. for and upon the account and behalf of the faid B. K. at fuch time and place as the court of chancery fhall appoint and direct the faid B. K. to pay fuch fum of money as shall be due and in arrear to the faid R. IV. and M. W. or either of them, for rent of the premiffes above mentioned, with other lands demifed, by them by the leafe before mentioned. And the faid B. K. is to give to the said M. L. fuch fecurity for the repayment thereof and intereft, as both parties fhall agree upon and think fufficient. In witness,

An Agreement for making an Aurance of Land in Fee under a yearly Rent, for the Grantee to build a Houfe thereupon, with special Limitations how it fhall be built, as to Height, Front, Pavement, &c.

Articles, &c. Between H. E. of, &c. of the one Part, and A. S. of, &c. of the other Part, as follows:

THE
HE faid H. E. and his truftees fhall and will, at the request, cols
and charges of the said A. S. by good affurance in the law, con-
vey and affure to him the faid A. S. All that piece or parcel of ground,
&c. in the parish of, &c. in the county, &c. containing in front

feet, and in depth backwards —— feet, lying between the other ground of the faid H. E. on the South, and other ground of the faid H. E. on the North; one head or end thereof abutteth upon the intended piazza there towards the Eaft, and the other head or end thereof abutteth upon the yards or gardens of, &c. towards the Weft, and all the eitate, &c. in or to the faid, &c. or of, in or to any part or parcel thereof; except and always referved to the faid H. E. his heirs and af figns, free liberty of ingrefs, egrefs and regrefs into and from the ftables of the faid A. S. belonging to the faid house already built there, with his and their fervants, horfes, coaches and other carriages of all kinds whatsoever, in, by and through a way or paffage made, or intended to be made, at the lower end of the faid piece or parcel of ground, &c. of about feet wide; To have and to hold the faid piece or parcel of ground, except as before excepted, unto the said A. S. his heirs and affigns, to the only use and behoof of the faid A. S. his heirs and affigns for ever; Tielding and paying, therefore to the faid H. E. his heirs and affigns yearly and every year for ever, the yearly rent or fum of, &c. always at the feafts of, &c. by even, &c. the first payment, &c. (infert here, that in fuch affurance there fhall be claufes of diftrefs and re-entry, and the tenants covenant to pay the rent.) And that he the faid H. E. his heirs and as figns, fhall not be interrupted in coming to the faid stables, yard and houfe of the faid H. E. in, by and through the intended way aforefaid, by him the faid A. S. his heirs or affigns, or any claiming or de riving title to the premiffes, by, from or under him, them or any of
