county of Clermont, and their associates, be, and they are hereby created a body corporate and politic, by the name and style of the "East Fork Road and Bridge Company," and as such, shall remain and have perpetual succession; and by their corporate name, may contract and be contracted with, sue and be sued, answer and be answered, plead and be impleaded, defend and be defended, in any court having competent jurisdiction.

Sec. 2. That the said corporation be, and they are hereby authorized to construct a graded road, not to exceed five degrees in elevation, from some convenient point at the south end of the town of Milford, in said county of Clermont, to the East Fork of the Little Miami river, and from thence to some eligible point on the Anderson State Road in said county, not exceeding five miles from the East Fork of the Little Miami, and erect a bridge over the said East Fork, near its junction with the main river.

Sec. 3. That if said company shall construct said road, and complete said bridge in a substantial manner, of proper width, and being in other respects of sufficient strength and dimensions, so as to admit of the safe passage of passengers, teams and carriages of the usual dimensions, within three years from the passage of this act, they shall, from the time of completing said road and bridge, enjoy all the privileges secured to them by this act.

Sec. 4. That the said company are hereby authorized to open books in the town of Milford, in said county of Clermont, and such other places as they may deem proper, to receive subscriptions to the stock of said company, in shares of twenty-five dollars each, which books shall be opened at such times and under such regulations as may be directed by a majority of the persons named in the first section of this act.

Sec. 5. That when eighty shares shall have been subscribed to the stock of said company, it shall be the duty of the persons named in the first section of this act, to call a meeting of the stockholders, by giving notice in the usual manner, at least twenty days prior to the time of such meeting, for the purpose of electing seven directors to manage all the concerns of said company; all votes for directors shall be by ballot, and each shockholder shall have one vote for each share he may hold in said company; stockholders may vote by proxy, under such regulations as may be prescribed by the by-laws of said company; the directors thus elected shall take an oath of office, and hold their office for one year and until their successors are elected and qualified.

Sec. 6. That so soon as the said company shall have completed the said road and bridge, they shall apply to the commissioners of the said county of Clermont, whose duty it shall be to appoint a disinterested person to examine said work, and report to the said company in writing; and if such report shall state that the said road and bridge are completed in accordance with the provisions of this act, then the said company are hereby authorized to demand and receive from all persons who may pass on the said bridge, the following rates of tolls, while the same is kept in good repair, to wit: For each foot passenger, two cents; for each horse and rider, six and one-fourth cents; for every four-wheeled carriage, drawn by two hor ses or oxen, twelve and one-half cents; for every horse or ox in addition, three cents; for every two-wheeled carriage, drawn by two horses or oxen, ten cents; for every horse or ox in addition, three cents; for every sled or

sleigh, drawn by two horses or oxen, six and one-fourth cents; for every horse or ox in addition, three cents; for every horse, mule or ass, led or driven, six months old or upwards, one cent; for every score of neat cattle, six months old or upwards, twelve and one-half cents; and a less number in proportion; for every score of sheep or hogs, six and one-fourth cents; for every four-wheeled pleasure carriage, drawn by two horses, eighteen and three-fourth cents; for every ho rse in addition, three cents; for every two-wheeled pleasure carriage, drawn by one horse, twelve and one-half cents, for every horse in addition, three cents; for every fourwheeled carriage, drawn by one horse, twelve and one-half cents: Provided, That all persons going to, or returning from public worship, funeral processions, and all persons necessarily going to, or returning from all military trainings, shall pass said bridge exempt from toll.

Sec. 7. That the proprietors of said bridge shall, previous to receiving any toll, set up and keep in some conspicuous place, over or near the gate to be erected on said bridge, a board, on which shall be printed in a plain and legible manner, the rates of toll allowed by this act.

Sec. 8. That if the proprietors of said bridge shall demand or receive any higher rates of toll than is allowed by this act, they shall be subject to the like fines and penalties which are or may be provided in case of ferries; and in ten years after the completion of said road and bridge, it shall be in the power of every Legislature to make such alterations in the rates of toll herein established, as to them shall appear, from time to time, equitable and just.

Sec. 9. That the said company shall have power to adopt such bylaws, rules and regulations for the government of the same, as they may deem expedient, not inconsistent with the constitution and laws of the United States and of this State: Provided, that the stockholders shall be held individually liable for all the debts of the company: Provided, The corporate funds of the company shall be first exhausted.

Sec. 10. That any future Legislature may alter, amend or repeal this act.

AN ACT

To authorize a review of a certain State Road in the counties of Allen and Mercer.

Sec. 1. Be it enacted by the General Assembly of the State of Ohio, That Charles Watkins, Thomas Coats and James Grant, of the county of Mercer, be, and they are hereby, appointed commissioners to review and relocate a State Road, commencing at the town of Knoxville, in Allen county, and running westwardly by the town of Montezuma, in Mercer county, to intersect the Greenville and Willshire road, which road was laid out under the provisions of an act of the General Assembly of the State of Ohio, passed December 19th, 1836, and an amendatory act thereto, passed

March 10th, 1837; that it shall be the duty of said commissioners to adopt as their location, the old county road, running nearly in the same direc tion of the present State road, as far as practicable, and so much of said State road as is now located, which shall not be adopted by said commis sioners, shall become vacated; any thing in the before cited act to the contrary notwithstanding.

That the commissioners, in all other respects, shall be govern ed by the law now in force, defining the mode of laying out and establishing State roads, passed March 14th, 1831.

Relative to the Superintendent of Common Schools.

Resolved by the General Assembly of the State of Ohio, That the Secretary of State be, and he is hereby authorized to furnish Samuel Lewis, Esq. Superintendent of Common Schools, with the general laws of Ohio; and that he have access to the State Library while in Columbus, under the usual rules.

RESOLUTION

Requesting the Governor to transmit a certain act to the Governor of Pennsylvania.

Resolved by the General Assembly of the State of Ohio, That His Excellency, the Governor, be requested to transmit to the Governor of Pennsylvania a certified copy of "An act further to amend an act incorporating the Pennsylvania and Ohio Canal Company," passed March 29, 1837, with a request that he would lay the same before the Legislature of that State for their concurrence and confirmation.

RESOLUTION

To provide for the binding of "An Index to the Laws and Resolutions."

Besolved by the General Assembly of the State of Ohio, That Z. Mills, Esq., State Librarian, be, and he is hereby authorized to have bound in what is commonly called extra half binding, one thousand copies of "An Index to all the Laws and Resolutions of the State of Ohio, including the laws adopted and enacted by the Governor and Judges and the Territorial

Legislature, from the commencement of the Territorial Government to the year 1835-6, inclusive," and deposite in the office of the Secretary of State, subject to the future disposition of the Legislature.

RESOLUTION

Requiring the Auditor of State to furnish certain information relative to banks.

Resolved by the General Assembly of the State of Ohio, That the Auditor of State be required to procure from the banks of this State, a statement of their respective conditions, according to their weekly statements, on or about the eleventh day of May and the first day of December, eighteen hundred and thirty-seven, verified by affidavit of the cashiers or presidents; and that in such statements, the officers of the banks be requested to spe cify the following items:

1. The amount of capital stock subscribed and paid;

2. The amount of loans or deposites bearing interest;

3. The amount of current deposites, public and private;

4. The amount of notes in circulation; and the amount thereof of less denomination than 'five dollars, and the amount of less denomination than one dollar; and also the amount of notes and checks payable on time; 5. The amount due banks, eastern and western;

6. The amount of profits on hand, and of other liabilities;

7. The amount of specie owned by then and actually in their vaults, subject to the redemption of their bills, on the twenty-third day of May last, and also on the first day of December instant; the notes of other western banks, and the notes of eastern banks;

8. The amount due by banks in eastern cities;

9. The amount due by western banks;

10. The amount of debts due the bank;

11. The amount of real estate and other investments;

12. The amount of loans to directors and stockholders, with security, and also without security;

13. The amount of gold coin, silver coin, or bullion sold, if any, since the suspension of specie payments in May last, and whether to banks or individuals, and the rate of premium received; and if so sold, to report whether the same was sold to foreign banks, and to what foreign banks, and the amount sold to each.

14. The amount of specie bought or procured, and where procured, by the banks since the first of July, 1836, and also since the 11th of May, 1837, and the expense thereof;

15. The amount of specie paid out in discharge of current demands against the banks since the 15th of July, 1836, and the amount thereof since May, 1837;
