conditioned for the safe keeping of the same, and their return to the State upon the order of the Quartermaster General; which bond, for any breach of the conditions thereof, shall be prosecuted to final judgment and execution in the name of "The Quartermaster General of the State of Ohio," and the amount, when collected, shall be paid into the State Treasury, to be expended in the purchase of ordnance and arms.

AN ACT

To incorporate the First Congregational Society of Bath, in Medina county.

Sec. 1. Be it enacted by the General Assembly of the State of Ohio, That Eleazer King, William Hale, Royal Hammond, Joseph Fulton, Phineas Nash, and Theodore Hammond, and their associates and successors, be, and they are hereby, created a body corporate and politic, under the name and style of the "First Congregational Society of Bath, in Medina county," agreeably to an act passed March 5th, 1836, entitled "An act in relation to incorporated religious societies;" and shall hold their first meeting for the election of officers, by the persons named in this act, or a majority of them, giving at least ten days' notice, in writing, posted up in three public places within the limits of the society, of the time and place of holding said meeting.

AN ACT

Further to amend the several acts relative to the town of Rossville, in the county of Butler.

Sec. 1. Be it enacted by the General Assembly of the State of Ohio, That the mayor and council of the town of Rossville, shall be, and they are hereby authorized and empowered to levy a tax on the real and personal property, subject to taxation within the corporation of said town, as the same has been or shall be appraised, and returned on the grand levy of the State, not to exceed, in any one year, one per centum on the aggregate value of the same, within the limits aforesaid.

Sec. 2. That the mayor or council, are hereby authorized and empowered, when they may deem it expedient, to exempt any member or members of the fire department, duly organized in said corporation, from the further

performance of labor, upon the public highways, as now required by the laws of the State.

Sec. 3. That so much of the act entitled "An act supplementary to An act entitled 'An act further to amend the act entitled 'An act to incorporate the Trustees and Inhabitants of the towns of Hamilton and Rossville, in the county of Butler," passed January 15, 1833, as is inconsistent with this act, be, and the same is hereby repealed.

AN ACT

For the relief of John Bell.

Whereas, it has been represented to this General Assembly, that John Bell, superintendent of Western Reserve and Maumee road, has expended, during the last year, the sum of four hundred and sixty-four dollars forty-nine cents, in making repairs on said road, over and above the sums received from the sales of lands belonging to said road; and whereas, it is also represented that the funds in the State Treasury belonging to said road are amply available to pay said sum; Therefore,

Sec. 1. Be it enacted by the General Assembly of the State of Ohio, That the Auditor of State be, and he is hereby authorized to draw an order on the State Treasurer in favor of the said John Bell, for the sum of four hundred sixty-four dollars forty-nine cents; to be paid out of any moneys belonging to the fund appropriated to the construction and improvement of the Western Reserve and Maumee road.

AN ACT

To authorize the making a protracted index to titles of real property in the county of Hamilton.

Sec. 1. Be it enacted by the General Assembly of the State of Ohio, That the county commissioners of Hamilton county be, and hereby are, authorized and required, if in their opinion the public good require it, to appoint some suitable person to make out a complete protracted index to the recorded titles of town and country property in said county, in such form

as said commissioners shall deem proper, to be placed and kept among the records of said county, for the inspection of all persons.

Sec. 2. That said county commissioners shall allow to the person so making such index, a suitable compensation therefor; the amount of which shall be paid out of the treasury of the county on the order of the auditor.

Sec. 3. That it shall be the duty of the recorder of said county for the time being, after such index shall be so made and completed, from time to time, as he shall record any deeds or mortgages, to continue such index on the same plan, for which he shall receive such compensation as the county commissioners may from time to time deem proper, out of the treasury of the county, upon the order of said commissioners; and for the strict performance of the duties required by this act, the recorder shall be subject to the same penalties as are provided by the eighth section of the act entitled "An act to provide for the election of county recorders, and prescribing their duties," passed February 25th, 1831.

AN ACT

To incorporate Logan College.

Sec. 1. Be it enacted by the General Assembly of the State of Ohio, That James Wallace, Joseph Stephenson, John B. Johnson, Thomas B. Clark, Hiram McCartney, James Gamble, John Shelby, Samuel Newell, Abraham Elder, Lawson Curtis, Samuel Hindman, and Joseph Ordway, of the county of Logan, Samuel Clelland, of Shelby county, George Vaneman, of Hancock county, William Cunningham, of Allen county, Porteus Wheeler, of Hardin county, Joseph Vance, James Dallas and William Ward, of Champaigne county, James Ewing, of Union county, and William Neil, of Franklin county, and their successors, be, and they are hereby created a body corporate, to be styled "The Trustees of the Logan College," with full power to acquire, hold and transfer property, personal and real; make contracts, sue and be sued, plead and be impleaded, to have and use a common seal, and to alter or destroy the same at pleasure; but the powers hereby given shall not extend further than in their corporate capacity, and in such things only as may be necessary and proper for said college; and the whole property and estate of said corporation shall be applied exclusively to that purpose.

Sec. 2. That the said college shall be located in the town or vicinity of Bellefontaine, Logan county.

Sec. 3. That before the above named trustees shall have power to add to their number, appoint a chairman of their own board, a president and professors, and such other officers and servants as they may think necessary, to hold their offices under such rules and regulations as the trustees may prescribe; and pay the president, professors and other officers, such com

pensation for their services as they may think proper; and three-fifths of the trustees shall have full power and authority to make by-laws, rules and regulations for the government of said college, and transact any business appertaining to the interest of the corporation: Provided, That said by-laws, rules, regulations and transactions be not repugnant to the constitution or laws of this State or of the United States, not inconsistent with the true intent of this act.

Sec. 4. That the first meeting of the trustees hereby appointed, shall be held in the town of Bellefontaine on the first day of May next, and at such time and place thereafter as may be agreed on by the board, or fixed by the chairman thereof; and in case said meeting shall be called by the chairman, he shall notify the board of the time and place of holding such meeting, either by personal service, or by advertisement published in some newspaper in general circulation in the county where said college is situated, for the term of three weeks before the time so fixed.

Sec. 5. That should any trustee hereby appointed, or hereafter to be chosen, refuse to serve, or fail to attend the regular meetings, on such refusal or failure, the seat of such trustee may be declared by the board to be vacant, and they may proceed to fill such vacancy according to the provisions of this act: Provided, however, That nothing herein contained shall be so construed as to take away the right of the Legislature to alter or amend this act.

AN ACT

Providing for a loan to the Ohio University.

Sec. 1. Be it enacted by the General Assembly of the State of Ohio, That the Commissioners of the Canal Fund are hereby authorized to lend to the Ohio University, from the moneys belonging to the Sinking Fund, the sum of five thousand dollars, to be repaid in annual instalments of one thou sand dollars each, and to bear an annual interest of six per cent., and the interest payable annually.

Sec. 2. The Commissioners of the Canal Fund shall require real or personal security to be given to their satisfaction, for the payment of the debt and interest, and such security shall be at double the amount loaned.

AN ACT

To lay out and establish a graded State Road in the counties of Monroe and Guernsey.

Sec. 1. Be it enacted by the General Assembly of the State of Ohio, That James Henthon and Michael Miller, of Monroe county, and Jacob Grigg, of Guernsey county, be, and they are hereby, appointed commissioners, and Mitchell Atkinson, of Monroe county, surveyor, to lay out and establish a graded State road, commencing at Tuel's landing, opposite the lower end of the town of Sistersville, in the State of Virginia; thence the nearest and best route to the house of Dennis Pool, in Monroe county; thence the nearest and best way to the cross streets in the town of Graysville, in said county; thence the nearest and best way to the town of Van Buren, in said county; thence the best way to the town of Cumberland, in Guernsey.

Sec 2. That said road shall in no place or part thereof, exceed an angle of six degrees with the horizon.

Sec. 3. That the commissioners aforesaid, shall, in all respects, be gov erned by the law now in force, defining the mode of laying out and establishing State roads; and should either of said commissioners die, refuse to serve, or remove out of his respective county, the commissioners of the county in which such vacancy may occur are hereby authorized to fill the

same.

AN ACT

To incorporate the First Baptist Church of Elyria, in the county of Lorain.

Sec. 1. Be it enacted by the General Assembly of the State of Ohio, That Luther Hartson, Horace K. Kendall, Francis Kendall, Alva Colburn, L. T. Dryer, L. Hartson, Edgar F. Munson, Lewis Andrews and their associates, and those who may be hereafter associated with them, be, and they are hereby, created a body politic and corporate, by the name of the "First Baptist church of Elyria," agreeably to an act passed March 5th, 1836, entitled "An act in relation to incorporated religious societies," and shall hold their first meeting for the election of officers by the persons named in this act, or a majority of them, giving ten days' notice, in writing, posted up in three public places in said town, of the time and place of holding the

same.
