The Council met.

PHILADELPHIA, Thursday, February 25th 1790.

PRESENT:

A letter from Daniel Brodhead, Esquire, Surveyor General, dated February twenty-third, iustant, informing Council that he has appointed George Palmer, Esquire, Deputy Surveyor of all the county of Northampton, and submitting the said appointment to Council for their approbation, agreeably to act of Assembly passed the eighth day of April, 1785, was received and read; and thereupon

Resolved, That Council approve of the said appointment, and that Jonas Hartzell and John Arndt, Esquires, be accepted as sureties for the said Deputy Surveyor.

The Council met.

The Comptroller and Register General's reports upon the account of James Watts, of Northumberland county, for a rifle gun which he delivered to John Brady, who was in actual service in the militia, and was wounded, and lost the same at the battle of Brandywine, valued at seven pounds ten shillings, was read and approved.

A letter from His Excellency the President of the United States of the twentieth of February, 1790, inclosing an act passed in the second session of the Senate and House of Representatives of the United States, entitled "An Act for giving effect to the several acts therein mentioned in respect to the State of North Carolina, and other purposes," was received and read, and a letter written by the President of the State acknowledging the receipt of the said letter and inclosure.

Upon application of William Todd, Esquire, of the right of pre-emption to a certain island in the river Allegany, nearly opposite to and above the mouth of Buffaloe creek, containing about twenty-five or thirty acres, upon which he has made a sinall improvement, it was

Resolved, That the said island be granted to the said William Tod upon his paying for the same at the rate of twenty five shillings per acre in certificates of this State, interest to be computed from this date.

The Comptroller and Register General's reports upon the account of Towers and Evans for glass, and of George Flake for glazing windows, which were broke by the discharge of cannon at the proclamation of the President and Vice President, on the eleventh day of November, 1789, amounting to eight pounds five shillings and four pence, was read and approved; for which sum an order was drawn upon the Treasurer.

The Council met.

John Barclay was re-appointed and commissionated a Justice of the Peace and of the Court of Common Pleas in and for the county of Bucks, upon a return of an election held according to law in the district of the townships of Springfield, and Haycock, in the said county, to supply the vacancy occasioned by the expiration of the said Barclay's former commissions for the said offices.

On motion, it was

Resolved, That John Barclay, Esquire, be continued in the offices of President of the Court of Common Pleas and of the Court of General Quarter Sessions of the Peace and Jail Delivery of the county of Bucks, and he was commissionated accordingly.

Upon farther consideration of the petition of Thomas Wright of Bucks county, and a respectable recommendation from the Repre sentatives of the said county in Convention and Assembly, from several Justices of the Peace, and a number of inhabitants, it was

Resolved, That the sum of fifteen pounds, now due by the peti tioner to the Commonwealth, being the remainder of a fine of fifty pounds to which he was sentenced by the Court of General Quarter Sessions of the Peace of said county, for an assault and battery upon Joseph Thomas, be and the same is hereby remitted.

On motion,

Resolved, That Thursday next be assigned for the consideration of the memorial of Edward Williams, relative to his claim against the State for his services as Chief Clerk in the late Military Hospital department.

The Council met.

The Comptroller and Register General's reports upon the account of Jacob Krug, Esquire, Treasurer of the county of Lancaster, of monies received by him for taxes of the years 1787, 1788 and 1789, amounting to eleven thousand eight hundred and seventyfour pounds eight shillings and nine pence, was read and approved.

Mr Martin was appointed a Member of the Board of Property for the present month.

The Council met.

The following orders were drawn upon the Treasurer, vizt:

In favor of Charles Biddle, Esquire, for the sum of fifty pounds, for defraying the expence of lighting the lamps in the State House yard, and for paying wages to the watchman employed in guarding the public offices in and about the State House and the Public Treasury, pursuant to act of Assembly passed the twenty-seventh day of March, 1789.

In favor of Frederick Sneider, for fourteen pounds, seven shillings and six pence, in full of his account for one month's wages as Doorkeeper to Council, ending the twenty-eighth of February, 1789, and cash paid for carrying up wood.

The Comptroller and Register General's reports upon the account of William Nichols, for a gun delivered to one of the SubLieutenants of Chester county in the year 1778, for public use, valued at six pounds ten shillings Continental money, amounting in specie to one pound twelve shillings and six pence, was read and approved.

Upon the petition of James Moore, of Lancaster county, for the pardon of his Negro man Joseph, who was convicted of a Robery at a Court of Oyer and Terminer, and General Jail Delivery held on the twelfth day of May, 1788, in the said county, and sentenced by the said Court to undergo a servitude at hard labour for the term of seven years, &ca; it was

Resolved, That the said Negro Joseph be and he is hereby par doned.

The further consideration of the petition Edward Williams for commutation of pay as Chief Clerk in the Hospital Department was postponed untill Thursday next.

A petition from Walter Hood, of Chester county, praying that Council would be pleased to remit a fine of ten pounds, which was

imposed upon him by the Court of General Quarter Sessions of the Peace of the said county for keeping a tipling house contrary to law, was read the second time, and it appearing that the said Court has since the conviction recommended the petitioner for a licence to keep a public house,

Resolved, That the said fine be remitted.

Two letters from Daniel Brodhead, Esquire, Surveyor General, dated the twenty third of February, 1790, informing Council that he has appointed the following gentlemen to be deputy Surveyors, were received and read, vizt:

Benjamin Lodge, Esquire, to be Deputy Surveyor of a district bounded and described as follows, vizt:

Beginning at Fort Pitt, and from thence extending up Mononga hela river to the mouth of Youghiogeny river, thence up the same to the mouth of Jacobs creek, thence up the said creek to Cherry's Mill, thence by the line of Fayette county to the line di- . viding the counties of Bedford and Westmoreland, thence along said line to the great road leading from Bedford to Fort Pitt, thence along said road (through Hannas Town) to the beginning, and likewise of the district Number 5, in the Donation Lands.

And John Moore, Esquire, to be Deputy Surveyor of a district bounded and described as follows, to wit:

Beginning at Pittsburgh, and from thence extending up the Allegany river to the mouth of the river Kiskamanetas, thence up the same to the mouth of Loyalhanning creek, thence up Conemaugh river to Bedford county line, thence by the same to the Old Pennsylvania road, thence along said road by Ligonier, Proctors', Hannas town, Meyers, Elliotts, &ca., to the beginning, and submitting the said appointments to Council for their approbation agreeably to act of Assembly, dated the eight of April, 1785; whereupon, it was

Resolved, That Council approve of the said appointments, and that the following gentlemer be accepted as sureties for the said Deputy Surveyors, vizt:-John Baird and William Findley, Esquires, for Benjamin Lodge; and William Jack, and Daniel St. Clair, for John Moore.
