Application of

the Fines.

Perfon fo offending, fhall, for every fuch offence, forfeit the fum of Fifty Pounds Current money of this Province,over and above every other Penalty or Punishment he or they may be adjudged to bear and fuffer by reafon of his or their refifting or obftructing the legal execution of any Warrant of fearch as aforefaid; And in cafe any perfon fhall wilfully make any falfe Oath touching the matters aforefaid, and be thereof lawfully convicted, he fhall be liable to the Pains and Penalties inflicted on the crime of wilful and corrupt perjury by the Statute paffed in the fifth year of the Reign of Queen Elizabeth.

XVIII. And be it further enacted by the authority aforefaid, that all the Fines and Forfeitures by this Act impofed fhall be recoverable with cofts in the fame manner as other debts of the fame value are recoverable in this Province by fuit, bill, plaint or information, the one moiety of all which Fines and Forfeitures (except fuch as are herein before otherwife applied) when recovered fhall be immediately paid into the hands of the Receiver General, for the ufe of His Majefty towards the fupport of the Government of this Province, and fhall be accounted for to his Majefty through the Commiffioners of His Majefty's Treasury for the time being, in fuch manner and form as His Majefty fhall direct, and the other moiety to the officer or perfon who fhall fue for the fame.

XIX. And be it further enacted by the authority aforefaid, that if any action or fuit shall be commenced against any person or perfons for any thing done in purfuance of this Act, fuch action or fuit fhall be commenced within the space of fix Calendar Months next after the offence fhall have been committed and not afterwards, and the Defendant or Defendants, in fuch action or fuit, may plead the general iffue and give this A&t and the special matter in evidence at any Trial to be had thereupon, and that the fame was done in purfuance and by authority of this Act, and if it shall appear fo to have been done, then the Court fhall find for the Defendant or Defendants, and if the Plaintiff fhall be non-fuited or difcontinue his action after the Defendant or Defendants fhall have appeared, or if Judgment fhall be given against the Plaintiff, the Defendant or Defendants fhall and may recover treble cofts, and have the like res medy for the fame as Defendants have in other cases by Law.

XVIII. Et qu'il foit de plus ftatué par l'autorité susdite, que toutes les amendes et confifcations impofées par cet Acte feront recouvrables avec les frais de la même manière que d'autres dettes de la même valeur font recouvrables dans cette Province par poursuite, bill, plainte ou information, moitié de toutes lefquelles amendes et confifcations (excepté celles qui font autrement appliquées par le préfent Acte) après avoir été recouvrées, fera immédiatement payée entre les mains du Receveur Général pour l'ufage de Sa Majefté, pour le foutien du Gouvernement de cette Province, et il en fera tenu compte à Sa Majefté, par la voie des Commiflaires du Tréfor de Sa Majefté pour le tems d'alors en telles manière et forme que Sa Majefté ordonnera, et l'autre moitié à l'Officier ou autre perlonne qui en fera la pourfuite.

HEREAS an A&t was paffed by the Legiflature of this Province in the forty-firft year of His Majefty's Reign, intituled, "An Act to ratify and confirm certain Provifional Articles of agreement entered into by the respective Commiffioners of this Pro"vince and of Upper Canada, at Quebec on the fecond day of February one thousand eight "hundred and one, relative to duties, and for carrying the fame into effect, And alfo to continue an At paffed in the thirty feventh year of His Majefty's Reign," which ar ticles of agreement will expire on the first day of March which will be in the year of Our Lord one thoufand eight hundred and five; And Whereas it is neceffary that other Commiffioners be appointed to treat with fuch Commiffioners as are or may be nominated and appointed on behalf of the Province of Upper-Canada: Be it enacted by the King's moft Excellent Majefty, by and with the advice and confent of the Legiflative Council and Affembly of the Province of Lower-Canada, conftituted and affembled by virtue of and under the authority of an A&t of the Parliament of Great Britain, intituled," An A&t to repeal certain parts of an A&t paffed in the fourteenth 66 year of His Majefty's Reign, intituled, "An Act for making more effectual provifion for the Government of the Province of Quebec in North America;" And to make fur"ther provifion for the Government of the faid Province;" And it is hereby enacted by the authority of the fame, that the Honorable James M'Gill and John Lees, John James M'Gill, Richardfon, Jofeph Papineau, Jofeph Périnault, Maurice Blondeau, Louis Guy, fils John Lees, John and Samuel Gerrard, Efquires, fhall be and they are hereby conftituted and appoin Richardson, Jofeph Papineau, Jofeph ted Commiffioners on the part of this Province, who or any three of whom are au Périnault, Maurithorized and empowered to meet, treat, confult and agree with fuch Commiffioners as are or may be appointed on the part of the Province of Upper-Canada of and concerning the establishing of Regulations for the Collection of duties or payment of drawbacks to be impofed or allowed by the Legiflature of each Province refpectively, on Goods, Wares and Merchandizes paffing from one Province into the other, and alfo of and concerning any proportion to be received or paid of any duties already imposed or hereafter to be impofed.

II. Et qu'il foit de plus ftatué par la fufdite autorité, qu'il fera et pourra être loifibe aux dits Commiffaires de requérir que des Retours leur foient fournis par les Officiers des Douanes de Sa Majefté, et d'envoyer quérir et examiner teis perfonnes, papiers et régiftres qu'ils jugeront néceffaires pour leur information, dans l'execution des pouvoirs donnés aux dits Commiffaires par cet Acte.

Provided always, and be it enacted and declared, that no Regulation, provitil approved by fion, matter or thing fo propofed, treated, confulted or agreed on fhall have conclufive force and effect, or be carried into execution until the fame fhall have been confirmed by the Legiflature of this Province.

And be it further enacted by the authority aforefaid, that the said Commiffioners fhall, with all convenient speed, lay the fubftance of their conferences and confultations with the agreements by them entered into, before His Excellency the Governor, Lieutenant Governor or Perfon adminiftering the Government, and both Houses of the Legiflature of this Province.

V. And be it further enacted by the authority aforefaid, that this A&t fhall continue in force until the first day of March which will be in the year of our Lord one thoufand eight hundred and five, and from thence to the end of the then next Seffion of the Provincial Parliament, and no longer.

AN ACT to confirm certain Marriages therein mentioned.

HEREAS fince the Conqueft of this Province by the Arms of His Majefty, many Marriages have been had and folemnized by Minifters of the Church of Scotland, by Perfons reputed to be Minifters of the Church of Scotland, by Proteftant Diffen ting Minifters, by Perfons reputed to be Proteftant Diffenting Minifters, and by Juftices of the Peace; now for the preventing and avoiding of all doubts and questions touching. the fame: Be it therefore declared and enacted by the King's moft Excellent Majefty, by and with the advice and consent of the Legislative Council and Affembly of the Province of Lower-Canada, conftituted and affembled by virtue of and under the authority of an A&t passed in the Parliament of Great Britain, intituled, “An A&t to repeal certain parts "of an A&t paffed in the fourteenth year of His Majefty's Reign, intituled," An Act for making more effectual Provifion for the Government of the Province of Quebec in North "America;" and to make further provifion for the Government of the laid Province;" And it is hereby declared and enacted by the authority of the fame, that all Marriages. had or folemnized within the limits of this Province fince the Thirteenth day of September which was in the year of Our Lord one thousand feven hundred and fifty nine, by any Minifter of the Church of Scotland, or by any Person reputed to be a Minister of the Church of Scotland, or by any Proteftant Diffenting Minister, or by any Perfon reputed to be a Proteftant Diffenting Minifter or by any Juftice of the Peace, shall be, and fhall be adjudged, efteemed and taken to be and have been, from the day of the Celebration of fuch Marriages refpectively, good and valid in Law to all Civil effects,
