Governor im- by enacted by the authority aforefaid, that it shall and may be lawful to and for His powered to appoint Truftecs of Excellency the Governor, Lieutenant Governor, or Perfon adminiftering the Governof the Schools of ment of this Province for the time being, by an Inftrument under the Great Seal of this Province, to conftitute and appoint fuch and fo many perfons, as he fhall fee fit, to be Trustees of the Schools of Royal Foundation in this Province, and of all other Institutions of Royal Foundation, to be hereafter established for the advancement of Learning therein, as alfo for the management and adminiftration, improvement and amelioration of all Estates and Property, moveable or immoveable, which fhall in any manner or way whatsoever, be hereafter appropriated to the faid Schools and Inftitu tions, for the purposes of Education and the advancement of Learning, within this Province, to remove from time to time, the faid Trustees or any or either of them, and to appoint others to be the fucceffors of fuch as fhall be fo removed, or fhall die, or refign their Truft.

II. And be it further enacted by the authority aforefaid, that the faid Trustees and by corporate and their Succeffors, to be named in manner herein before directed and appointed, fhall be and they are hereby declared to be, a Body Corporate and Politic, in name and in deed, by the name of "The Royal Inflitution for the Advancement of Learning," and that by the fame name, they fhall have perpetual Succeffion and a Common Seal, with power to change, alter, break and make new the fame, when and as often as they fhall judge the fame to be expedient, and that they and their Succeffors, by the fame name, may fue and be fued, implead and be impleaded, anfwer and be answered unto, in all or any Court of Record or Places of Judicature within this Province, and that they and their Succeffors, by the name aforefaid, shall be able and capable in Law, to purchase, take, have, hold, receive, enjoy, poffefs and retain, without licence in mortmain or Lettres d'amortiffement, all Meffuages, Lands, Tenements and Immoveable Property, money, goods, chattles and moveable Property, which hereafter shall be paid, given, granted,purchased, appropriated, devifed or bequeathed in any manner or way whatfoever for and in favor of the faid Schools and Inftitutions of Royal Foundation, to and for the purposes of Education and the Advancement of Learning, within this Province, and do, perform and execute, all and every lawful Act and Thing, in as full and ample manner and form, to all intents, conftructions and purposes, as any other Body Politic or Corporate, by Law, may or ought to do.

III. And be it further enacted by the authority aforefaid, that all Lands, Meffuages, Tenements and Hereditaments and Immoveable Property, and all rents, fum and fums of money charged upon, and iffuing or payable out of any Meffuages, Lands Tenements, Hereditaments or Immoveable Property, and all fum or fums of money goods chattles, effects or moveable Property, which fhall hereafter be paid, given, granted, purchased, appropriated, devifed or bequeathed in any manner or way whatfoever, for and in favour of the faid Schools and Inftitutions of Royal Foundation, to and for the purposes of Education and the Advancement, of Learning within this Province, fhall and the fame are hereby vefted, in the faid Trustees and their Succeffors, to and for the ufes, and purposes herein mentioned, declared and enacted, concerning

II. Et qu'il foit de plus ftatué par l'Autorité fufdite, que les dits Syndics et leurs un corps incorpo. Succeffeurs, qui feront nommés en la manière ci-deffus dirigée et appointée, feront comme il font par le préfent déclarés être un Corps Incorporé et Politique, de Nom et de fait, fous le nom de "l'Inftitution Royale pour l'Avancement des Sciences," et que fous ce même nom ils auront une Succeffion perpétuelle et un Scéau commun, avec pouvoir de changer, altérer et détruire icelui, et d'en faire un nouveau, toute. fois et quand ils le jugeront à propos, et que, fous ce même nom, ils pourront ainsi que leurs Succeffeurs pourfuivre et être pourfuivis, plaider, répondre et être répondus, dans toutes ou aucune des Cours de Records ou de Judicature en cette Province, et que fous le nom fufdit, eux et leurs Succeffeurs feront habiles et capables fuivant la Loi d'acheter, prendre, avoir, tenir, recevoir, jouir, poffeder et détenir, licence en main fans Licence, en Main-morte ou Lettres d'Amortiffement, tous établiffements, terres, poffeffions et immeubles, argent, effets, biens et immeubles qui feront ci-après payés, donnés, concédés, achetés, appropriés, teftés ou légués en aucune maniere ou vole quelconque, pour et en faveur des dites Ecoles et Inftitutions de Fondation Royale pour les fins de l'Education, et pour l'avancement des Sciences en cette Province, et de faire et exécuter tout Acte et chofe légale, d'une maniere et forme auffi entières et auffi amples, à tous effets, intentions et conftructions, que tout autre Corps Politique ou Incorporé peut ou doit le faire fuivant la Loi.

III. Et qu'il foit de plus ftatué par l'Autorité fufdite, que toutes terres, établiffements, poffeffions, héritages et immeubles et toutes rentes, fomme ou fommes d'argent, dont aucuns établifiemens, terres, poffeffions, héritages ou immeubles feront chargés et qui en devront fortir ou être payées, et toute fomme ou fommes d'argent, biens, effets ou meubles qui feront ci-après payés, donnés, accordés, achetés, appro. priés, teftés ou légués en aucune maniere ou voie quelconque, pour et en faveur des dites Ecoles et Inftitutions de Fondation Royale pour les fins de l'Education et l'Avan cement des Sciences en cette Province, feront, comme ils font par le préfent, placés entre les mains des dits Syndics et leurs Succeffeurs pour les ufages et fins mentionnes,

IV. And be it further enacted by the authority aforefaid, that it fhall and may be lawful, to and for the Governor, Lieutenant Governor or Perfon adminiftering the Government of this Province, by an Inftrument, or Inftruments under the Great. Seal of this Province, from time to time, to nominate a Prefident or Principal of the faid Corporation, hereby erected, and fuch other Officers, Clerks and Servants, as he fhall judge neceffary, for the well ordering and governing of the affairs and business of the faid Corporation, to fix the place, times and manner in which the faid Corporation fhall affemble, and the number and defcription of Members which fhall be requifite, for tranfacting the bufinefs of the faid Corporation, and for the execution of the truft repofed in them; and the Prefident and fuch number of Members of the faid Corporation, which fhall be fo fixed, being affembled, at fuch place and times, and in fuch manner as fhall be allo fo fixed, fhall have full power and authority, to make, ordain and constitute fuch and fo many Bye laws, Rules, Orders, Conftitutions and Ordinances, not repugnant to the Statutes, Cuftoms or Laws of this Province, or the exprefs Regulations of this Act, as to them, or the greateft part of them, then and there prefent, fhall be judged neceffary and expedient, as well for the direction, condu&t and government of the faid Corporation of the Free Schools of Royal Foundation of this Province, and all other Inftitutions of Royal Foundation for the Advancement of Learning, which fhall be hereafter established within this Province, and of the Masters, Ufhers, Tutors, Profeffors and Students thereof, refpectively, as for the management and administration, improvement and amelioration of all eftates and property, moveable and immoveable, which shall in any manner or way be hereafter paid, given, granted, purchased, appropriated, devifed or bequeathed, in any manner or way for and in favour of the faid Schools and Inftitutions of Royal Foundation, for the purposes of Education and the advancement of Learning within this Province. Provided always, nevertheless, that no fuch Law, Rules, Orders, Conftitutions or Ordinances, fhall have any force or effect until the fame fhall have been fanctioned and confirmed

Et le dit Receveur Général eft par le préfent requis de recevoir les dites Sommes et d'en tenir compte en la même maniere qu'il reçoit actuellement et tient compte des autres Argents publics, à Sa Majefté par la voie des Commiffaires du Tréfor de Sa Majefté pour le tems d'alors, ainfi que la Cou ronne l'ordonnera.

IV. Et qu'il foit de plus ftatué par l'Autorité fufdite, qu'il fera et pourra être loifible au Gouverneur, Lieutenant Gouverneur ou à la Perfonne ayant l'Adminiftration du Gouvernement de cette Province, de nommer, de tems à autre, par un Inftrument ou des Inftruments fous ie Grand Sceau de cette Province, un Préfident ou Principal de la dite Corporation par le préfent érigée, et tels autres Officiers, Clercs et Affiftants qu'il jugera néceffaire pour le bon Ordre et bon Gouvernement des Affaires de la dite Corporation, de fixer le lieu, le tems et la manière ciers. dont la dite Corporation s'affemblera, et le nombre et defcription des Membres qui feront néceffaires pour tranfiger les Affaires de la dite Corporation, et pour l'exécution de la Charge à eux commife; et le Préfident et tel nombre des Membres de la dite Corporation qui fera ainfi fixé, étant affemblés à tels tems et lieu, et en telle maniere qui fera auffi ainfi fixée, auront plein pouvoir et autotorité de faire, ordonner et conftituer tels et autant de Statuts, Règles, Ordres, Conftitutions et Ordonnances qui ne feront point contraires aux Statuts, Coutumes ou Loix de cette Province ou aux Règlemens exprès de cet A&te, ainfi qu'il fera par eux ou par la plus grande partie d'entr'eux là et alors préfents, jugé néceffaire et expédient, tant pour la direction, conduite et gouvernement de la dite Corporation, des Ecoles Gratuites de Fondation Royale en cette Province, et de toutes autres Inftitutions Publiques de Fondation Royale qui feront ci-après établies pour l'avancement des Sciences en cette Province, et des Maîtres, Sous-maîtres, Tuteurs, Profeffeurs et Etudiants d'icelles refpectivement, que pour la geftion, administration et amélioration de tous biens, fonds, meubles et immeubles qui feront ci-après payés, donnés, concédés, achetés, appropriés, teftés ou légués en aucune manière ou voie quelconques pour et en faveur des dites Ecoles et Inftitutions de Fondation Royale pour les fins de l'Education et l'Avancement des Sciences en cette Province. Governor in- V. And be it further enacted by the authority aforefaid, that when and so often as powered to erect it fhall be judged expedient by the Governor, Lieutenant Governor or Perfon admithe Parishes or niftering the Government of this Province, to erect one or more Free Schools in any Townships of the Parish or Township of this Province, it fhall and may be lawful, to and for the Governor, Lieutenant Governor or Person adminiftering the Government of this Province, by an Inftrument, under his hand and Seal at Arms, to declare the fame and to nominate and appoint two or more Perfons refiding in the County, wherein fuch Parish or Township may be fituated, for the purpose of erecting one or more School-houses with convenient appartments for one or more School Mafters, in fuch Parish or Township, to remove from time to time, fuch Perfons or either of them, and to appoint others in the place and ftead of fuch as fhall be removed or fhall die, or refign their truft, and the faid Perfons fo nominated and appointed, fhall be and they are hereby conftituted Commiffioners, for the purposes aforefaid.

VI. And be it further enacted by the authority aforefaid, that the faid Commiffioners, being fo appointed, fhali forthwith after due confideration, fix upon fome convenient Lot or Lots of ground in fuch Parish or Township, whereon fuch School-house or School houfes may be erected, and fhail alfo fix upon the dimensions of the faid School houfe or School-houfes to be erected, which fhall not in any cafe exceed, eighty feet in length and forty feet in breadth, and fhall contain the appartments proper and convenient, for the refidence of the School-Mafter or School-Malters therein. Provided always, that the fituation of fuch Lot or Lots of ground and the dimen fions of fuch School houfe or School-houfes, fhall be reported to, and be approved by His Excellency the Governor, Lieutenant Governor or Perfon adminiftering the Government of this Province for the time being, before the same shall be finally fixed upor.

VII. And be it further enacted by the authority aforefaid, that when fuch Lot or Lots of ground fhall be fo fixed upon, with fuch approbation as aforefaid, the said miffioners impo- Commiffioners or any two of them, in each of the faid Diftricts refpectively, fhall for the purchafe as foon as may be, contract for the abfolute purchase of the faid Lot or Lots of ground of the Lots of in fuch Parish as aforefaid, for the purpose of erecting thereón, fuch School houfe
