HEREAS it is expedient further to continue an A&t paffed in the thirty fixth

of the Reign of His prefent Majefty, intituled, An Act for making a temporary provifion for the regulation of Trade between this Province and the United States of America, by Land or by Inland Navigation," Be it therefore enacted by the King's Moft Excel lent Majefty, by and with the advice and confent of the Legislative Council and Af fembly of the Province of Lower Canada, conftituted and allembled by virtue of and under the Authority of an Act of the Parliament of Great Britain, intituled, “An Act "to repeal certain parts of an Act poffed in the fourteenth year of His Majefly's Reign, inti“tuled, “An Act for making more effectual Provifion for the Government of the Province of " Quebec in North America, and to make further Provifion for the Government of the faid Pro"vince," And it is hereby enacted by the authority of the fame, that the said A&t intituled, " An Act for making a temporary Provifion for the regulation of Trade between this "Province and the United States of America, by Land or by Iland Navigation," And all matters and things therein contained, fhall continue and be in force until the fift day of January one thoufand eight hundred and two, and from thence to the end of the then next Seffion of the Provincial Parliament and no longer. Provided always, that Orders under this all and every Order or Orders iffued and published under theauthority of the aforefaid A&t, or which fhall be iffued or published under the authority of this A&t, fhall not continue and be in force longer than to the faid firft day of January one thoufand eight hundred and two, and from thence to the end of the then next Sellion of the Provincial Parliament.

An ACT for the Relief of Perfons holding Lands or immoveable Property of His Majefty, En roture, upon which Lots et Ventes, or Mutation Fines are due.

HEREAS the Collection of the Lots et Ventes now due in the Cenfive of your Majefty's Doma ne in this Province, to a certain extent and under certain modifications, is juft and expedient, but without limitation would be injurious in particular cafes. Be it therefore enacted by the King's moft Excellent Majefty, by and with the advice and confent of the Legislative Council and Affembly of the Province of Lower Canada, conftituted and affembled by virtue of and under the authority of an Act paffed in the Parliament of Great Britain, intituled, " An Act to repeal certain parts of an "Act paffed in the fourteenth year of His Majefly's Reign, intituled," An A&t for making more effectual Provifion for the Government of the Province of Quebec in North America, and "to make further Provifion for the Government of the faid Province," And it is hereby enacted by the authority of the fame, that it fhall and may be lawful to and for the Governor, Lieutenant Governor, or Perfon adminiftering the Government of this Province for the time being, by an Inftrument or Inftruments under his Hand and Seal at Arms, to nominate and appoint five perfons to be Commiffioners for the due execution of this A&t, and of the feveral powers and trufts repofed under and by virtue thereof; to remove from time to time the faid Commiffioners or any of them, and to appoint others in the place and ftead of fuch as fhall be removed, or fhall die or refign their truft.

II. And be it further enacted by the authority aforefaid, that it' fhall and may be lawful to and for the Governor, Lieutenant Governor or Perfon adminiftering the Government of this Province for the time being, in like manner, by an Inftrument or Inftruments under his Hand and Seal at Arms, to nominate and appoint a Clerk, to the aforefaid Commiffioners, and to allow him fuch reasonable salary as he thall think meet; and from time to time at his difcretion, to difmifs and difcharge fuch Clerk, and to apand appoint auo-point another in his place; and the faid Clerk his hereby enjoined faithfully, to execute ther in his flead. and perform the fervices to be of him required by the faid Commithioners, without demanding or receiving for fuch fervices, any reward or recompence other than fuch Salary as fhall be fo allowed.

III. And be it further enacted by the authority aforefaid, that the faid Commissioners and Clerk to take and Clerk, before they fhall be capable of acting in the execution of this Act, fhall feverally take and fubfcribe before His Majefty's Chief Juftice of this Province, or any two of the Puisne Juftices of His Majefty's Court of King's Bench, for the Dillrict of Quebec an Oath to the effect following, that is to fay:

Vu que la Collection des droits des Lots et Ventes qui font maintenant dus dans la Cenfive du Domaine de Votre Majefté dans cette Province, jufqu'à une certaine étendue et fous certaines modifications, eft jufte et expédiente, mais fans limitation deviendroit onéreufe dans des cas particuliers; qu'il foit donc ftatué par la très Excellente Majefté du Roi, par et de l'avis et confentement du Confeil Législatif et de l'Affemblée de la Province du Bas-Canada, conftitués et affemblés en vertu et fous l'autorité d'un Acte. paffé dans le Parlement de la Grande Bretagne, intitulé " Acte qui "rappelle certaines parties d'un Ate paffé dans la quatorzieme année du Règne de Sa Majefté, "intitulé " Ace qui pourvoit blus efficacement pour le Gouvernement de la Province de Qué"bec dans l'Amérique du Nord, et qui pourvoit plus amplement pour le Gouvernement de la "dite Province" et il eft par le préfent ftatué par la même autorité, qu'il fera loisible au Gouverneur, Lieutenant Gouverneur ou à la perfonne ayant l'adminiftration du - Gouvernement de cette Province pour le tems d'alors, de nommer et appointer par Commiffion ou Commiffions, fous fon feing et le fçeau de fes Armes, cinq perfonnes pour être Commiffaires pour l'exécution de cet Acte, et des différents pouvoirs et charges confiés en vertu d'icelui; de démettre de tems à autre les dits Commiffaires ou aucun d'eux, et d'en nommer d'autres en la place de ceux qui feront démis, ou qui mourront, ou qui réfigneront leur charge.

II. IV. And be it further enacted by the authority aforefaid, that it shall and may be lawpecuniary compo ful to and for the faid Commiffioners or any three of them, and they are hereby fully and entirely authorised and impowered, to accept of and from any perfon or perfons whofoever, such pecuniary compofition for Lots et Ventes or Mutation Fines, which may be due by fuch perfon or perfons to His Majefty, at the paffing of this Act, for any Sale or other Mutation equipolent to the fale of any Lands or Immoveable Property fituate in this Province, and held of His Majefty en Roure, or be payable to His Majefty, and fecured upon any fuch Lands or Immoveable prope ty, in the pofeffion of fuch perfon or perfons, and make fuch relinquishment and remiffion, upon each of fuch Lots et Ventes or Mutation Fines, as they the faid Commiffioners, or any three of them, in their difcretion, according to the nature and circumftances of each particular cafe, in fhall deem juft and equitable. Provided always, that nothing in this Act contained, fhall authorife and impower, or be conftrued to authorife or impower the laid Commiffioners or any of them, to accept of any pecuniary compofition or to make any relinquifhment or remiffion, whatever, in any cafe or cafes of Lands or Immoveable pro. perty held of His Majefty, en Roture, upon which only one Lots et Ventes or Mutation Fine is due, or in any cafe or cafes of Sale or of Mutations equipolent to fale of Land, or immoveable Property held of His Majefty en Roure, where any specific fum of mo⚫ ney or any part of the price of purchafe, fhall have been referved, fpecifically, by contract, in the hands of the Seller or Purchaser, to pay the Lots et Ventes; those cafes nevertheless excepted, in which fuch Purchafer or Seller, fhall establish to the fatisfaction of the faid Commiffioners or any three of them, that he, fhe or they, at the time of paffing this Act, were not worth more than four times the amount of the Lots et Ventes, for the payment of which, fuch specific fum as aforefaid or fuch part of the purchase money as aforefaid, fhall have been fo referved by him, her or them refpectively.

V. Provided alfo and be it further enacted, that all and every perfon or perfons, who favor of certain ferved in defence of the City of Quebec, during the blockade thereof, in the year of our Lord one thousand feven hundred and feventy five, and who were then Proprietor or Proprietors of any houfe or houfes, or other buildings in the faid City of Quebec, 01 which any Lots et Ventes were then due and owing to the Crown, which houfe or houses or other buildings were deftroyed by fire or otherwife, during the faid Blockade, all and every fuch perfon or perfons, their Widows or heirs, who are now Proprietor or Proprietors of the ground on which fuch houfe or houfes or other buildings, as aforefai 1, were erected, fhall be entitled to a full and complete remiffion and difcharge of fuch Lots et Ventes fo due, which remiffion and difcharge, the faid Commiffion.rs or any three of them, are hereby authorifed and required to grant.

VI. And be it further enacted by the authority aforefaid, that in all cafes of Land or Immoveable Property, fituate in this Province, and held of His Majelly en Roture, upon which only one Lots et ventes or Mutation Fine is due, it fhall and inay be lawful to and for the Receiver General of this Province, and he is hereby required upon payment thereof to him, to make thereon the customary abatement of one third: Provided always, that fuch Lots et ventes or Mutation Fine be paid to the faid Receiver General, within twelve Calendar Months, from the paffing of this Act, and if the fame be not paid to the
