Assignees' Affidavit of the Truth of their Account, where they cannot attend.

In the matter of Joseph Styles, a bankrupt.

J. G., of ——, and C. J., of ——, merchants, assignees under a fiat in bankruptcy awarded and issued, and now in prosecution, against Joseph Styles, of street, in the city of builder, dealer, and chapman, severally make oath and say: and first, this deponent J. G. for himself saith, that the sheets of paper hereunto annexed, marked A. &c., and [respectively] signed by him this deponent, do contain a full and true statement of all money received by him as assignee as aforesaid, and when and on what account and how the same has been employed; and that the several sums therein charged to have been allowed, paid, and expended, have been really and bonâ fide allowed, paid, and expended in manner and for the purposes therein mentioned. And this deponent C. J. for himself saith that he hath not received or paid any sum or sums of money whatsoever, for or on account of the estate and effects of the said bankrupt, under the said fiat. [Or if he have, let his affidavit be the same as that of the other assignee.]

At the &c. [as before,] the 16th day of August, 1840.

In the matter of Joseph Styles, against whom a fiat, bearing

date the

day of -, 1840, was duly issued.

Be it remembered that I, whose name is hereunto subscribed, being the commissioner authorized to proceed on [or we, whose names are hereunto subscribed, being the major part of the commissioners named in and authorized by] a fiat in bankruptcy, now

in prosecution against the said Joseph Styles, sat [met together] the day and year and at the place above mentioned, in order to make a dividend of the estate of the said bankrupt, pursuant to notice in the London Gazette for that purpose given:

And it appearing to me [us], by an examination of the proceedings, and by a statement in writing delivered to me [us] upon the oath of G. J. G. the official assignee, [or J. G. and C. J., the assignees, or J. G., the acting assignee] of the said bankrupt's estate, that there is the sum of £708 2s. 6d. now in hand; which sum is composed as follows :—

And it also appearing to me [us] that the debts proved and claimed under the said fiat, and now standing upon the proceedings, amount to the sum of £2,360 8s. 1d.—that is to say,

And it also appearing to me [us] that the sum of £708 28. 6d. so being in the hands of the assignees to be divided is sufficient to pay all the creditors and claimants the sum of six shillings in the pound upon their several debts, I [we] do therefore order a dividend of six shillings in the pound to be paid to all the said bankrupt's creditors who have proved their debts, and unto the claimants, when they shall have substantiated their claims, in proportion to their several debts; which said dividends, as I [we] compute the same, will amount to the sum of £708 28. 67.
