AN ACT

Relating to certain taxes in the county of Montour.

SECTION 1. Be it enacted by the Senate and House of Representa tives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That Taxes and fines all taxes and militia fines assessed, levied, or laid prior to the first day in Montour co. of November, Anno Domini, one thousand eight hundred and fifty, within the territory now composing the county of Montour, shall be collected, recovered, applied, and appropriated, as if the said county of Montour had never been erected, except as hereinafter otherwise provided.

SECTION 2. That the county of Montour shall retain the sum of one thousand six hundred and eighty-five dollars and eighty-three cents, paid to the treasurer of said county of Montour, by Amandus Levers, late treasurer of Columbia county, out of the taxes assessed for the year eighteen hundred and fifty, within that part of Columbia county which now forms Montour county, and neither the said county of Mon tour, nor the said Amandus Levers shall be liable to account to the county of Columbia for that sum.

SECTION 3. That the county of Montour shall have allowed to her the sum of two thousand nine hundred dollars in all out of the county taxes of the year, Anno Domini, one thousand eight hundred and fifty, assessed in her territory as the full amount of the surplus payable to her under the sixth section of the act erecting the said county of Mon.

SECTION 4. That the treasurer of Montour county is hereby autho- Treasurer to rerized to receive from collectors of county taxes within the Montour ceive certain territory, for the year, Anno Domini, eighteen hundred and fifty, any sum or sums not exceeding in the aggregate the sum of eight hundred dollars, to and for the use of the said county of Montour, and to give receipts therefor to the collectors paying the same, which said receipts shall be valid to the said collectors in the settlement of their duplicates, and the said amount so received by the treasurer of Montour county, under the provisions of this section, together with any amount ascertained to be due Columbia county, under the sixth section of this act, shall be deducted from the aforesaid sum of two thousand nine hundred dollars, payable to Montour county, under the third section of this act, any balance which may be due to Montour county, under this act, shall, upon the collection of the same, be paid to her by the county of Columbia, and all costs of suits heretofore had in the Court of Common Pleas of Columbia county, in relation to the taxes mentioned in this act, shall be paid in equal proportions by the said counties of Columbia and Montour, and neither county shall have any claim upon the other in connexion with the taxes aforesaid, except as provided in this

act.

SECTION 5. That the jurisdiction and powers of the courts, officers, Jurisdiction and and authorities of Columbia county in relation to all actions, liens, powers of courts officers, &e., of writs, process, or proceedings, whatsoever, connected with or pertaining Columbia co. to the collection, recovery, adjustment, and settlement of the taxes and fines mentioned and intended in the first section of this act, shall be and remain the same in all respects, and to be exercised in the same manner as if the county of Montour had never been erected.

SECTION 6. That in order that the county of Montour contribute her Duties of com fair proportion of the expenses of the courts of Columbia county, held missioners. in the month of November, Anno Domini, one thousand eight hundred and fifty, the commissioners of the said counties shall proceed to ascertain and adjust the amount of expenditures paid to jurors and constables from the Montour territory attending the courts of Columbia in November, Anno Domini, one thousand eight hundred and fifty, together with all expenses and outlays incurred and borne by Columbia county, in and about the trial of a certain prosecution against William H. H. Crandall, for murder in the month aforesaid, or arising out of the jurisdiction of the proper court of Columbia county in the said case, and if the commissioners of either county shall neglect or refuse to ascertain and adjust the expenditures and expenses aforesaid, or if the commissioners of the said counties shall fail to agree upon the amount of the same, then the president judge of the eleventh judicial district upon application made to him for that purpose by the commissioners of either county, shall appoint three indifferent persons to ascertain and fix the amount of such expenditures and expenses, whose decision, or the decision of a majority of whom in the case shall be final, and the amount of such expenditures and expenses, upon the ascertainment of the same as aforesaid, shall be paid by the county of Montour to the county of Columbia, upon warrants or orders drawn by the commissioners of Montour county upon the treasurer thereof for that purpose: Provided, That the county of Columbia may retain the amount of such expenditures and expenses, or any portion thereof, upon the ascertainment of the same, out of any moneys received by her under the previous sections of this act, and

which would otherwise be payable to the county of Montour: And provided further, That in case of the appointment of persons by the president judge aforesaid, to ascertain and fix the amount of the expenditures and expenses aforesaid, the persons so appointed shall receive such reasonable compensation for their services, and to be paid by the aforesaid counties, or either of them, in such manner and in such proportions as the said judge shall direct and determine.

SECTION 7. That so much of any act of Assembly as may conflict with the provisions of this act shall be, and the same is hereby repealed.

For the relief of Nancy Acklin and Sarah Williams, widows of soldiers of the
Revolutionary war.

SECTION 1. Be it enacted by the Senate and House of Represen tatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That the State Treasurer be, and is hereby authorized and required to pay to Nancy Acklin and Sarah Williams, both of Fayette county, or to their order, each an annuity of forty dollars, commencing on the first day of January, one thousand eight hundred and fifty-two, payable half yearly on the first day of January and July.

A SUPPLEMENT

To the act incorporating the Meyers' Mill Plank Road Company, and authorizing a railroad in lieu thereof; relative to certain dividends in the Bedford and Stoystown Turnpike Road Company.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That

SECTION 2. That the said company are hereby further authorized to construct between the above mentioned points in lieu of a plank road construct a a railroad, the said company to have all the powers and privileges, and railroad. subject to all the restrictions of an act entitled "An Act regulating railroad companies," approved the nineteenth day of February, one thousand eight hundred and forty-nine, and shall complete the said road within the period of seven years from the passage of this supplement. SECTION 3. That the eleventh section of the act of the fourteenth Dividends. day of April, Anno Domini, one thousand eight hundred and fifty-one, which directs the Bedford and Stoystown turnpike road company to pay to the purchaser or purchasers of the stock held by the Commonwealth in said company which was sold in pursuance of the act of the twentysixth day of April, Anno Domini, one thousand eight hundred and fifty, such dividends as were due thereon at the time of said sale, shall be so construed as to require the said company to pay the said dividends to the original individual stockholders of said company or their representatives or assignees.
