AN ACT.

To incorporate the Old Fort and Spruce Creek Turnpike Road Company; to authorize the laying out of a State road from Boalsburg, in Centre county, to a point on the Kishacoquillas turnpike, in Mifflin county; declaring Little Mushannon creek a public highway; relative to appeals of unseated lands in Centre county; relative to the costs in two certain suits; authorizing the laying of a tax upon dogs in Bellefonte borough; appointing commissioners to run the boundary lines between Centre, Huntingdon, and Mifflin counties; and confirming certain unseated land titles in Centre county.

SECTION 1. Be it enacted by the Senate and House of Represen tatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That William Burchfield, John Glenn, John Bailey, Samuel Hess, George Commissioners Boal, George Jack, Andrew Gregg, or any three of them, be, and they are hereby appointed commissioners to open books, receive subscrip

tions, and organize a company by the name, style, and title, of "The Style.

SECTION 2. That the capital stock of said company shall consist of four hundred and twenty shares at fifty dollars per share.

SECTION 4. That it shall be the duty of the said commissioners to Meeting of com meet at the house of Geo. W. Johnson, in Boalsburg, on the twelfth missioners and day of May next, or as soon thereafter as convenient, and after being their duties. duly sworn or affirmed to discharge the duties enjoined by this act faithfully and impartially, to proceed and view the ground over which said road is to pass, and lay out the same in the most judicious manner, having a due regard to the nature of the ground, and doing as little injury to private property as possible, and plainly to mark the road laid out; and the said commissioners shall receive a per diem allowance of one dollar and fifty cents for each day necessarily engaged under this act, and to employ a surveyor at one dollar and fifty cents per day, or if either of the said commissioners perform the duties of surveyor he is to receive an additional sum of one dollar per day, which shall be paid out of the treasuries of the respective counties through which the said road may pass, according to the time actually spent in locating said road in the respective counties, and the said commissioners shall on or before the first day of January next, make out a fair and accurate draft of said road, noting courses and distances, township lines and waters,

which shall be forwarded to the Secretary of the Commonwealth, to be filed in his office as a matter of record, and one copy to be deposited in the office of the clerk of the courts of each county through which said road may pass, and from thenceforth the said road shall be a public highway, and shall be opened and repaired in all respects as public roads are opened and repaired under the existing laws of this Commonwealth. SECTION 5. SECTION 6. That the commissioners of Centre county shall, after every triennial assessment, set apart at least one day, or as many more as they may deem necessary, to hear and determine at their office all appeals from the valuation of unseated lands, four weeks notice of which time and place shall be given by advertisements in all the newspapers published in said county.

SECTION 7. That in two certain feigned issues in which John G. feigued issues Lowrey, John Love, and William McMeen, executors of David Love, deceased, are plaintiffs, and William Allison is defendant, the venue whereof was removed by act of twenty-seventh February, one thous and eight hundred and fifty-two, to Northumberland county, the aforesaid plaintiffs shall in no event of said feigned issues be liable for a greater amount of costs than they would have been compelled to pay had such suit or suits been tried, and the same verdict rendered in the proper court of Centre county.

SECTION 8. That the town council of the borough of Bellefonte, be, and are hereby authorized to cause all dogs owned or kept in said borough to be assessed, returned, and taxed at such rates as to them may seem reasonable, and to have such taxes collected as school taxes are now collected: Provided, That all moneys arising therefrom, shall be appropriated to the support of the common schools of said borough, and to no other purposes.

Commissioners. SECTION 9. That William Christy, of Huntingdon county, Joseph Hafley, of Mifflin county, and Henry P. Treziyulny, of Centre county, be, and they are hereby appointed commissioners, whose duty it shall be to employ a proper number of assistants, and the said commissioners or a majority of them shall correctly run and mark distinctly the boundary line or lines between the counties of Centre and Mifflin, and Huntingdon and Centre, agreeably to the act of Assembly creating said counties, and the supplements thereto, and the said commissioners or a majority of them, shall make out three drafts, one of which shall be filed in the commissioners' office of each of the said counties, and the said commissioners shall receive the sum of three dollars for each and every day they may be necessarily employed in running and Compensation. marking said boundary line, and the assistants each, the sum of one dol lar for each and every day they may necessarily be employed as aforesaid, one-third of which shall be paid out of the treasury of each of said counties, and the said commissioners are hereby required to perform the duties enjoined by this act, on or before the first day of December next, and the report of said commissioners be final and conclusive.

SECTION 10. That where the county commissioners of Centre county may have purchased unseated lands at treasurer's sale, according to the provisions of an act entitled "An Act to amend an act directing the mode of selling unseated lands for taxes, and for other purposes," approved the thirteenth March, one thousand eight hundred and fifteen, and afterwards in pursuance of the said act have sold the

same at public sale, the deeds of the treasurer to the commissioners and of the commissioners to the purchaser, shall be taken as prima facia evidence that all the requirements of the said act have been complied with.

AN ACT

For the relief of Thomas Watkins; relative to inspectors of the Philadelphia county prison; to prevent the destruction of fish in Mountain creek, and its tributaries, in Cumberland county.

WHEREAS, Thomas Watkins, collector of the State tax for the town- Preamble. ship of Warwick, in the county of Bucks, for the year one thousand eight hundred and fifty, in his settlement with Edward Baker, the county treasurer of that year, over paid the said treasurer sixteen dollars and fifty-six cents, which was not discovered until the said county treasurer had made his final settlement with the State Treasurer:

And whereas, It is right and proper that the same should be refunded if found to be correct; therefore,

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That

AN ACT

Repealing certain road laws in M'Kean county; to out-let lock and towing-path bridge, at Millerstown, Perry county; legalizing a certain election held in Liverpool township, Perry county; incorporating the Associate Reformed Presbyterian congregation of Paris, Washington county; erecting the town ship of Wilkesbarre into separate school districts; declaring east branch of Tionesta creek a public highway; conferring additional powers on the Western insurance company; amending the charter of the Jackson beneficial society of Pennsylvania; relative to the collection of road taxes in Butler county; authorizing the Summit branch railroad company to borrow money; relative to the West Philadelphia gas company; and authorizing the sale of a certain school house in Alsace township, Berks county; relative to the Perrysville and Zelienople plank road company; and to elections in Neshannock township, Lawrence county.

SECTION 1. Be it enacted by the Senate and House of Represen tatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That the first, second, third, and fourth sections of the act of the twentyfourth of February, one thousand eight hundred and forty-seven, entitled "An Act to appoint commissioners for the purpose of keeping in good order and repair that part of the east and west State road, west of Fayette Corners, in the county of M'Kean, and for other purposes," be, and the same are hereby repealed.

WHEREAS, Petitions have been presented to this Legislature asking the passage of a law authorizing and directing the Canal Commissioners to construct or build an out-let lock to the Pennsylvania canal, at Millerstown, Perry county, and erecting a towing-path to the bridge across the Juniata river, and extending the towing-path or canal down the side of said river, to intersect the canal at the dam at North's island:

And whereas, Remonstrances have been presented against said improvement, and asking the passage of a law authorizing said Canal Commissioners to erect or build a towing-path bridge across the Juniata river, where the rope ferry is now located; therefore,

SECTION 2. That the Canal Commissioners be, and they are hereby Duties of Canal directed to examine both the above proposed routes or improvements, and make an estimate of the cost of construction respectively, together with the propriety and practicability of such improvement, and make eport thereof to the next Legislature.

SECTION 3. That the Liverpool township election, in the county of Election in Liv. SECTION 4. That the Associate Reformed Presbyterian congregation Corporation. of Paris, in the county of Washington, formerly known by the name of the congregation of Herman's creek, is hereby erected into a body politic and corporate, in deed and in law, by the name, style, and title of the trustees of the Associate Reformed Presbyterian congregation of Paris, and by this name shall have perpetual succession; and be able to sue and be sued, in all courts of law, and elsewhere, and shall be able Privileges. and capable, in law and equity, to take and hold lands and tenements, goods, and chattels, to them and their successors, any property of whatsoever kind, nature or quality, real, personal, or mixed, which are now or may hereafter become the property of the said congregation by gift, grant, bargain, sale, conveyance, or assurance, will, devise, bequest, or otherwise, from any person or persons whomsoever capable of making the same, and the same to grant, bargain, sell, or dispose of: Provided, That the yearly income of the said real estate shall not at any time exceed two thousand dollars.

SECTION 5. That the affairs of this congregation shall be conducted Affairs of corpoby six trustees, four of whom shall form a quorum, to be chosen from ration, how conthe members of said congregation, who shall choose from among their ducted. number a president and secretary, and shall choose a treasurer from among the members of the congregation who is not a trustee, and who shall give sufficient security for the trust reposed in him, and in case of the removal of the president, or any of the trustees by death or resignation, or otherwise, the vacancy or vacancies shall be supplied by the board of trustees until the next annual election, and the following named persons shall be trustees until others are elected in the manner hereafter described, namely: James Fulton, William Buchanan, James Gardner, Alexander M'Cracken, Samuel Martin, William L. Crawford, the two first named persons to remain in office for one year, and the next two named to continue in office for two years, and the two last named to continue in office three years, from the first Monday of April, one thousand eight hundred and fifty-two, and on the same day annually thereafter, the members of the congregation shall at a general meeting thereof elect two persons to serve as trustees to continue in office three years, and other trustees to fill any vacancy or vacancies which shall have occurred in the manner before mentioned.

SECTION 6. That all elections to be held in the congregation shall be Elections, how conducted by two members of the congregation who shall be appointed conducted. inspectors at the same time and place where the trustees are elected as aforesaid, and the said inspectors so chosen shall appoint a clerk or clerks to perform such duties as the nature of the case may require, and when each election shall be closed and the number of votes for each person ascertained, the inspectors shall make out a return of the names of the trustees elected with the number of votes in favor of each, and shall give notice to each of the trustees thus elected.
