AN ACT

For the relief James M'Elwain, a soldier of the Indian war, and Catharine Monks, widow of a soldier of the Indian war.

SECTION 1. Be it enacted by the Senate and House of Represen. tatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That the State Treasurer, be, and he is hereby authorized and required to pay to James M'Elwain, and Catharine Monks, both of Butler county, or to their order, an annuity of forty dollars, each, commencing on the first day of January, one thousand eight hundred and fifty-two, to be paid semi-annually, on the first day of January and July.

AN ACT

To authorize the State Treasurer to refund to Christain Shirk, administrator with the will annexed of Thomas Mains, certain money overpaid by him, and relating to the district of West Philadelphia.

SECTION 1. Be it enacted by the Senate and House of Represen tatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That Certain moneys the State Treasurer be, and he is hereby authorized and required to refund to Christain Shirk, administrator with the will annexed of Thomas Christian Shirk. Mains, late of Washington county, Maryland, deceased, the sum of thirty-five dollars and thirty-six cents, for that amount overpaid by him as collateral inheritance tax, believed to be due to this Commonwealth from said estate.

AN ACT

Incorporating the Odd Fellows' Hall Association of the city of Pittsburg and county of Allegheny.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That William M'Cague, Henry Errett, David Stonecipher, James C. Hen- Corporators. derson, F. G. Rook, R. B. Ewens, Eli Young, James Miles, Ferdinand E. Voltz, John Miles, Samuel McCleeny, John Conling, and Philip Keller, and their successors, and all persons who now are or who may be hereafter associated with them, be, and they are hereby erected and created into a body politic and corporate in deed and in law, by the name, style, and title, of "The Odd Fellows' Hall Association of the Style. city of Pittsburg and county of Allegheny," and by that name shall have perpetual succession, and shall be able to sue and be sued, plead and be impleaded in any court of law or equity and elsewhere, and shall be able and capable in law and equity to take, and hold to them and their successors, either by grant, gift, devise, or lease, any lands or real estate for the purpose of erecting thereon a suitable building or buildings for the use of said association, and also to take and hold for the use of said association, and any goods, chattels, sum or sums of money by gift, grant, bargain, sale, will, devise, or bequest, from any person or persons whatsoever, capable of making the same, and the same at their pleasure to grant, bargain, and sell for the use of said association, and generally to do all and singular the matters and things which shall be lawful for them to do for the well being and due management of the affairs of said association.

SECTION 2. That the object of the said corporation shall be to pro- Object. vide, erect, and furnish a hall, or suitable building or buildings in the city of Pittsburg for the accommodation of the various lodges of the Independent Order of Odd Fellows' established or to be established there, and suitable also for a library, and such other purposes as they may deem advisable and consistent with the intention of this act.

SECTION 3. That it shall and may be lawful for the said corporation Seal. to have a common seal, and the same at will and pleasure to change, alter, and renew, as they may deem proper, and shall have and exercise all the rights, privileges, and immunities necessary for the purposes of the corporation hereby constituted and as herein expressed.

SECTION 4. SECTION 6. That the Legislature hereby reserves the right to alter, revoke, or annul the charter of the said Odd Fellows' hall association of the city of Pittsburg and county of Allegheny, whenever, in their opinion, it may be injurious to the citizens of this Commonwealth, in such manner, however, that no injustice shall be done to the corporators thereof.

AN ACT

To authorize Isaac Koons and Joseph Kendall, committee of the person and estate of Henry Kendall, to sell certain real estate; relative to the Waterford and Union plank road company; to the register of the Asylum land company, and to Marriott's lane, in the county of Philadephia.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That Isaac Koons and Joseph Kendall, committee of the person and estate Henry Kendall of Henry Kendall, who has been duly declared an habitual drunkard, shall have power and authority to sell the one moiety or undivided half part of a certain messuage, tenement, and three story brick house, with the appurtenances, situate on the North side of Market street, between Fourth and Fifth streets, in the city of Philadelphia, being numbered one hundred and sixty-one, containing in front on Market street eighteen feet, and in depth eighty-two feet, of which said moiety or undivided half part of said messuage, tenement, and house, with the appurtenances, the said Henry Kendall, at the time of the appointment of the said Isaac Koons and Josoph Kendall, committee of his person and estate, was the owner, at public sale, for the best price that can be fairly and reasonably obtained for the same, and upon such terms as shall be most advantageous to the said Henry Kendall; and to make, execute, and deliver to the purchaser or purchasers thereof, a good and valid deed for the same in fee simple, and out of the proceeds of said sale to pay the proper proportion of the debts of said Henry Kendall, which were a lien on said moiety, or haf part of said messuage, tenement, and house, with the appurtenances at the time the said Isaac Koons and Joseph Kendall were appointed committee of his person and estate, and the expenses necessarily incident to said sale, and the balance of said purchase money to remain

charged upon said messuage, tenement, and house, with the appurte-
nances to be secured by bond and mortgage on the same, the interest
thereof to be paid semi-annnally to the committee of said Henry Ken-
dall, for and during his natural life; and immediately after his death
the principal to be paid to the legal representatives of the said Henry
Kendall: Provided, That in case at any time the Court of Common Proviso.
Pleas of the county of Philadelphia, shall make an order that the
commissioners in his case, and the inquisition taken thereon, and the
appointment of committee, and all preceedings relating thereto shall be
altogether superseded, and determined, that the said principal shall be
immediately paid to the said Henry Kendall: Provided also, That be- Proviso.
fore the said Isaac Koons and Joseph Kendall shall make such sale,
they shall give security, to be approved of by the Court of Common
Pleas of the county of Philadelphia, that they will well and faithfully
sell said undivided moiety or half part of said messuage, tenement, and
house, with the appurtenances, for the highest and best price that can
fairly and reasonably be obtained for the same, and that they will
fairly, honestly, and faithfully pay said debts and expenses, and invest
the balance of the purchase money as is hereinbefore provided: Pro-
vided, further, That said court shall approve of said sale.

SECTION 2. SECTION 3. SECTION 4. That the commissioners of the district of Southwark, Marriott's lane, in the county of Philadelphia, are hereby authorized and empowered width increased to increase the width of Marriott's lane, between Fourth and Fifth streets, in said district, to the distance of thirty-five feet from the north line of said lane, and the damages accruing shall be paid as is now provided by law in the case of other streets in said county.
