Provisions of certain act

No. 224.

AN ACT

Supplementary to the act incorporating the borough of Williamsport; relative to Dickinson Seminary; and relative to road viewers in the counties of Lycoming and Tioga.

SECTION 1. Be it enacted by the Senate and House of Representative of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That the following described territory be, and the same is hereby included in the corporate boundaries of the borough of Williamsport, to wit: beginning at the south-west corner of the present line bounding said borough; thence by the river south sixty-nine and one-half degrees west one hundred and forty-eight perches to a buttonwood, on land of Cameron and Perkins; thence north by the line dividing lands of James Armstrong, and others, two hundred and fifty perches to a ditch, on land of F. C. Campbell; thence north eighty-five degrees cast eighty-eight perches to the west line of a public road; thence by said road north fifty-two perches to a post; thence east two hundred and seventy perches to land of A. Woodward; thence by the east line of the road to the cemetery south forty-two perches to the south line of the Cemetery lot; thence south seventy-two degrees west forty perches to a post, on land of David Thomas; thence south twelve and one-half degrees west twenty-two perches to the south side of a public road; thence south twenty-five and one-half degrees east fifty-four perches to the river; and thence by the river south fifty-eight degrees west one hundred perches to the south-east corner of the present boundary of said borough.

SECTION 2. That the provisions of the act entitled "An Act regulating boroughs," passed the third day of April, one thousand eight hunmade applica dred and fifty-one, be, and the same are hereby extended to the said borble. • ough of Williamsport.

SECTION 4. SECTION 5. SECTION 6. SECTION 7. That the compensation of a surveyor in the county of Compensation Lycoming and Tioga, as a viewer of roads and bridges, under the act of surveyors in entitled An Act relative to public roads in certain counties therein Lycoming and Tioga cos. named," approved the twenty-fourth day of February, one thousand eight hundred and forty-five, shall hereafter be two dollars per day, and the daily pay of the other viewers shall remain as heretofore.

AN ACT

To incorporate the North East Cemetery, in the county of Erie; to declare the waters of Sugar creek lake a highway; to authorize the overseers of the poor, of Summit township, Crawford county, to sell land; to authorize the commissioners of Venango county to borrow money; to change the name of Albert Borden; to change the time of holding elections in Sparta township, Crawford county; to authorize the road commissioners of the several townships, in Erie and Bradford counties, to view and lay out private roads; to change the time of holding elections in Concord township, Erie county; to change the mode of voting in the Erie and North East railroad company; to authorize the trustees of the Erie Academy to sell land, and to repeal the twenty-second section of the act of twenty-eighth of April, A. D., one thousand eight hundred and fifty, entitled "An Act regulating election districts, and relating to the election of supervisors and borough officers.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That George Hurst, Thomas Crawford, John Brawly, John Schouller, James Smedly, E. W. M. Blaine, David Allison, Bester Town, William A. Robinson, John Sillymon, James Whitehill, James H. Haynes, John Greer, William Griffith, Herman Robinson, Jacob Knapp, Robert Crawford, Joseph McCord, William Custord, James M. Moorhead, Peter Haldeman, Thomas Mellin, Calvin Spofford, John Butt, Harman Ensign, Samuel Molick, Powell Harper, Robert Custord, Russell A. White, Elijah Heath, Harvey Newton, Chancy Campbell, Samuel Kingsbury, Ozee Selkregg, A. W. Blaine and R. S. Brawly, be, and they and their successors are hereby created a body politic in law, under the name and title of the "North East Cemetery," and by that name and title shall have perpetual succession, and be able and capable in law to have and use one common seal, to sue and be sued, implead and be impleaded in all courts of law and equity, and to do all such other things as are incident to a corporation.

Annual meeting SECTION 2. That the annual meeting of the corporation shall be held on the second Monday of January in every year, at such time and place, and on such notice as shall be provided for in the by-laws, at which annual meeting it shall be the duty of the corporators to fill all vacancies that may occur in their number, from among the lot. holders in the cemetery; and at such annual meetings said corporation shall have full power and authority, by a vote of the majority of the corporators present, to pass, ordain and establish all such by-laws, rules and regulations not contrary to the constitution and laws of the United States and of this State, which may be necessary for the proper govvernment of the corporation, its officers and affairs, the protection of the cemetery and grounds from visitors and intrusion, for the regulation of burial, the improvement of burial lots, the erection of grave stones, monuments and sepulchral structures, and the inscriptions on the same. SECTION 3. That the business of the corporation shall be conducted conducted by by a board of seven managers, chosen from the body of the corporators as is hereinafter provided, said board of managers (five of whom shall constitute a quorum necessary for the transaction of business) shall choose a president out of their own number, and shall have power to

appoint a secretary and treasurer, and such other officers and agents as Officers. may be needful, to fix their compensation and wages, and discharge the same at pleasure, to take security from the treasurer for the faithful performance of his trust, to enforce and carry into execution all the bylaws, rules and regulations of the corporation, and to do all other acts necessary within the power conferred upon the corporation by this or any other act; the first election of managers may be held at any time Elections. that a majority of the corporators shall appoint, on their giving at least ten days' previous notice, by written or printed handbills, not exceeding seven in number, put at the most public places in said borough and township, which election and all subsequent elections of managers shall be by ballot; the managers thus chosen shall serve until the next annual meeting of the corporation, when, and annually thereafter, the corporators present shall elect a board of managers to serve for one year and until their places are supplied; in case of failure to elect, said board of managers shall cause a record of their proceedings to be kept, and shall make report of the same, and the state of the finances at each annual meeting of the corporation, and as much oftener may be required by a majority of the corporators.

SECTION 4. That the said corporation shall have power to contract Hold lands. for, purchase, pay for, receive title and hold any tract or tracts, or other quantity of land within the county of Erie, not exceeding in the whole one hundred acres, for the purposes of a cemetery, and the same to lay out, fence and ornament, to divide and arrange it into suitable plots and burial lots, establish carriage-ways and foot-ways and other avenues, erect buildings, and to do all other things necessary and proper to be done, to adapt the ground and premises to the uses aforesaid; and to sell and dispose of said lots and plots, making the title in fee simple or otherwise, for the purpose of sepulture to individuals, societies or congregations, or other public bodies, without distinction of person, party or sect, under such conditions, rules and regulations as the said corporation may establish for the government of lot owners, in the occupancy of the same, not inconsistent with the provisions of this act: Pro- Proviso. vided, That all the land thus purchased and held by the corporation, or 20 much as shall be laid out and appropriated to cemetery purposes, shall not be converted to any other use, either by the corporation or its grantees, and all the lands thus purchased and held by the corporation or by its grantees for burial purposes, shall be free from all taxes, except for State purposes, and from seizure, levy and sale, under or by virtue of any execution or other legal process against the said corporation or its grantees.

SECTION 5. SECTION 7. That the waters of Sugar Creek Lake and its inlet public highway, Westerly, so far as the Oil Creek road, in the county of Crawford, be, and the same are hereby declared a public highway.

That the overseers of the poor of the township of Sumpoor of Summit mit, in the county of Crawford, be, and they are hereby authorized to township Craw-sell by public out-cry at Harmonsburg, in said township, after giving certain real es- public notice of the time and place of sale by at least three weekly publications in one of the papers of said county, and by five hand bills put up in the most public places in the said township, twenty-days before the day of sale, a certain fifteen acres of land in said township of Summit, bounded north by Philip Foust, east by Murphy and Vanlieu, south by Philip Foust, and west by Philip Foust, as the property of one Eli Foust, for the best price that may be got therefore, and on such terms as said overseers may judge best, and make a deed therefor to the purchaser or purchasers; the proceeds of said sale to be applied to pay the past and future expenses incurred, and that may be incurred, in the support of said Eli Foust, a pauper chargeable to said township.

That from and after the passage of this act, the name Borden changed of Albert Borden, of the city of Erie, in the county of Erie, State of Pennsylvania, be, and the same is hereby changed to that of Albert Schneider, and the said Albert Borden shall be known and called by the name of Albert Schneider, and by that name he shall be able and capable in law to sue and be sued, grant, and receive and inherit property, and do all other legal acts and things as fully and effectually to all intents and purposes as he could have done under his former

SECTION 11. That the citizens of Sparta township, Crawford county, are hereby authorized and required to hold their annual elections for township officers on the Friday preceeding the second Monday in February.

SECTION 12. That the road commissioners of the several townships in the counties of Erie and Bradford, are, and they are hereby invested cos. regulated. with the powers and authorities conferred by the act of June thirteenth, one thousand eight hundred and thirty-six, entitled "An Act relating to roads, highways, and bridges," upon the Court of Quarter Sessions of said county, relating to private roads, and they are hereby authorized, upon the petition of any citizens of their respective townships, to view and lay out such private roads of any width not exceeding thirty-three feet; the expenses and damages thereof to be paid as is provided in said act of thirteenth June.
