AN ACT

For the relief of Jacob Hogleberger, a Soldier of the Indian war.

SECTION 1. Be it enacted by the Senate and House of Represenlatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That the State Treasurer be, and he is hereby authorized and required to pay to Jacob Hogleberger, of Crawford county, a soldier of the Indian to his order, an annuity of forty dollars, commencing on the first day of January, one thousand eight hundred and fifty-two, payable half yearly on the first day of January and July.

A SUPPLEMENT

To the act entitled 'An Act to provide for the erection of a house for the employ ment and support of the poor, in the county of Westmoreland;" regulating certain election districts, and erecting an independent school district in said county; repealing an act relative to the destruction of fish in said county; incorporating the Evangelical Lutheran and German Reformed Congregations of Ligonier; and relative to the estate of James Donaldson, deceased.

SECTION 1. sons, he shall receive from the directors of said poor house, the sum of thirty-seven and a half cents for executing the order or warrant, eight cents for each mile circular, counting from the office of the justice from which the order or warrant issued, and one dollar for conveyance, if under fifteen miles, and for any greater distance the sum of one dollar and fifty cents: Provided, That if there are more than one name contained in the order or warrant, the foregoing fees shall be charged and no more: Provided, That no justice of the peace shall issue an order or warrant as provided in this section, for any person having a settlement out of the township in which said justice resides.

SECTION 2. That if, upon receipt of an order or warrant directed to him, the person or persons therein named cannot be removed to the house of employment of said county, by reason of sickness or other bodily injury, sustained by him or them, then in such case the constable shall make suitable provision, and furnish such relief as their situation may require, having regard to the interests of the county, and as soon Directors to be as convenient thereafter, notify the directors of the poor in writing of the facts of the case, who shall make provision for the payment of the same, and for which services he shall receive the sum of fifty cents, and three cents for each and every mile circular, and as soon as the person or persons named in the order or warrant, are able to be removed, it shall be the duty of the constable to convey the person or persons to the house of employment, and deliver him or them to the steward or keeper thereof, and in case of neglect or refusal to perform the duties Penalty for ne- hereby enjoined on him, he shall be liable to indictment, for misdeglect. meanor in office, and shall be fined in any sum not less than ten and not exceeding fifty dollars, at the discretion of the court.

SECTION 3. That it shall not be lawful for the directors of the poor to pay any funeral expenses or other charges, after the death of any person on a warrant issued by two justices of the peace for that purpose, where there were five or more days' time before the death of such person, for him or some one in his behalf, to procure an order or warrant, signed by two justices of the peace, and directed to a constable, who shall proceed in the manner directed in the foregoing second section, and receive the same fees as therein directed.

SECTION 5. That all laws hereby altered or supplied, so far as are inconsistent with the act, and this supplement to the act, are hereby

repealed.

SECTION 6. That hereafter the qualified voters of South Huntingdon South Huntingtownship, Westmoreland county, shall hold their general and township den township, Westmoreland elections at the house of William Turner, in said township, and all that co. part of Unity township, in said county, known by the name of Kuhn's district, shall hold their general elections at the house of George Shabondys, in said township.

SECTION 7. That all that part of Sewickly township, Westmoreland Sulphur Spring county, known as Sulphur Spring school district, shall be erected into school district a separate independent school district, with all the powers and privileges erected in of any district in said township, and that Jacob Grenewalt, and Jacob Wilson, shall serve as school directors for one year, and Alexander Guffey, and Thomas Moore, shall serve for three years, and Samuel McDonald, and Samuel Smith, for three years, from and after the passage of this act; the first election for school directors shall be held on the first Thursday of April, one thousand eight hundred and fifty-three, and every successive year thereafter, at the stone school-house, in said district, and the president and secretary of said board shall hold said elections.

SECTION 8. That the fourth section of the act of the eighth day of Repeal. April, one thousand eight hundred and forty-eight, entitled "An Act relative to the destruction of fish in the counties of Cumberland, Franklin, Westmoreland, and Clarion, and for other purposes," be, and the same is hereby repealed, so far as relates to Westmoreland county.

SECTION 9. That the present members of the Evangelical Lutheran Corporation. and German Reformed congregations, and all persons who may hereafter become regular members of said congregations, in Ligonier, Westmoreland county, are created into a body corporate in fact and in law, to be known by the style and title of "The Evangelical Lutheran and German Reformed congregations of Ligonier, Westmoreland county," to have perpetual succession, to be capable in law to sue and be sued, Privileges. to plead and be impleaded in any court of law or equity, in this State, or elsewhere, to be able to make, have, and use a common seal; the same to break, alter, or amend, at pleasure, and also to ordain and establish such by-laws and ordinances as shall be necessary for the regulating of their temporal concerns, and for promoting piety among their members: Provided, The same shall not be repugnant or contrary to Proviso. the laws of this Commonwealth.

SECTION 10. That the business of said corporation shall be conducted Trustees to conby six trustees, who shall choose from their number a president and duct business, secretary, and may appoint a treasurer, or treasurers, or such other &c. officers as they may deem necessary, and until others shall be appointed, as hereinafter provided; the following named persons shall be appointed trustees, viz: Michael Kaffer, William Ambrose, Jacob Loury, John Trustees. Wills, John Barron, and Henry Brant, to continue in office until the first Saturday of January, A. D., one thousand eight hundred and fiftythree, or until their successors shall be elected; and on the said first Saturday of January, A. D., one thousand eight hundred and fifty-three,

SECTION 11. That said corporations shall be able and capable in law to have, purchase, take, receive, and hold, lands, tenements, results, annuities, and hereditaments, which may be sold, devised, bequeathed, or in any other way conveyed to them for their use, or in trust for their use: Provided, That the yearly value or income of said estate shall not at any one time exceed two thousand dollars, and shall not be ppropriated to any other than religious or benevolent purposes.

SECTION 13. That the guardians of the minor heirs of Elizabeth children of Jas. Stirlen, deceased, and of Polly Johnston, deceased, both of whom were Donaldson, dec. children of James Donaldson, deceased, of Westmoreland county, are to sign releases. hereby authorized to sign and execute releases for the interest and titles of said heirs in certain real estate in said county.

AN ACT

Relating to taxes for borough purposes, in the borough of Carlisle; to collect a dog tax in the borough of Newville, in the county of Cumberland, and to lay out a State road from a point at or near Wagoner's lane, in Newton township, in said county, on the State road leading from Carlisle, in said county, to Roxbury, in Franklin county, to intersect the State road running from Lewistown, in Mifflin county, to Shippensburg, in said county of Cumberland, at or near the Three Square hollow; and also, to the erecting of a bridge over the Conedoguinet creek, in the county of Cumberland, on the line of said road.

SECTION 1. Be it enacted by the Senate and House of Represen tatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That all personal property, moneys at interest, bonds and mortgages, of the

SECTION 2. SECTION 4. SECTION 5. SECTION 6. That it shall be the duty of the said commissioners to Drafts to be make out a fair and accurate draft of the location of said road, respec- made out and tively noting the courses and distances as they occur, the improvements, and also the crossing of township lines, roads, and waters, with such other matter as may serve for explanation, one copy whereof shall deposited in the office of the Secretary of the Commonwealth, on or before the first day of January next, and one copy in the office of the clerk of Quarter Sessions in the said county of Cumberland, or as much sooner as practicable, which shall be a record thereof, and from thenceforth the said road shall be to all intents and purposes a public highway, and shall be opened to the breadth of thirty-three feet at least, and repaired in all respects as roads are opened and repaired which are laid out by order of the court of the said county of Cumberland. SECTION 7.
