to plead and be impleaded, in all courts and places and in all matters whatsoever, and shall in like manner have authority to have and use a common seal and alter the same at pleasure, and may also make, ordain, and put in execution such by-laws, ordinance, rules, and regulations as shall be deemed proper and necessary for the good government of said society. and the prudent and efficient management of its affairs; Provided, that nothing be done contrary to the constitution of the United States or the laws of this territory.

SEC. 2. That the object of this association shall be the development of our agricultural and mechanical resources, domestic manufactures, and the general improvement of our homes.

SEC. 3. That the officers of this society shall consist of a president, vice president, secretary, treasurer, and five directors, to be selected from the county at large, all of whom shall be chosen by the society on the first Saturday in January. In addition to the above, there shall be directors elected in each township of the county by the members residing therein, according to the following apportionment, viz.: The first ten members shall elect one director, and every twenty-five members in addition thereto shall elect one director; said officers shall hold their offices for the term of one year and until their successors are elected and qualified; they shall constitute a board of directors for the society, and shall have power to fill vacancies that may occur in their body during the year; it shall be their duty to superintend the general interests of the society, to take efficient measures for getting up an annual exhibition or fair by offering such premiums as the means at their disposal will permit, to make all the rules and regulations that may be necessary for conducting such exhibition or fair, and to note and report annually any superiority in domestic animals, crops, and modes of culture that they may deem of importance to the society.

SEC. 4. That five members of the board of directors shall constitute a quorum for the transactions of business, but a less number may meet and adjourn from time to time.

SEC. 5. That the president shall exercise the functions common to that office, both at the meetings of the board and of the society, and shall have power to call special meetings of the society or board whenever he may deem it necessary.

SEC. 6. That it shall be the duty of the treasurer to re

ceive all moneys from the secretary and pay the same over upon the order of the president, countersigned by the secretary; before entering upon the duties of his office he shall execute a bond, with at least three securities approved by the board, conditioned for the faithful performance of all the duties of his office.

SEC. 7. That it shall be the duty of the secretary to estab- Secretary. lish an office in some central portion of the county at which to keep the books and papers of the society, to receive entries for the annual exhibitions, and transact such other business as may devolve upon him as an officer of this society; he shall be ex-officio secretary of the board of directors, shall have power to appoint deputies when needed, and exercise all other functions and perform all other duties commonly assigned to such office.

SEC. 8. That any person may become a member of this society by giving in his or her name and paying one dollar as a matriculating fee, and annually thereafter, on or before the first Saturday in January, an assessment of one dollar.

SEC. 9. That any person may become a life member of Life member. this society by giving in his or her name and paying the sum of ten dollars.

SEC. 10. That every member of this society shall be enti tled to vote on the election of the officers thereof, and upon the determination of all questions that may arise in the deliberations of this society.

SEC. 11. That the board of directors may, at their discretion, require any person contending for any premium offered by them, to pay upon entry any sum not exceeding twenty per cent. of such premium.

SEC. 12. That Joseph Gardner, E. B. Whitman, P. H. Berkaw, Lyman Allen, Joel Grover, Erastus Heath, G. F. Warren, Levi Woodard, Henry Hiatt, G. W. Deitzler, and John H. Furman are constituted the first board of directors of this society.

SEC. 13. That it shall be the duty of the county tribunal transacting county business for the county of Douglas to appropriate annually, between the first day of March and the first day of July, a sum not less than five hundred dollars or over one thousand dollars, to be devoted, under the direction. of the officers of this society, exclusively to the payment of premiums as offered and published by this association.

CHAPTER IV.

AN ACT to incorporate the Franklin County Agricultural Society.
Be it enacted by the Governor and Legislative Assembly of the
Territory of Kansas:

SECTION 1. That there is hereby established and incorporated a society, to be known and designated by the name Name and pow and style of the Franklin County Agricultural Society; and by that name and style shall have perpetual succession; and by that name shall have power to contract and be contracted with, to sue and be sued, plead and be impleaded, in all courts; answer and be answered to, defend and be defended, in all courts and places, and in all matters whatsoever; and may also make, ordain and establish and put in execution such by-laws, ordinances, rules and regulations as shall be proper and necessary for the good government of said society, and the prudent and efficient management of its affairs; Provided, that said by-laws, ordinances, rules and regulations shall not be contrary to the provisions of this charter, the laws of this territory, or the constitution of the United States.

SEC. 2. That for the purpose of carrying into effect the provisions of this act, Joseph Merit, H. V. Benson, Jacob Sumstine, D. C. Weatherwax, P. P. Elder, and Nathan Ames, and their associates, of said Franklin county, or any three of them, shall have power to call the first meeting of the society, at the county seat of said county, at such time or times as they may agree upon; and at such meeting, any five members shall constitute a quorum to do business.

SEC. 3 That at the first meeting of the persons herein provided, they shall have power to elect a president, vicepresident, secretary, treasurer, and prudential committee of

CHAPTER V.

AN ACT incorporating the Linn County Agricultural Society.

Be it enacted by the Governor and Legislative Assembly of the
Territory of Kansas:

SECTION 1. That William Snook, Robert Ewing, H. K. Robinson, J. M. Arthur, R. B. Mitchell, Riley Barber, Andrew Stark, Josiah Cummings, Alonzo Curtis, G. W. Garrett, J. W. Babb, Wm. Hutchins, S. A. McGrew, James Montgomery and T. F. Willson, and their associates and successors, be and are hereby constituted a body politic and corporate, under the name of the Linn County Agricultural Society.

SEC. 2. That said society shall have power and be capable of building, purchasing, or taking in fee simple, or on lease, or by gift, grant, demise or otherwise, any lands, tenements or estates, or any property real or personal, or mixed, as may be necessary to carry on the objects of the society; and said society may also sell, alienate, convey, lease or dispose of the same as it may seem proper.

SEC. 3. Said society may have a common seal, and may alter or change the same at pleasure, and said society shall have all legal remedies, in any or all the courts of this territory, and shall be liable for all debts contracted in a corporate capacity, the same as an individual.

SEC. 4. That all property held or owned by the corporation, not exceeding five thousand dollars in value, shall be free from all taxation whatsoever.

SEC. 5. The objects of said society shall be to encourage progress in agriculture, arts, and manufactures; and the better to promote these objects, they are hereby empowered to adopt a constitution and by-laws for their government, and to elect such officers as they may see fit; Provided, no article of the constitution or by-laws adopted by this society shall conflict with the statutes of this territory or constitution of the United States.

SEC. 6. This act shall take effect and be in force from and after its passage.
