CHAPTER CLXIV.

AN ACT to repeal an act to establish a Ferry across the Missouri river at
Leavenworth city, territory of Kansas, and for other purposes.

Be it enacted by the Governor and Legislative Assembly of the
Territory of Kansas:

SECTION 1. That an act entitled "An Act to establish a ferry across the Missouri river at Leavenworth city, territory of Kansas," approved February 11th, A.D. 1859; also an act approved January 31st, A.D. 1860, entitled "An Act explanatory of an act entitled 'An Act legalizing certain bonds therein named,' approved January 18th, A.D. 1860;" also the proviso in the latter part of the fourth section of the act mentioned in the second section of this act, be and the same are hereby repealed.

SEC. 2. That an act entitled "An Act to establish a ferry at the town of Leavenworth, in the territory of Kansas," passed by the Governor and Legislative Assembly of this territory in the year 1855, be and the same hereby is excepted from the operation of any and all repealing acts heretofore passed, and said act is hereby revived, and shall have the same force and effect as if said repealing acts had not been passed; and the privileges granted to the persons named in said act are hereby confirmed to their assigns the same as if said privileges had been originally granted to them.

SEC. 3. That the act mentioned in the preceding section is hereby amended, as follows:-The owners of the ferry privilege granted by said act shall not be required to run their boat or boats for the purpose of carrying passengers, teams, horses, mules, cattle, sheep, swine, or other stock, in the night time, nor at any other time when it shall be unsafe to do so, by reason of ice in the river, or other cause. The right to charge the rates of ferriage prescribed in the third section of said act shall not be impaired or abridged during the time said ferry privilege shall exist, according to the provisions of this act and of the act hereby amended. The landing of said ferry on the west side of the Missouri river shall extend to the present limits of the city of Leavenworth, and should said limits be extended, then to the limits so extended; and the time mentioned in said act, during which the grantees and their assigns shall enjoy the privileges thereby granted, is hereby extended ten

(10) years beyond the expiration of the period mentioned in said act, anything in said act to the contrary notwithstanding. SEC. 2. This act shall take effect and be in force from and

AN ACT to incorporate a Ferry across the Missouri river at the city of Quin-
daro, Kansas territory.

Be it enacted by the Governor and Legislative Assembly of the
Territory of Kansas, as follows:

Term, location

SECTION 1. That George W. Veale, Abelard Gutherie, Fielding Johnson and Julius G. Fisk, their associates, their, and extent. executors, administrators and assigns, shall have the right and privilege for the term of ten years from and after the passage of this act of keeping and maintaining a public ferry across the Missouri river at the present limits of the city of Quindaro, in the territory of Kansas, and no other ferry shall be established within two miles of the present limits of the city of Quindaro aforesaid, provided that the ferry landing on the west or Kansas side of the Missouri river shall be restricted to and confined within the limits of said city.

SEC. 2. That the above-named persons shall provide that a good and substantial boat or boats adapted to the wants of the public at the city of Quandaro, which shall be kept by them or their assigns properly manned, attended, and propelled by steam, horse power, or otherwise, and kept in good repair.

SEC. 3. That the said parties herein before named, their heirs and assigns, shall have the exclusive privilege of establishing and keeping a ferry within the limits of Quindaro city across the Missouri river on the west or Kansas side thereof for the period of ten years as aforesaid; but the said per

sons, their heirs and assigns, shall execute a good and suffi cient bond, to be approved by the mayor and common council of the city of Quindaro, conditioned that they will comply with the conditions of this act.

SEC. 4. The mayor and common council of the city of Quindaro shall from year to year, or whenever they may think proper, fix and establish the rate of ferriage, and a list of the same shall be posted on the boat used for ferrying, or at the landing of said ferry.

SEC. 5. The said persons so chartered, their heirs or assignes, shall keep the said ferry and its appurtenances in good repair and condition, and they shall be allowed a reasonable time to repair, or, in case of loss of their boat, time to procure another.

SEC. 6. The mayor and common council of the city of Quindaro may, at their discretion, charge and collect a license from the persons aforenamed, for the use and benefit of the city of Quindaro, in any sum not exceeding twenty dollars per annum, for the privilege of using said ferry.

SEC. 7. The persons so chartered, their heirs and assigns, shall not be required to commence running a boat or boats on said ferry before the first day of May next, anything herein to the contrary notwithstanding.

SEC. 8. This act to take effect and be in force from and after its passage.

CHAPTER CLXVI.

AN ACT to establish and charter a Ferry across the Missouri river at the City
of Wyandott.

Be it enacted by the Governor and Legislative Assembly of the
Territory of Kansas:

SECTION 1. That the exclusive right to establish, maintain, and operate a Ferry across the Missouri river at any point or points between the mouth of the Kansas river and a point of said river two miles above the mouth aforesaid, with Location. the right to land on either side of the mouth of the Kansas extent. river, for the period of twenty years from the passage of this act, be and the same is hereby granted to the city of Wyan- Corporator. dott.

SEC. 2. That the said city of Wyandott shall, within six months from the date of the passage of this act, cause to be run a good and substantial steam ferry boat across the Missouri river within the limits described in the first section of this act, and to keep the same at all times ready to accommodate the traveling public, except in cases of ice, and when unavoidable accidents may disable said boat, then a reasonable time for repair shall be allowed.

SEC. 3. That the said city of Wyandott shall have authority in its corporate capacity to lease the ferry right granted by this act for any term of years not exceeding the limits of this charter; and the said city of Wyandott, or the party or parties leasing said ferry, shall be subject to all of the provisions of an act entitled "An act regulating Ferries," approved February 8, 1859, not inconsistent with the provisions of this act. SEC. 4. That all acts heretofore passed establishing ferries within the limits described in the first section of this act, be and the same are hereby repealed.

SEC. 5. This act to take effect and be in force from and after its passage.

CHAPTER CLXVII.

AN ACT authorizing a Ferry across the Great Nemaha river.

Be it enacted by the Governor and Legislative Assembly of the
Territory of Kansas:

SECTION 1. That John W. Forman and D. Vanderslice are hereby authorized to keep a public Ferry across the Great Nemaha river, at a point near Elisha's creek, for the term of fifteen years from and after the passage of this act, and they shall have a landing on both sides of said river.

SEC. 2. That the above named persons, their associates and successors, hereby promise and agree that a good and substantial ferry boat or boats, adapted to the wants of the public, shall be kept by them and their successors, the said boat or boats to be properly manned, attended and propelled, and kept in good repair.

SEC. 3. That said persons named in the first section of this act, and their successors, shall have the exclusive privilege of establishing and keeping a ferry at the point aforesaid, and within two miles above and below the point mentioned in section first of this act, for the period of fifteen years; the said persons mentioned above, and their successors, shall execute a sufficient bond, to be approved by the tribunal transacting county business of Brown county, conditioned that they comply with the provisions of this act.

SEC. 4. That said Forman and Vanderslice, and their associates and assigns, shall have the exclusive right of build ing a bridge and maintaining the same at the said place over the Great Nemaha river for fifteen years, and shall be gov erned in all matters, and have all the rights of the charter granted Joseph Beaty to build a bridge across Independence creek, approved February 9, 1859, and may adopt a corporate name, and by it own and control the bridge as aforesaid.

SEC. 5. The tribunal transacting county business shall, from time to time, fix the rates of ferriage and toll, and a list of the same shall be posted up at the landing of said ferry.

SEC. 6. That said persons, and their successors, shall keep said ferry in good repair and condition, being allowed a reasonable time to repair in case of accident, or procure a new boat or boats.
