How construed

SEC. 2. The said corporators shall keep a good and substantial boat, or boats, steam, horse, or flat boat, as the wants of the public may demand; said boats shall be kept in good condition and constant readiness at said ferry, properly manned and attended for speedy and safe crossing at all times, and whenever called upon by citizens, travelers and others.

SEC. 3. In case of accident to, or loss of said boat or boats, the corporators shall have reasonable time to repair the same, or to construct or to procure new boats.

SEC. 4. The tribunal transacting county business for the county of Shawnee may, from year to year, establish the rates of ferriage to be charged at said ferry. A list of said rates shall be conspicuously posted at the landing of said ferry and any charge made or extorted by the parties in charge of said ferry, greater than the rates prescribed by said tribunal, shall work a forfeiture of all the rights and privileges of this act.

SEC. 5. That the said corporators, their associates, successors and assigns, before availing themselves of the privileges of this act, and yearly thereafter, to wit.: upon the first Monday of January in each year shall execute sufficient bonds, to be approved by the aforesaid county tribunal, conditioned that they will fully comply with and observe all the provisions of this act, the said bond to be filed in the office of tribunal aforesaid, and may be sued on by any person aggrieved, injured or unnecessarily detained at said ferry, and a copy of the same, under the seal of the said tribunal, properly attested, shall be sufficient evidence of the contents of said bond.

SEC. 6. Nothing in this act shall be construed to prohibit the Topeka Bridge Company from running any such boat or boats as they may require to promote and facilitate the construction of a bridge across the said Kansas river.

This act to take effect and be in force from and after its passage.

CHAPTER CLIV.

AN ACT to establish a ferry across the Kansas river, at Waubaunsee, in Kansas

Territory.

Be it enacted by the Governor and Legislative Assembly of the
Territory of Kansas, as follows:

SECTION 1. That John H. Nesbitt, Charles B. Lines, E. C. Corporators. D. Lines, William Mitchel, jr., S. M. Thomas, Julius F. Williard and Walker S. Griswold, trustees of the Waubaunsee Town Company, and their successors in office, under the name of the Waubaunsee Ferry Company, be and they are hereby Name. authorized to establish and keep a ferry across the Kansas Location and river, in the territory of Kansas, for the term of ten years from and after the passage of this act, and they shall have a landing on the south side of said river, on the town site of Waubaunsee, and on the north side of said river on land in Potawatamie county, at a point convenient for the purposes of said company. SEC. 2. That the above named company shall keep a good, or boats. substantial ferry boat or boats, adapted to the wants of the public, at the point aforesaid, the said boat or boats to be properly manned, attended and propelled, and kept in good repair.

SEC. 3. The said company and their successors shall have the exclusive privilege of establishing and keeping a ferry at the point aforesaid, and within two miles above and below said point Extent and term upon said Kansas river, for the period of fifteen years; but the said company and their successors shall execute a sufficient Bond. bond, to be approved by the tribunal transacting county business for the county of Waubaunsee, and shall renew the same whenever required by said tribunal, conditioned that they will comply with the provisions and conditions of this act: Provided, that the company hereby incorporated shall not have any right or privilege to keep a ferry or have a landing at any other point than that before described, without the consent. of all adjoining proprietors of land.

SEC. 4. The tribunal transacting county business for the Tolls. county of Waubaunsee shall, from time to time, or whenever they think proper, fix the rates of ferriage, and a list of the

same shall be posted up at the landing of said ferry.

SEC. 5. The said persons and their successors so chartered Keep in repair. shall keep the said ferry and its appurtenance in good repair

and condition, being allowed a reasonable time to repair in

case of accident, or procure a new boat when necessary.

SEC. 5. That the said persons so chartered, and their successors, shall not be required to commence running their boat upon said river before the first day of September next. This act to take effect and be in force from and after its passage.

CHAPTER CLV.

AN ACT to establish and charter a ferry across the Kansas River, at or near the
mouth of the Wakarusa,

Be it enacted by the Governor and Legislative Assembly of
Kansas Territory:

SECTION 1. That Charles Fish, his heirs and assigns, are hereby authorized to keep a ferry across the Kansas river, at or near the mouth of the Wakarusa, Douglas county, and territory of Kansas, and shall have the exclusive right and privilege of keeping a ferry, within the distance of one mile above and one mile below the mouth of the Wakarusa river, on the Kansas river, for the term of five years from and after the passage of this act.

SEC. 2. That the said Charles Fish shall keep a good and substantial boat or boats, sufficient to cross the traveling pub. lic, and shall cause the same to be kept by good and safe hands.

SEC. 3. That the tribunal transacting county business for the county in which said ferry shall be situated, is hereby authorized to determine and fix the fees for ferriage across said river, from time to time, as the same may be deemed neces

sary.

SEC. 4. That the said Charles Fish, so chartered, and his assigns, shall keep said ferry and its appurtenances in good order and repair, but shall be allowed a reasonable time to repair, or in case of the loss of a boat, to procure another.

SEC. 5. That the said party or parties before mentioned shal shall, before proceeding to put in operation said ferry, execute sufficient bond, to be approved by the aforesaid tribunal, and filed with them, conditioned that he or they will comply with. and fully observe all the conditions and provisions of this act; and said bond may be sued on by any person aggrieved or injured, or unnecessarily detained by said ferry, and that a copy of the same, under the seal of said tribunal, properly attested, shall be sufficient evidence of the contents of said bond, on a trial had for damages.

SEC. 6. That a non-compliance with the provisions of this Forfeiture. act shall work a forfeiture of this charter.

This act to take effect and be in force from and after its

passage.

CHAPTER CLVI.

AN ACT to charter a ferry across the Marias des Cygnes.

Be it enacted by the Governor and Legislative Assembly of the
Territory of Kansas:

SECTION 1. That Henry Dunbar, his heirs and assigns, are hereby authorized to keep a ferry across the Marias des Cygnes river, within one mile of a point where the road from Twin extent. Springs to the Missouri State line crosses said river, in Linn county, and shall have the exclusive right and privilege of keeping a ferry within the distance of one mile on each side of [where] such ferry may be located, for the term of ten years. SEC. 2. That the said Henry Dunbar shall keep a good of boats. and substantial boat or boats, sufficient to cross the traveling public, and shall cause the same to be manned by good and safe hands.

SEC. 3. That the board of county supervisors, or board of county commissioners for the county in which said ferry is situated, is hereby authorized and required to fix the fees for

SEC. 4. That the said Henry Dunbar, his heirs or assigns, shall keep said ferry and its appurtenances in good order and repair, or in case of loss of boat, to procure another.

SEC. 6. This act to take effect and be in force from and after its passage.

CHAPTER CLVII.

AN ACT to establish a ferry across the Marias des Cygnes River.
Be it enacted by the Governor and Legislative Assembly of the
Territory of Kansas:

SECTION 1. That Henry Shively, his associates and assigns, are hereby authorized to keep a ferry across the Marias des Cygnes, at what is known as the Sewel Ford, for the term of five years.

SEC. 2. That the said H. Shively, his associates and assigns, shall be allowed to keep a good and sufficient boat or boats, at all times sufficient to cross the traveling public, and shall be entitled to such fees as the county board may allow for the same.

SEC. 3. That if the parties above named shall violate the provisions of this act, or fail to have said ferry in operation within six months from the passage of this act, [they] shall forfeit all the privileges herein granted.

SEC. 4. This act to be in force from and after its passage.
