CHAPTER VIII.

AN ACT to establish a Toll Bridge over the Arkansas river at the mouth of
the Fountain que Bouille.

Be it enacted by the Governor and Legislative Assembly of the
Territory of Kansas, as follows:

SECTION 1. That A. F. Bercaw, his associates, and suc-
cessors be, and the same are hereby authorized to erect a toll
bridge across the Arkansas river at or near the mouth of the
Fountain que Bouille river, in the territory of Kansas, and
to charge toll to all passengers crossing the same in the man-
ner hereafter provided; and the said bridge shall be so built
as not to obstruct the present or future fording of said river
at the place aforesaid.

SEC. 2. The tribunal transacting county business for the county in which said bridge shall be located, shall, from time to time, regulate the amount of toll to be charged, and in case said county tribunal neglect to regulate the rate of toll, then the said Bercaw, his associates, or successors shall collect such toll as to them shall seem just; always provided that the amount charged shall not exceed, for each footman, twenty cents; for each horse, mule, or ox, twenty-five cents; for any horse or mule with rider, forty cents; for every buggy, wagon, cart, or vehicle of any kind whatsoever, fifty cents.

SEC. 3. That the above privilege shall extend one mile and one-half from the mouth of the Fountain que Bouille river up the Arkansas river on a westerly direction, and the same distance down the Arkansas river from the mouth of the Fountain que Bouille river, and that the above mentioned incorporators shall have the exclusive privilege of erecting and keeping a toll bridge within the above prescribed limits for the term of twenty years.

This act to take effect and be in force from and after its
passage.

CHAPTER IX.

AN ACT to authorize Hiram E. Byington to build and maintain a briage across
the Marias des Cygnes river at the Sac & Fox agency.

Be it enacted by the Governor and Legislative Assembly of the
Territory of Kansas:

SECTION 1. That Hiram E. Byington, his associates, and Term of assigns shall have the exclusive right to build and maintain a toll bridge, for the term of ten years, across the Marias des Cygnes river at the ford where the territorial road from Leav- Location. enworth City to the town of Burlington crosses said river; Provided, such bridge be so constructed as not to obstruct in, any manner whatsoever the present or future fording of the

SEC. 2. CHAPTER X.

AN ACT to incorporate the Fort Scott Bridge and Ferry Company.
Be it enacted by the Governor and Legislative Assembly of the
Territory of Kansas:

SECTION 1. That William R. Griffith, William R. Judson, H. S. Wilson, S. A. Williams, B. F. Riggins, and their associates, are hereby authorized to erect a toll bridge across the Marmaton river and Mill creek, at or near the mouth of Mill creek, in Bourbon county, Kansas Territory, and to keep a ferry on the Marmaton, at that point, until said bridge shall be built.

SEC. 2. The company hereby incorporated shall be known by the name of The Fort Scott Bridge and Ferry Company, with power to make contracts, sue and be sued, plead and be impleaded by that name in all matters whatsoever. They are hereby authorized to have and use a common seal, to alter the same at pleasure, to make by-laws for the regulations of said company, to receive and collect subscriptions to the capital stock of the company, establish and collect tolls not to exceed the rate provided in this act, hold and convey real estate as much as may be necessary for the construction of said bridge and ferry, and do such other acts as may be necessary for the government of said company and the management of its affairs.

SEC. 3. They shall erect and keep in good repair such a bridge-and until the erection of said bridge such a ferry—as shall render the crossing thereon safe and convenient, and may charge and receive such rates as may be fixed by the tribunal transacting county business in the county of Bourbon.

SEC. 4. The capital stock of said company shall be divided into shares of ten dollars each, not to exceed eight thousand dollars in all.

SEC. 5. The corporators herein named, or a majority of them, may at any time proceed to open books for the subscription of stock, after having given due notice of the time and place by handbill or otherwise.

SEC. 6. The privileges herein granted shall be exclusive to the persons herein named, and their associates, for the term of twenty-one years from and after the passage of this act.

This act shall take effect and be in force from and after its

passage.

CHAPTER XI.

AN ACT authorizing Silas O. Hemenway, and others, to build a bridge. Be it enacted by the Governor and Legislative Assembly of the Territory of Kansas:

SECTION 1. From and after the passage of this act, the sole and exclusive privilege is hereby granted to S. O. Hemenway, and his associates and their assigns, for the period of ten years, to build, erect and construct, a bridge across the Fountain que Boui river, at or near Fountain City, Arrapahoe county, Kansas Territory; Provided, that said bridge shall be Proviso. completed within one year.

SEC. 2. Said company shall, at all times, maintain a good and sufficient bridge at said point and keep the same repaired, and at all times held in readiness for the accommodation of the traveling public; and no other person or persons whatsoever shall be permitted to build or maintain a bridge or ferry within two miles of said crossing, within said term of years.

SEC. 3. That the tribunal transacting county business for the said Arrapahoe county, is hereby authorized and required to determine and fix the rates of toll across said bridge. This act to take effect and be in force from and after its passage.

CHAPTER XII.

AN ACT to authorize William D. Harris and Alexander Street to build a
bridge across the 110 Creek, at the town of Washington.

Be it enacted by the Governor and Legislative Assembly of the
Territory of Kansas:

SECTION 1. That from and after the passage of this act, the sole and exclusive right and privilege is hereby granted, for the term of five years, to William D. Harris and Alexander Street, their heirs or assigns, to build, construct and maintain a bridge across 110 Creek, where the Santa Fe road crosses the same, at the town of Washington; Provided, that said bridge is completed within three months from the passage of this act.

SEC. 2. That it shall not be lawful for any person or persons whomsoever, to build or construct a bridge on said 110 Creek within one mile of said town of Washington.

SEC. 3. That said William D. Harris and Alexander Street, their heirs or assigns, are authorized to demand and receive the following rate of toll for crossing said bridge: For every pleasure carriage, ten cents; for every two horse, mule or ox wagon, ten cents; for every wagon drawn by more than two horses, mules or oxen, twenty cents; for every horse with rider, five cents.

SEC. 4. If the said William D. Harris and Alexander Street, their heirs or assigns, shall suffer said bridge to go to decay, so as to render crossing thereon unsafe, the privileges herein granted shall cease.

SEC. 5. This act to take effect and be in force from and after its passage.
