trusts, and to pay the proceeds thereof, to Charles W. Bender, Lewis Shennick, Joseph L. Hancock, and Daniel Bacon, in equal parts:

And whereas, It is the wish of all the persons interested in the said estate, that the said lots of ground should be sold, or otherwise disposed of, in order that a larger and more certain income may be obtained therefrom, which purpose cannot be effected to advantage as long as the lien or charge created by the said will, in favor of the said Frederick Stock, continues to bind the whole of the said estate, and the said Frederick Stock is willing to release and discharge the same, on receiving sufficient security for the payment to him of a fixed annual sum; therefore,

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That

the said Joseph Bacon, trustee under the said indenture, dated the ninth Powers of trusday of August, one thousand eight hundred and thirty-nine, is hereby tee. authorized and empowered to sell and convey, and to unite with the holders of the remaining four undivided seventh parts or shares of and in the aforesaid lots or pieces of ground, in the sale and conveyance of the same, and of either or any part thereof, either absolutely or upon ground rent or ground rents, to be reserved upon the usual terms and conditions, and with the usual covenants, and either at public or private sale; and also to unite with the said other holders in a grant to the said Frederick Stock, of a certain annual sum or annuity during the life of the said Frederick Stock, to be charged upon the said lots, or upon some or one of them, in lieu and in stead of the charge created by the will of the said Philip Stock; and also to unite with the said other holders in the assignment or transfer to the said Frederick Stock, for the term of his life, of any ground rent or ground rents that may be created or reserved on the conveyance of any or any part of the said lots of ground, and to execute and deliver all deeds and other instruments that may be necessary and proper for carrying into effect the powers hereby granted; and so that no purchaser of the said lots or either of them, and no one taking the same on ground rent, and no assignee of any ground rent, shall be bound to see to the application of the money arising therefrom, or shall be in any way liable in respect to the execution or non-execution of the said trusts.

AN ACT

To erect Danville, in Columbia county, into a borough.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That Danville, in the county of Columbia, shall be set apart and be separate from the township of Mahoning, in said county; and the same shall be and is hereby erected into a borough, which shall be called "The borough of Danville," bounded and limited as follows, to wit: beginning on the western bank of the river Susquehanna, at a point about fourteen rods below the mouth of the Mahoning creek; thence north four degrees east, crossing the creek in two places, as per draft, fifty-five perches to a pine bush above the road leading to Northumberland, and five rods north of the canal bank; thence along the south side of the hill above the Northumberland road, south seventy-nine and one-half degrees east twenty-one and one-fourth perches, south seventy-two degrees east one hundred and ten perches to a pine sapling, south seventyfive degrees east thirty-five perches to a pine tree; and thence north thirty degrees east seventy-six perches to the top of the Quarry ridge; thence down the said ridge south sixty degrees east ninety-five perches to the forks of the road at the foot of Welsh hill; thence north seventyfour degrees east seven perches to Lafferty's corner; thence along Lafferty's west line south thirty degrees east twenty-two perches to an alley in front of Lafferty's house; thence along the said alley north sixty degrees east twenty and one-half perches to Samuel York's west line; thence along the said line south thirty degrees east seventy-nine perches to a corner, near the Presbyterian burying ground; thence along the said ground and Daniel Frazer's west line south eighteen degrees east twenty-six perches to the south-east corner of the Presbyterian church lot; thence between the said lot and Daniel Frazer's land, south seventy-one degrees west sixteen perches to the south-west corner of the same lot; thence along Daniel Frazer's south line south thirty degrees east seventy-six perches to Jacob Sechler's line; thence through Jacob Sechler's low land south six degrees east thirty-six perches to the weaver shop at the lane leading down to the woollen factory; thence along the said lane south seventy degrees west thirty-six perches to the canal bridge; thence up the towing-path of the canal south twenty-five degrees east sixty-four perches to a point above John Foust's dwelling house; and thence crossing the canal south sixty degrees west along Foust's east line eighty perches to the river bank; and thence down the river the several courses and distances to the place of beginning. SECTION 2. The provisions of the act of the general assembly, passed tain act extended the first day of April, Anno Domini one thousand eight hundred and to the borough of thirty-four, entitled "An Act to provide for the incorporation of boroughs," are hereby extended to the borough of Danville, except so far as the same may be inconsistent with the other provisions of this act. SECTION 3. The high constable of the said borough shall have the power and authority vested by the laws of this commonwealth in the constables of the different townships, in the said county, and shall give

bond for the just and faithful discharge of the duties of his office, in the manner required of the constables of the different townships in the said county.

SECTION 4. At the first election held in the said borough for borough officers, there shall be elected six school directors, two to serve for one year, two to serve for two years, and two to serve for three years, and thereafter two school directors annually; and the said school directors shall perform the same duties, and possess the like powers in all respects, as school directors elected agreeably to the general laws of this commonwealth.

SECTION 5. The school directors first elected under the provisions of Enumeration of this act, shall, immediately after their election, cause to be made an taxable inhabienumeration of the resident taxable inhabitants in said borough; and tants. the president of the board of directors shall certify the same to the superintendent of common schools, who is hereby directed to adopt the number of taxables thus certified to him, as the basis of the distribution to said borough, of its share of the state appropriation; and the amount to which the said borough is entitled, shall be deducted from the amount to which Mahoning school district, in the said county, would otherwise be entitled, until after the next tri-ennial enumeration of taxables for school purposes.

SECTION 6. At the first election held in the said borough for borough officers, and thereafter annually, there shall be elected an assessor and a judge and two inspectors, to conduct the general and borough elections in said borough; and at such times as are directed by the existing laws of this commonwealth, an assistant assessor and two justices of the peace.

SECTION 7. The qualifications of voters in the election of burgess and Qualification of town council, shall be those required by the act of general assembly, voters. passed the first day of April, Anno Domini one thousand eight hundred and thirty-four, entitled "An Act to provide for incorporation of boroughs;" and the qualifications of voters in the election of all other officers provided for by this law, shall be the same as are required in the election of similar officers in the different townships in said county.

SECTION 8. The said borough shall form a separate election district; Separate election and the qualified voters therein shall hereafter hold their general and district. borough elections at the old court house in said borough.

SECTION 9. The borough elections in said borough shall be held on Annual elections. the third Friday in March of every year, between the hours of nine o'clock, A. M., and six o'clock, P. M., of said day.

SECTION 10. Any indebtedness by Mahoning township for the making Indebtedness of and repairing of roads or bridges, and for the support of paupers, and Mahoning townby Mahoning school district, shall be paid rateably by the proper ship, how reguauthorities of the said township and district, and the borough of Dan-lated. ville; and any money due or owing to the said township or district, shall be divided rateably between the said township and district, and the borough of Danville, (by the present auditors of Mahoning town

ship, whose authority is hereby continued for that purpose.)

SECTION 11. It shall be lawful for the town council of said borough Town council to to assess and collect a tax on all single freemen and inmates resident in assess and collect said borough, to be rated according to the provisions of the act to raise tax, &c. and collect county rates and levies; and the said town council shall further have the power and authority to assess and collect on each and every dog owned in said borough, a tax in amount not exceeding one

dollar, and on every bitch a tax in amount not exceeding three dollars, as they may deem expedient and proper for the use of said corporation. WILLIAM F. PACKER,

A SUPPLEMENT

To an act to incorporate the Dingsman's Choice and Delaware bridge company, passed the eleventh day of February, one thousand eight hundred and thirtyfour.

Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That if any person or persons shall pass Dingsman's Choice and Delaware bridge without the payment of the legal toll, with design to defraud the owners of the same, he, she or they shall forfeit and pay the sum of five dollars, to be recovered before any justice of the peace, by action of debt, in the same manner as debts of the same amount are now recoverable by law.

AN ACT

For the better regulation of the townships of New Castle, East Norwegian, and
Blythe, in Schuylkill county.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That

the qualified voters of the townships of New Castle and East Norwe- Supervisor not to gian, in the county of Schuylkill, hereafter, at the usual time of holding furnish for his inthe spring elections, shall elect but one person to the office of supervisor dividual benefit, of said townships; and that the said supervisor so elected or appointed, horses, carts, shall not be permitted to furnish for his individual benefit, either horses wagons, &c. and carts, or wagons and horses, in opening or repairing any of the public highways or bridges in said townships, at the expense of said townships, nor be in any way personally interested, either directly or indirectly, in the hire of any such horses, carts or wagons; and further, that the said supervisor and auditors of said townships shall act in conjunction in laying the rate of assessment, and in the appointment of a collector of the township rates and levies; and that the said supervisor shall, in all cases, act in conjunction with the township auditors in opening and repairing any of the roads and bridges of said township.

SECTION 2. That hereafter no order drawn by the supervisor of Orders of superNew Castle or East Norwegian townships aforesaid, in his own favor visors, how for services rendered by himself, for work done upon the public high- drawn. ways of such townships, shall be deemed good and valid, unless such order state, in the body thereof, the consideration for which the order is drawn, and the same to be countersigned by the town clerk of said townships, and an approval thereof, endorsed thereon by a majority of the township auditors.

SECTION 3. That from and after the passage of this act, the qualified One supervisor electors of Blythe township, Schuylkill county, shall elect but one only to be elected. supervisor, instead of two, and that he shall give bonds with sufficient To give bond. security, to the auditors of said township, in the name and for the use of said township, for the faithful performance of his duties; and said supervisor shall, after having given at least ten days' notice, by putting up not less than three written or printed advertisements, in as many public places in said township, give out by public outcry, to the lowest and best bidder, the making and repairing of the public roads in said township; payment to be made to the contractor or contractors as the same shall be, from time to time, collected from the road tax.
