AN ACT

Vesting in the burgess and town council of the borough of Erie, and their successors, in the county of Erie, the title to a certain tract of land, providing for the election of auditors in the borough of Erie, and changing the place of holding elections in M'Kean township, in the county of Erie.

WHEREAS, Owing to the great increase of the commercial business of the port of Erie, the present facilities for conducting the same are insufficient, and additional improvements in the bay thereof are required:

And whereas, The corporate authorities of said borough of Erie are desirous of making such improvements, but are prevented from so doing by the fact that the title to that portion of the shore and bay of Presq' isle, opposite the said borough, and within its jurisdictional

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That Right and claim the right, title and claim of the commonwealth, of, in and to all that to certain tract of certain piece or tract of land, lying and being on and along the southern land transferred shore of the bay of Presq' isle, and extending into the said bay, inand vested in the cluded within the boundaries hereinafter recited, viz beginning at the burgess and town council of the north-east corner of in-lot in the borough of Erie, aforesaid, numbered with the numbers three thousand two hundred and seventy-eight; running thence in an eastwardly direction, in a line with the northern line of said in-lot number three thousand two hundred and seventy-eight, until it intersects the line of the south breakwater; extended thence in a straight line along the eastern side of said south break water to the north side of the angle of the south channel pier and south breakwater; thence southwardly in a straight line terminating at the north-east corner of the present canal basin pier, being the north-east corner of water lot number fifty nine; thence eastwardly in a line parallel with Second street, in said borough, to Parade street; extended thence along the west side of Parade street, to the place of beginning, be and the same is hereby transferred to, and vested in the burgess and town council of the borough of Erie, in the county of Erie, and their successors in office, reserving any rights, privileges or grants heretofore made by the commonwealth, of or out of any or all of the lands included within the bounds aforesaid; hereby giving and granting full power and authority to the said burgess and town council, and their successors in office, to improve the same in such manner as they may see fit to accomplish the purposes aforesaid, and to sell or otherwise dispose of the same according to their best judgment and discretion, so as to advance the commercial and other business interests of the said borough of Erie.

SECTION 2. The qualified voters of the East and West wards of the borough of Erie shall annually elect, at the time of holding their borough elections, two auditors in each ward; and it shall be the duty of the auditors so elected, any three of whom, duly convened, shall be a quorum, to meet annually on the second Monday in April, and oftener if necessary, and audit, adjust and settle the accounts of the burgess and town council of the borough of Erie, and the accounts of the school directors of said borough: Provided, That the said burgess and town council, and said school directors, or the accounting officers shall have the same right of appeal as is by law allowed from the settlement of township auditors.

SECTION 3. That the qualified voters of the township of M'Kean, in the county of Erie, shall hereafter hold their general and township elections at the house now occupied by Jonathan Burlingham, at M'Kean's Corner.

AN ACT

To regulate and grade the footways in the Upper ward, Germantown, and relative to the Strattonville and Freeport turnpike road company.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That the road commissioners elected in the Upper ward, Germantown, under the provisions of the act of March twenty-four, one thousand eight hundred and forty-eight, are hereby authorized to regulate and grade the authorized to side walks of the Upper ward, Germantown, from the nine mile stone, regulate and on the Germantown and Perkiomen turnpike road, down to the lane, grade side walks. known as Kerper's lane; and the said road commissioners are hereby invested with all the authority, and subjected to all the penalties provided for by the act of April fifth, one thousand eight hundred and thirty-four: Provided, That nothing in this act shall be so construed Proviso. as to interfere with the rights and privileges now enjoyed by the collector of tolls on the said Germantown and Perkiomen turnpike road. SECTION 2. AN ACT

Appointing commissioners to run and mark the division line between Lycoming and Tioga, and Blair and Cambria counties, and relative to fixing the corner of Indiana, Cambria and Clearfield, Berks and Schuylkill counties.

SECTION 1. Be it enacted by the Senate and House of Representa tives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same. That Commissioners. A. H. M'Henry and John Piatt of Lycoming county, and William Bache of Tioga county, or a majority of them, be and they are hereby appointed commissioners, whose duty it shall be to correctly run and distinctly mark the boundary line or lines, between the said counties of Lycoming and Tioga, agreeably to the provisions of the acts of assembly, defining the boundaries of said counties; and the said commissioners shall make two drafts of said division line, one of which shall be filed in the commissioners' office of each of the counties aforesaid; and they shall be authorized to employ such chain carriers, marPay of commis- kers and assistants, as may be deemed necessary; and the said commissioners shall receive two dollars and fifty cents per day, for each and every day they may be necessarily employed in running and marking the said boundary line, and the chain carriers, markers and assistants, shall receive one dollar per day, one-half of which expenses shall be paid out of the treasury of each of the aforesaid counties: Provided, That the said commissioners shall perform the duties enjoined by this act, on or before the first day of January next, and the report of said commissioners shall be final and conclusive.

VickCommissioners. roy of Cambria county, be and they are hereby appointed commissioners, whose duty it shall be to correctly run aud distinctly mark the boundary line or lines between, between the counties of Blair and Cambria, agreeably to the acts of assembly defining the boundaries of said Drafts to be filed, counties; and the said commissioners shall make out two drafts of said division line, one of which shall be filed in the commissioners' office, in each of the counties aforesaid; and they shall be authorized to employ such chain carriers, markers and assistants, as may be deemed necessary; and the said commissioners shall each receive three dollars per day, for each and every day they may be necessarily employed in running and marking the said boundary line, and the chain carriers, markers and assistants, shall each receive one dollar, one per day, one half of which expenses shall be paid out of the treasury of each of the aforesaid counties: Provided, That the said commissioners shall perform the duties enjoined by this act, on or before the first day of January next, and the report of said commissioners shall be final and conclusive; and the fourth section of an act relative to the Wills hospital, for the relief of the indigent blind, and for other purposes, passed the eleventh day of April, one thousand eight hundred and forty-eight, be and the same is hereby repealed.

SECTION 3. That the county commissioners of the counties of Indiana, Cambria and Clearfield are hereby authorized and required to appoint three commissioners, (artists) one from each county aforesaid,

whose duty it shall be to fix and determine the corner between the counties aforesaid; and when they shall have ascertained by a careful. survey of the county lines, and the old purchase line contiguous to said corner, at the junction of said lines, they shall then suitably mark the site for said corner, and also plainly mark the said lines contiguous to said site; and the county commissioners aforesaid shall cause to be erected on said site, a permanent fixture, which shall hereafter be known and regarded as the proper corner of said counties.

SECTION 4. That the said commissioners appointed as aforesaid, Said commissionshall make out four separate copies of their report, together with plots, ers to make out signed by them or a majority of them, one of which they shall trans- report, with mit to the commissioners of each of said counties, and one to the sur- plots. veyor general of this commonwealth, to be filed in their respective offices for public examination and inspection.

SECTION 5. That the said commissioners appointed as aforesaid, Pay of said comshall be allowed for their services two dollars per day, and the axe-men missioners. and chain-bearers, one dollar per day, for each and every day by them necessarily spent, which, together with all the other necessary expenses in carrying out the provisions of this act, shall be equally paid by the aforesaid counties respectively, by an order drawn on their respective treasuries by the county commissioners aforesaid: Provided, That said survey shall not be so construed as to prejudice, or in any way to effect the boundary lines of any tracts of land bounded on either of said lines.

SECTION 6. That a part of the county line between Schuylkill and County line beBerks, shall hereafter be as follows, to wit: beginning at a pine tree, tween Schuylkill a corner in the present county line, on the top of the Blue mountain, and Berks. and corner of old Brunswick township, in Schuylkill county, and Albany township, in Berks county; thence south degrees west in a straight line to the spring, at the old dug road, now the Centre turnpike, about one and a half miles below Port Clinton, known to be the corner dividing the counties of Schuylkill and Berks.
