SECTION 7. Dividends of so much of the profits of the company as shall appear to the directors advisable, shall be declared twice a year and paid to the stockholders, or their legal representatives, on demand, at any time after the expiration of ten days after having been so declared; but such dividends shall in no case exceed the amount of net profits actually acquired by said company, so that the capital stock shall never thereby be impaired; if the directors shall make any dividend which shall impair the capital stock of said company, the directors consenting thereto shall be liable, in their individual capacities, to the said company for the amount of capital stock so divided; and each director present, when such dividend shall be made, shall be adjudged as consenting thereto, unless he forthwith enter his protest on the minutes of the board, and give public notice to the stockholders of the declaring of such dividend; and when such dividends shall exceed eight per cent. per annum, the said company shall pay a tax of six per cent. on such dividend into the treasury of the state.

SECTION 8. This act shall continue and be in force for the term of twenty-five years from the passage thereof; but the legislature may at any time amend or repeal any of the foregoing provisions, or rescind the privileges hereby granted, upon failure of the corporation to comply with any or every part of this act, or when its provisions shall be found injurious to the citizens of this commonwealth.

SECTION 9. If said company shall not commence their railroad or and completion of railroads within three years, and complete the same within ten years from the date of the passage of this act, this act shall become null and

AN ACT

To authorize the auditor general to examine the claim of Green, Dorsey and Company, for materials furnished on the Juniata division of the Pennsylvania canal.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That the auditor general be and is hereby authorized to examine the claim of Green, Dorsey and Company, of Huntingdon county, on account of

materials furnished on the Juniata division of the Pennsylvania canal, in the year Anno Domini one thousand eight hundred and thirty-eight, and make report to the legislature.

AN ACT

Erecting parts of Saville and Juniata townships, in the county of Perry, into a separate election district, to be called Perry election district, and to fix the places of holding elections in Stuartson township, Potter county, and in Pine township, Crawford county.

Boundaries.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That those parts of Saville and Juniata townships, in the county of Perry. embraced within the following boundaries, shall hereafter constitute a separate election district, to be called Perry election district, as follows: Perry election beginning at a point on the Madison township line, five and one-half district. rods from a fallen pine, near the great road; thence by Jacob Fuller north fifty-eight degrees east two hundred and forty rods to a spruce near the mouth of a small stream, at the Great Western bend of Buffalo creek; thence down said creek by the courses and distances thereof to the Juniata township line; thence by said line one hundred and seventyfour rods to the summit of Raccoon ridge; thence by the general course of said ridge (passing two rods south of the index boards opposite James H. Devor) to a point on land of said James H. Devor; thence north forty-five degrees west to a white oak, near the dwelling house of said Devor; thence by land of G. R. Robis north fifty-one degrees west sixty-seven rods to a white oak, again north forty-five degrees west to the Juniata county line; thence along said line (on Tuscarora mountain) to the Madison township line; thence by the same to the place of beginning; and that the qualified electors thereof shall hold their general and township elections at the school house in the town of Ickesburg, and that Jonathan Swartz is hereby appointed judge, and Jacob Shuman and John Peck, inspectors, to hold the first election after the passage of this act: Provided, Said election be held on Friday, the thirtieth Proviso. day of March, Anno Domini one thousand eight hundred and forty-nine; and the constable of Saville township, in said county, is hereby required to give the usual notice of said election, as required in other townships.

SECTION 2. That hereafter the qualified voters of Stuartson township, in the county of Potter, shall hold their general election at the house of John S. Clark, in said township.

SECTION 3. That the qualified electors of Pine township, Crawford Crawford county. county, shall hold their township and general election at the school house in the village of Linesville, in the aforesaid township.

AN ACT

To confer on Mary Smeck, late Mary Boyer, of Berks county, the rights and privileges of a child born in lawful wedlock.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That Mary Smeck, late Mary Boyer, of the county of Berks, shall have and enjoy all the rights and privileges of a child born in lawful wedlock, and shall be able and capable in law to inherit and transmit any estate whatsoever, as fully and effectually as if she had been born in lawful wedlock.

To confer on Martha Irvin and William Irvin, the privileges of persons born in lawful wedlock.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That Martha Irvin and William Irvin, children of John Irvin and Eliza Irvin, of Curwensville, Clearfield county, Pennsylvania, shall have and enjoy all the rights and privileges of persons born in lawful wedlock, and shall be able and capable in law to inherit and transmit any estate or property whatsoever, as fully and effectually as if they had been born in lawful wedlock.

AN ACT

To extend to the Delaware County institute of science, the provisions of the act, entitled "An Act to prevent the disturbance of meetings held for the purpose of religious worship," passed April second, one thousand eight hundred and twenty-two.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That the provisions of the act, entitled "An Act to prevent the disturbance of meetings held for the purpose of religious worship," passed the second day of April, one thousand eight hundred and twenty-two, and the supplement thereto, passed April fifteenth, one thousand eight hundred and thirty-five, be and the same are hereby extended to the several meetings of the Delaware County institute of science, so far as the same are applicable to the meetings of that institution; and no store or licensed tavern, within the distance of one mile of said place of meeting, shall

be permitted to sell any intoxicating drinks during the time of holding the annual exhibitions of said institution.

or piece of ground

AN ACT

To authorize the sale of certain real estate in the county of Philadelphia.

Be it enacted by the Senate and House of Representatives the Commonwealth of Pennsylvania in General Assembly me and it is hereby enacted by the authority of the same, Th the guardians for the relief and employment of the poor of the city Philadelphia, the district of Southwark, and the townships of t Northern Liberties and Penn, shall have full power and they are here authorized to sell and convey, with or without a reservation of re from time to time, as they may deem most advantageous for the publ that certain lot or piece of ground, situate on the south side of Tidmar street, as formerly laid out and extending from Eleventh to Twel street, in the township of Moyamensing, in the county of Philadelph being the same premises which John Lownes and others, by de dated the fifteenth day of November, one thousand eight hundred twenty-one, conveyed to the guardians in fee, or any part or parts said lot, and to execute under the seal of the said corporation, s conveyances and assurances in law, from time to time, as may necessary to carry such sales into complete effect; and such sales: conveyances shall vest the title to the said estate in the purchaser purchasers, fully and absolutely, according to the terms and conditi of the sale; and whenever any rent shall be reserved upon any s sale, it shall and may be lawful for the said guardians to sell, relea convey, assign, and transfer the said rent, at such times, and in s manner, as they may deem most advantageous to the public.
