CAP. LXIII.

An Act to confirm the legality of debentures issued under
By-Law No. 49 of the Municipality of Emerson, in the
Province of Manitoba, as confirmed by 45 Vic., cap. 43.

[Assented to 7th July, 1883.]

Whereas the council of the municipality of Emerson did Preamble. pass a by-law bearing date the 25th day of May, A.D. 1882, to authorize the issue of debentures of the said municipality, to the amount of fifty thousand dollars, to be applied to and for the purpose of making permanent drainage improvements within the said municipality, which by-law is numbered among the by-laws of the said municipality as No. 49.

And whereas, the Act of the Legislative Assembly of the Province of Manitoba, passed in the session held in the 45th year of the reign of Her Majesty Queen Victoria, cap. 43, was passed to legalize the said By-Law No. 49 and the debentures issued and to be issued thereunder, and doubts have arisen as to whether the said Act legalizes such debentures without a further vote of the electors being taken thereon;

And whereas, the debentures hereinafter mentioned have been issued under the said by-law since the passage of the said Act;

And whereas, it is proper to remove the said doubts, and to legalize and render valid the said by-law and the said debentures issued thereunder;

Therefore Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Manitoba,

1. That notwithstanding anything contained in the Act in By law 49 dethe preamble to this Act mentioned, By-Law No. 49 of the and debenmunicipality of Emerson, in the said Act mentioned is hereby thereunder declared legal, valid and binding upon the said council and binding on municipality, and each and every of the said debentures of the said municipality of Emerson issued thereunder, bearing date the sixteenth day of November, A.D. 1882, and numbered from one (1) to one hundred and two (102) both inclusive, for one hundred pounds sterling each, and one debenture for seventyfour pounds eight shillings and six and three-quarter pence sterling, payable on the first day of December, 1902, with interest at 7 per cent., payable yearly on the first day of December in each year, together with each and every coupon for the said interest to each such debentures attached, are hereby

made and declared to be legal and valid and binding upon the municipality aforesaid, without any further vote of the electors of the said municipality, or any other Act, matter or thing being requisite or necessary for the validity of the same, and the legality of the said by-law and debentures shall not be questioned in any suit or action brought in respect thereof for any cause, matter or thing whatsoever.

CAP. LXIV.

An Act to amend the several Acts of incorporation of the city of Winnipeg, and to legalize certain by-laws of the city of Winnipeg and the debentures issued thereunder.

[Assented to 7th July, 1883.]

Whereas the Mayor and Council of the city of Winnipeg have by their petition prayed that the Act of incorporation of the said city be further amended;

And whereas, it is expedient to grant the prayer of said petition;

And whereas, the mayor and council of the city of Winnipeg have passed the following by-laws: By-Law No. 199, intituled, A by-law to authorize the issue of debentures for the sum of eighty thousand and three hundred dollars for the purpose of purchasing certain bridges over or across the Assiniboine river within the city of Winnipeg; By-Law No. 212, intituled, A by-law to authorize the issue of debentures to raise the sum of five thousand pounds sterling, to expend in improvements as required by sub-section seven and eight of section number one hundred and sixty-five of the consolidated Act of incorporation of the city of Winnipeg; By-Law No. 148 to authorize the issue of debentures granting by way of bonus to the Canadian Pacific Railway Company the sum of two hundred thousand dollars in consideration of several undertakings on the part of such company; and By-law No. 195 amending By-law No. 148 and extending the line for the completion of the undertakings expressed in By-law No. 148 by the Canadian Pacific Railway Company.

And whereas, it is deemed expedient to set at rest all doubts that may exist as to the validity of any or all the above in part recited by-laws and the debentures issued thereunder, and to legalize and confirm the same, and each of them respectively.

Therefore, Her Majesty, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

1. That section four of the Act passed in the 45th year of Sec. 4 of 45 Her Majesty's reign, cap. 36, be and the same is hereby re- repealed and pealed and the following substituted therefor, to take effect new sec. subfrom and after the time provided for the next ensuing annual election of aldermen for the city of Winnipeg:

"From time to time and in the manner hereinafter mentioned, there shall be elected one suitable person who shall be and shall be called the mayor of the city of Winnipeg, and two other suitable persons for each ward, who shall be and be called aldermen of the city of Winnipeg, and such mayor and aldermen shall form the council of the said city and shall be designated as such, and shall represent under such title the corporation of the said city for all purposes.'

WARD NO. 1.

Commencing in the centre of the Red River, where the cen- No. 1. tre of the Assiniboine River intersects it, thence westerly along the centre of the Assiniboine River to its intersection with the parish line between St. Boniface and St. Charles, thence along the said parish boundary southerly to the twomile limit of lots lying on the south side of the Assiniboine River, thence easterly along the south side of the road allowance on the two-mile limit of the Assiniboine lots to its intersection with the west side of the road allowance on the twomile limit of lots bordering on the Red River, thence southerly along the west side of the last mentioned road allowance to its intersection with the line between lots 13 and 17 of the parish of St. Boniface, thence easterly along the last mentioned line to the divisional line between lots 13 and 16, thence southerly along the last mentioned divisional line to the centre of the Red River and thence following the centre of the Red River to the place of beginning.

WARD NO. 2.

Commencing in the centre of the Red River, where the No. 2. centre line of Water street would strike if produced easterly thereto, thence westerly along the centre of Water street to the centre of Main street, thence northerly along the centre of Main street to its intersection with the centre of Queen street, thence westerly along the centre of Queen street to its intersection with the centre of Notre Dame street west, thence

westerly along the centre of Notre Dame street west to the centre of Boundary street, thence southerly along the centre of Boundary street produced to the centre of the Assiniboine River, thence easterly following the centre of the Assiniboine and Red Rivers to the place of beginning.

WARD NO. 3.

Commencing at the centre of the Assiniboine River, where the centre line of Boundary street would intersect, if produced southerly thereto, thence northerly along the centre of Boundary street to the centre of Notre Dame street west; thence westerly, following the centre of Notre Dame street west to the western limit of the city, thence southerly following the westerly limit of the city to the centre of the Assiniboine River, thence easterly along the centre of the Assiniboine River to the place of beginning.

WARD NO. 4.

Commencing in the centre of the Red River where the centre of Alexander street would strike if produced easterly thereto, thence westerly along the centre of Alexander street produced to the city limits, thence southerly following the western limits of the city to its intersection with the centre of Notre Dame street west, thence easterly along the centre of Notre Dame street west to the centre of Queen street, thence easterly along the centre of Queen street to the centre of Main street; thence southerly along the centre of Main street to the centre of Water street, thence easterly along the centre of Water street produced to the centre of Red River, thence northerly along the centre of Red River to the place of beginning.

WARD NO. 5.

Commencing in the centre of the Red River, where the centre of Burrows avenue would strike if produced easterly thereto, thence westerly along the centre of Burrows avenue produced to the western limit of the city, thence southerly along the western limit of the city to its intersection with the centre of Alexander street produced; thence along the centre of Alexander street produced, easterly to the centre of the Red River and thence along the centre of the Red River to the place of beginning.

Commencing at a point in the centre of the Red River where the line between lots two and three of the parish of Kildonan would strike if produced easterly thereto, thence west

erly along the said line between lots 2 and 3 to the north-east corner of section 24, township 11, range 2 east of the principal meridian, thence westerly along the north side of the road allowance to a point opposite the north-west corner of the north-east quarter of section 24 of the beforementioned township and range, thence southerly along the western line of the aforesaid quarter section to the south-west corner thereof, and thence in the same direction along the east line of the southwest quarter of the same section to its intersection with the centre of Burrows Avenue produced, thence easterly along the centre of Burrows Avenue produced to the centre of the Red River, and thence along the centre of the Red River to the place of beginning.

4.
