AN ACT

To incorporate the trustees of the Presbyterian board of publication.

WHEREAS, The general assembly of the Presbyterian church in the United States of America, have a board of publication, composed of ministers and laymen of the Presbyterian church, the design of which is the publication of such works, permanent or periodical, as are adapted to promote sound learning and true religion :"

And whereas, The aforesaid board of publication labors under serious disadvantages as to receiving donations and bequests, and as to the management of funds entrusted to them for the purposes designated in their constitution, and in accordance with the benevolent intentions of those from whom such bequests and donations are received; therefore,

Preamble.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That Matthew Newkirk, James N. Dickson, William S. Martien, James B. Incorporators. Ross, Archibald M'Intyre, Joseph B. Mitchell, Alexander W. Mitchell, M. D., Robert Soutter, junior, and James Dunlap, citizens of the United States and of this commonwealth, and their successors, are hereby constituted and declared to be a body politic and corporate, which shall henceforth be known by the name of "The trustees of the Presbyterian Name. board of publication," and as such shall have perpetual succession, and Privileges. be able to sue and be sued in all courts of record and elsewhere, and to purchase and receive, take and hold, to them and their successors, forever, lands, tenements, hereditaments, goods, money and chattels, and all kinds of estate which may be devised or bequeathed, or given to them, and the same to sell, alien, demise and convey; also, to make a common seal, and the same to alter and renew at their pleasure; and also to make such rules, by-laws and ordinances as may be needful for the government of the said corporation, and not inconsistent with the constitution and laws of the United States and of this state: Provided Proviso. always, That the clear yearly income of the real estate held by the said corporation, shall not, at any time, exceed the sum of five thousand dollars.

SECTION 2. The trustees above named, shall hold their offices for one Election of trusyear from the date of this incorporation, and until their successors are tees. duly qualified to take their places, who shall be chosen by the aforesaid board of publication, at such times and in such manner as shall be provided by the said general assembly of the Presbyterian church in the

United States of America: Provided, Not more than one-third of the Proviso. trustees shall be removed in any one year.

SECTION 3. The trustees hereby incorporated, and their successors, Trustees subject shall, subject to the direction of the said board of publication, have full to direction of power to manage the funds and property committed to their care, in such board.

AN ACT

For the reimbursement of money expended by certain citizens in the repair of the aqueduct over the Allegheny river, at the city of Pittsburg.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That before the aqueduct over the Allegheny river, opposite the city of Pittsburg, shall revert to the commonwealth, the mayor, aldermen and citizens of Pittsburg shall, after being reimbursed for rebuilding and repairing the same, as provided for in the act, entitled "An Act authorizing the mayor, aldermen and citizens of Pittsburg to rebuild or repair the aqueduct over the Allegheny river, at said city," and the supplement thereto, approved one thousand eight hundred and forty-four, retain possession of the same, and continue to collect the tolls provided for in said act, until the sum of two thousand two hundred and fifty dollars, with interest thereon from this date, which interest shall be paid annually by the treasurer of said city, out of the tolls received, shall have been collected; and they shall pay the said sum, when collected, into the state treasury, to be drawn out upon the warrant of the auditor general, in favor of such persons as he shall be satisfied expended their money in the repair of the said aqueduct, in the year one thousand eight hundred and forty-three, while the same was in the possession of the commonwealth.

AN ACT

Authorizing George Grey Leiper and William Logan Fisher, trustees of Dr. Samuel Betton and Mary F., his wife, to mortgage certain real estate.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That George Gray Leiper and William Logan Fisher, trustees of Dr. Samuel Betton and Mary F.. his wife, of Germantown, in the county of Philadelphia, under a deed dated the ninth day of June, Anno Domini one thousand eight hundred and twenty-five, recorded in the office for recording of deeds, &c., for the city and county of Philadelphia, in deed book GWR, number eight, page sixty three, &c., on the said ninth day of June, be and they are hereby authorized to borrow a sum not exceeding three thousand dollars, and to secure the payment of the same, to execute, as trustees a bond and mortgage of any or all the real estate conveyed to them in trust by said deed; and to pay over the sum so borrowed, to the said Dr. Samuel Betton and Mary F., his wife, for their use, without any liability of the lender thereof to see to the due application of the money so to be borrowed.

AN ACT

For the relief of Thomas B. Lytle.

SECTION 1. Be it enacted by the Senate and House of Representalives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That the canal commissioners be and they are hereby authorized and required to re-examine the claim for damages alleged to have been sustained by Thomas B. Lytle, of Lancaster county, by fire from the burning barn of Robert M'Ellvain, which was set on fire by a spark from the locomotive of the state, on the Philadelphia and Columbia railroad, and

from thence communicated to the barn of the said Thomas Lytle; and if, in their opinion, there is evidence to show that damages have been sustained by the claimant, for which the state is justly liable, they are required to report the same to the next legislature, specifying the amount. AN ACT

To authorize W. F. Boone, guardian of Peter F. Stout, minor child of Thomas M. Stout, late of the city of Philadelphia, deceased, to sell and convey certain real estate.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That William F. Boone, guardian of Peter F. Stout, a minor child of Thomas M. Stout, late of the city of Philadelphia, deceased, is hereby authorized and empowered to sell, either at public or private sale, and to convey to the purchaser or purchasers in fee simple, all the right, title, in terest and claim of the said minor, Peter F. Stout, of, in and to a certain messuage or messuages and lot of ground, situate in the city of Philadelphia, bounded on the north by Dock street, on the east by Second street, on the south by property late of John Flowers, de eased, and on the west by property of John Upton, being one hundred feet on Dock street, and sixteen feet on Second street, be the same more or less, being the same property which descended from Peter Stout and Frances, his wife, the grandfather and grandmother of the said minor, to the said Thomas M. Stout, and from him to the said minor, Peter F. Stout: Provided, That the proceeds of the sale of the said property shall be re-invested by the said guardian in other real estate, which the said guardian is hereby authorized to purchase, for the use and benefit of said minor, so that the said minor shall have the same title and interest in the real estate so purchased, in regard to the widow's dower, as he now has in the above described property: Provided nevertheless, That before the said guardian shall execute a deed for the above mentioned premises, to the purchaser or purchasers thereof, he shall give bond, with such security as the orphans' court of the city and county of Philadelphia shall direct, conditioned for the faithful discharge of his duty, and for the proper appropriation of the proceeds arising from the sale of said property: And provided further, That the sale and purchase of the aforementioned real estate, shall be returned to, and shall

be subject to the approval of the orphans' court of the city and county

of Philadelphia.

AN ACT

To extend the limits of the borough of Brookville.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That from and after the passage of this act, the limits of the borough of Brookville, in Jefferson county, are so extended as to include the whole of the survey in name of Timothy Pickering and company, number three hundred and ninety-four, being the same survey within which the borough of Brookville is located; and the jurisdiction of the officers and school directors of said borough, are hereby extended to the outer lines of said survey.
