Lay out a state road from M'Elroy's in West

moreland county, to Kuhn's in Armstrong county.

AN ACT

To authorize the laying out of a state road from a point on the Greensburg and Freeport road, in Westmoreland county, to the farm of David Kuhns, in Armstrong county, and in relation to a state road in Chester county, and the collection of certain taxes on unseated lands.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly mel, and it is hereby enacted by the authority of the same, That John F. M'Cullough and William Ross, of Westmoreland county, and John Turney, of Armstrong county, be and they are hereby appointed commissioners to view and lay out a state road from a point on the road leading from Greensburg to Freeport, at or near the farm of John M'Elroy, in Allegheny township, Westmoreland county, to a point on the Pennsylvania canal, at or near the farm of David Kuhns, in Armstrong county, by the nearest and best route, marking the same plainly and distinctly upon the ground.

SECTION 2. The said commissioners after taking and subscribing an Duty of commis- oath or affirmation before some justice of the peace to perform the duties enjoined on them by this act with fidelity and impartiality, shall proceed to view the ground and lay out the road as near to a straight line, between said points, as the nature of the ground will permit, so that the vertical departure from a horizontal line shall at no point exceed five degrees, except at crossing ravines and streams, where by a moderate excavation, filling or bridging, the declination of said road may be preserved within that limit.

SECTION 3. The said commissioners shall meet on or before the first Time of meeting. day of September next, and proceed to complete the view of said road; and they are hereby authorized to employ one surveyor, at a per diem not exceeding two dollars, two chain bearers and one axeman at a per diem of one dollar each; and the said commissioners shall each receive a per diem not exceeding one dollar and fifty cents for each day necessarily spent in the discharge of the duties enjoined by this act; and the accounts of the said commissioners, for their own pay and the pay of the surveyor, chain bearers and axeman, shall be paid by the commissioners of the counties of Armstrong and Westmoreland, by warrants

SECTION 4. It shall be the duty of the said commissioners to make

SECTION 5. SECTION 6. That Richard M. A FURTHER SUPPLEMENT

To the charter of the borough of York, and borough of New Castle and Waynesboro'.

SECTION 1. Be it enacted by the Senate and House of Representa tives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That Relative to paving all the provisions contained in the charter of the borough of York, and footways in Cen- its supplements, concerning the pavements or footways on the streets of said borough, are hereby extended to the pavements and footways on the centre square thereof, with the like effect, and to all intents and purposes, as if the same were hereby vacated and re-enacted in detail.

SECTION 2. That wherever the width of the pavements or footways on High or George streets, in said borough, shall be increased to sixways and gutters. teen feet, then one foot of the sixteen next to the street or wagon way shall be constructed, according to the directions of the regulators, and under the control of the burgesses, as part of the gutter between such footways and the street, to carry off the water from the same; and the burgesses and assistant burgesses of said borough, shall have the same power and authority to require and compel the construction, renewal and repair of the gutters, as they now have in regard to the pavements and footways in said borough: Provided, That by no increase of the width of the pavements or footways, shall the width of the street or wagon way be reduced to less than eighteen feet between the market houses and the corners of High street and the Centre square.

SECTION 3. That wherever such an increase as aforesaid of the width of the pavements or footways shall be made, there the porches, cellar doors and steps, may be extended one foot beyond the present limits.

SECTION 4. That from and after the passage of this act, the seventh, eighth, ninth and tenth sections of an act, approved the eleventh day of April, Anno Domini eighteen hundred and forty, relating to the grading of streets, and paving and repairing of side walks, in the borough of Norristown, Montgomery county, be and the same is hereby extended to the borough of New Castle, Mercer county, and the officers and town council of said borough of New Castle shall have all the powers conferred on the officers of the borough of Norristown, by said sections, as fully as if the said sections had been originally passed for said borough of New Castle.

SECTION 5. That the provisions of the first section of an act, entitled Franklin county, "An Act authorizing the burgess and town council of the boroughs of to provide a lock- Johnstown and Blairsville, in the counties of Cambria and Indiana, to up house. provide lock-up houses," approved the thirteenth day of February, eighteen hundred and forty-six, be and the same are hereby extended to

AN ACT

Relating to the tax on dogs in certain townships in the county of Chester.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That

from and after the passage of this act, the provisions of the first, To levy a tax on second, third, fourth, fifth and seventh sections of an act, entitled "An dogs in certain Act laying a tax on dogs in the borough of West Chester, and certain townships. townships in the county of Chester, and for other purposes," approved the fourteenth day of April, one thousand eight hundred and forty-six, be and the same are hereby extended to the townships of East Caln, West Bradford, Kennett and East Fallowfield, in the said county of Chester.

SECTION 2. Be it enacted by the Senate and House of Representa tives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That the provisions of the act, entitled "An Act supplementary to the acts relating to hawkers and pedlers, and regulating auctions in the county of Schuylkill," approved the seventeenth day of April, one thousand eight hundred and forty-six, be and the same are hereby extended to the counties of Lebanon and Elk, Cumberland and Perry, Carbon and Berks, and also to the county of Fayette, with reference to carrying from place to place, and exposing to sale articles of tin and copper ware. AN ACT

To erect part of Norwegian township, in Schuylkill county, into a new township, to be called East Norwegian township, and for other purposes.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That East Norwegian So much of the township of Norwegian, in the county of Schuylkill, township erected. as is now embraced in the general election district, whose electors vote at the town of Port Carbon, be and the same is hereby established and erected into a new township, to be called the township of East Norwegian.
