CAP. XXX. open AN ACT to appropriate certain sums of money therein-mentioned, for (22d March, 1825.) Preamble, MOST GRACIOUS SOVEREIGN, W THEREAS it is expedient to appropriate a certain sum of Money towards exploring the intermediate Country, and tracing a Road between the last settlements in the Township of Frampton, in the County of Dorchester and the River Saint John, and for opening a Road from Coteau du Lac to the line separating this Province from Upper-Canada; May it therefore please Your Majesty that it may be enacted, and be it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Assembly of the Province of Lower-Canada, constituted and assembled by virtue of and under the authority of an Act passed in the Parliament of Great-Britain, intituled, "An Act to repeal certain parts of an Act passed in the fourteenth year "of His Majesty's Reign, intituled, "An Act for making more effectual pro"vision for the Government of the Province of Quebec, in North America," and "to make further provision for the Government of the said Province;" And it is hereby enacted by the authority of the same, that from and after the passing of this Act, it shall be lawful for the Governor, Lieutenant-Governor, or Person administering the Government of the Province, for the time being, by a Warfor exploring rant or Warrants under his hand, to cause to be advanced and paid out of any unappropriated monies that now are or hereafter may come into the hands of the Receiver-General of the Province, for the time being, a sum not exceeding eighty the River St. pounds, currency, for exploring the intermediate Country, and tracing a Road £80 granted the country, and tracing a road from Frampton to John. between the last Settlements in the Township of Frampton in the County of Dorchester and the River Saint John, and for making Plans and Reports thereof, to be laid before the Legislature which Plans and Reports shall be laid before the Legislature within fifteen days after the opening of the ensuing Session, thereof by the person whom it shall please the Governor, Lieutenant-Governor, or Person administering the Government of the Province for the time being, to appoint for the purposes of this Act. Provided always and be it further enacted by the authority aforesaid, that no part of the said sum of five hundred pounds shall be employed nor expended until by a Procès Verbal of the Grand Voyer, or his Deputy, duly homobeen homolo- logated at law, the said Road have been traced and established upon such line as may not be submerged by the rising of waters, and the maintaining and repairing thereof, by the persons thereunto held by law have been provided for, by such gated. And be it further enacted by the authority aforesaid, that there shall for appoint Com- the said Road between Coteau du Lac and the said Province line be appointed by the Governor, Lieutenant-Governor, or Person administering the Government of the Province for the time being, six Commissioners three of whom shall exclusively be authorized to enter into Contracts, with good and sufficient security for the performance thereof, for opening and making the said road, notice by them having been previously given of the works and improvements intended to be made upon such road as required by an Act passed in the fifty-seventh year of the Reign of His Majesty George the Third, intituled, " An Act to make more ef"fectual provision for the improvement of the internal Communications of this Province," and the three other Commissioners shall be experts for the purpose of surveying and reporting upon such works from time to time during the progress of the same, as after the completion thereof, and whose certificate that such works and improvements have been well and faithfully done and performed according to Contract, shall be necessary and requisite before the Contractor or Contractors shall be entitled to a Warrant or Warrants, for the full amount of his, or their Contract or Contracts. Provided always, that during such works and improvements a sum not exceeding in all one half of the whole amount of the Contract, may be advanced to the Contractor or Contractors, by a Warrant or Warrants in his or their favor, upon their obtaining a Certificate or Certificates from such experts, that the works or improvements contracted for are in progress, and likely to be completed according to contract. Pourvû toujours, et qu'il soit de plus statué par l'autorité susdite, qu'au- Aucune partie cune partie de la dite somme de cinq cens livres ne sera employée ni dépensée de l'Argeni ne jusqu'à ce que, par un Procès Verbal du Grand-Voyer ou de son Député dûment avant que le homologué en Loi, le dit Chemin ait été tracé et établi sur une ligne qui ne puisse être submergée par la crue des eaux, et qu'il ait été pourvû par tel Procès Verbal à l'entretien et réparation d'icelui par les personnes qui, par la Loi, peuvent y être tenues. IV. Et qu'il soit de plus statué parl'autorité susdite, que pour le dit Chemin entre le Côteau du Lac et la ligne qui sépare cette Province du Haut-Canada, il sera nommé par le Gouverneur, Lieutenant-Gouverneur ou la Personne ayant alors l'Administration du Gouvernement de la Province, six Commissaires dont trois seront exclusivement autorisés à contracter, en prenant bonnes et suffisantes cautions pour la vraie et fidèle exécution d'iceux pour les travaux et les améliorations à faire sur le chemin pour lequel tels Commissaires auront été nommés, avis ayant été préalablement donné des travaux et améliorations proposés tel que requis par un Acte passé dans la cinquante septième Année du Règne de Sa Majesté, George Trois, intitulé, "Acte pour pourvoir plus efficacement à améliorer les Communications Inté"rieures dans la Province," et les trois autres Commissaires seront Experts pour examiner les dits Travaux et améliorations, et faire rapport sur iceux de tems à autre durant le Cours d'iceux, ainsi qu'après qu'ils seront complêtés, et leur Certificat déclarant que tels Travaux et améliorations ont été bien et fidèlement faits suivant le Contrat, sera nécessaire et requis avant que ceux qui auront contracté aient droit à un Warrant ou à des Warrants pour le montant entier de leur Contrat. Pourvû toujours, que durant le cours de tels Travaux et améliorations une somme n'excédant point en tout la moitié du montant du Contrat pourra être avancée à ceux qui auront contracté par un Warrant ou des Warrants en leur faveur, sur un Certificat ou des Certificats de tels Experts, déclarant que les travaux ou améliorations pour lesquels il a été contracté, sont avancés, et qu'il y a probabilité qu'ils seront complêtés. WHE HEREAS it is expedient to appropriate a sum of Money for the improvement of the Kennebec and Craig Roads; May it therefore please Your Majesty that it may be enacted, and be it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Assembly of the Province of Lower-Canada, constituted and assembled by virtue of and under the authority of an Act passed in the Parliament of Great-Britain, intituled, " An Act to repeal certain parts of an Act passed in "the fourteenth year of His Majesty's Reign, intituled, "An Act for making more effectual provision for the Government of the Province of Quebec, in "North America," and to make further provision for the Government of the £800 granted said Province;" and it is hereby enacted by the authority of the same, that for making the road between from and after the passing of this act, it shall be lawful for the Governor, Lieutenant-Governor or person administering the Government of the Province for the time being, by a Warrant or Warrants under his hand, to cause to be adwith the Pro vanced and paid out of any unappropriated monies that now are, or that hereafter may come into the hands of the Receiver-General of the Province for the time being, a sum not exceeding eight hundred pounds, currency, for making and repairing the Road connecting the last and uppermost settlements on the River Chaudière with the Province line towards the River Kennebec, and a furThree Rivers. ther sum not exceeding four hundred pounds, currency, for repairing the part of the uppermost vince line towards the Kennebec river, and £400 more for re pairing Craig Road in the District of Craig Road within the District of Three Rivers.
