pervisor forthwith to proceed and advertise the said swine for sale, giving at least five days notice, by advertisements, in writing, set up in at least three of the public places in said township, of the time and place of selling the same, and the same being sold at public vendue or outcry, the said constable or supervisor shall make return thereof to the said justice, within two days after the sale, as aforesaid; and the said jus tice shall forthwith make division of the proceeds of the sale, to be applied in manner as aforesaid: Provided, That the said person so taking up said swine, shall, before he makes his complaint as aforesaid to the justice as aforesaid, notify the owner or owners of said swine to the end that the said owner or owners may disprove the complainants allegation of the said swine being so found at large, if such be the fact.

SECT. 2. And be it further enacted by the authority aforesaid, That from and after the first day of June'next ensuing the publication hereof, it shall be lawful for any person within the said county of M'Kean, receiving damage by swine, forthwith to acquaint a justice of the peace of the fact, who shall, on request made by the party aggrieved, issue his order to two discreet and disinterested inhabitants of the township where the said trespass or damage is supposed to be done, whose duty it shall be to go and view the fences where any damages are supposed to have been done, and if they find upon view of the same, the fences to be sufficient, and agreeable to the laws of this commonwealth, then and in such case they are to appraise and ascertain the damages done, and make return of the same to the said justice of the peace, who, on notice given to the owner or owners of said swine is hereby empowered to award judgment and execution, as the case may require, and the said swine so taken trespassing or doing damage as aforesaid, shall be liable to be taken up and impounded by the party aggrieved, subject to being sold towards paying the damages aforesaid, the overplus, if any, being returned to the owner or owners thereof.

SECT. 3. And be it further enacted by the authority aforesaid, That from and after the passage of this act, it shall not be lawful for such owners of swine as now or hereafter may reside within the limits of the town plot of Smethport, ning at large in said county, to suffer such swine to run at large, under in Smethport may be for the penalty of forfeiting the same, to be disposed of in such manner as is provided by the first section of this act, any thing in the said first section to the contrary notwithstanding.

AN ACT

To confer on Horatio Nelson Beaumont, Andrew Jackson Beaumont, Sarah Ann Beaumont, Louisa Beaumont, George Harrison Beaumont John Addison Beaumont, and William M. Beaumont, the rights and benefits of children born in lawful wedlock.

WHEREAS, John Beaumont, of Solebury township, Bucks Preamble. county, hath represented to the Legislature, that, previously to his marriage with Elizabeth Arnwine, he had by her seven children, to wit: Horatio Nelson Beaumont, Andrew Jackson Beaumont, Sarah Ann Beaumont, Louisa Beaumont, George Harrison Beaumont, John Addison Beaumont, and William M. Beaumont; and he hath prayed the Legislature to confer on the said children, born before his said marriage, the rights and benefits belonging to legitimate issue.

SECT. 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That the State Treasurer be, and he is hereby authorized and required to pay to Peter Myers, of York county, a soldier of the revolutionary war, or to his order, the sum of forty dollars immediately, and an annuity of forty dollars, payable half yearly, during life, to commence on the first day of January, one thousand eight hundred and thirty-three.

AN ACT

To prevent obstructions being placed on turnpike roads.

SECT. 1.
