RESOLUTION

Relative to calculating interest upon mortgages in the Land Office.

Resolved by the Senate and House of Representatives of the Commonwealth of Pennsylvania, in General Assembly met,

That in calculating the amount due on mortgages to the Com- Mortgages monwealth, executed prior to the twenty-fifth day of January, prior to 25th one thousand eight hundred and sixteen, the Secretary of Jan. 1816. the Land Office shall make the same allowances and deductions, and make the calculation in the same way as if the mortgage had been executed subsequent to the said twenty. fifth of January, one thousand eight hundred and sixteen.

Relative to the estate of John De Pui.

Relative to the disposal of water power at Milton, Northumberland county.

Resolved by the Senate and House of Representatives of the Commonwealth of Pennsylvania, in General Assembly met, Authority to That the canal commissioners be and they are hereby aucomm'rs. to thorized to contract with George Eckert of Milton, Northum contract with berland county, for the use of such supply of water of the Geo. Eckert. West Branch canal, for his mills, as he may want upon

such terms as shall be equitable and just; Provided, The same can be spared without any injury to the public works.

RESOLUTION

Relative to the Peninsula at the Bay of Presque Isle, on lake Erie.

WHEREAS, it has been represented to the Legislature, that much damage has been done and is doing to the peninsula Preamble. at the bay of Presque Isle, on lake Erie, by cutting timber growing thereon, and by digging up and by setting fire to the shrubbery growing thereon, whereby the permanency of the said peninsula and the safety of the public works and of the harbor are endangered; Therefore,

Resolved by the Senate and House of Representatives of the Commonwealth of Pennsylvania, in General Assembly met, That Rufus S. Reed, of the borough of Erie, be and he is Rufus S.Reed hereby authorized and required, for the period of five years, charged with care of state to take charge of the aforesaid peninsula on behalf of this Commonwealth, and to prevent any persons from trespassing thereon by cutting timber thereon, or by digging shrubbery of any kind thereon, or by setting fire thereto, or by any other act inconsistent with or repugnant to the rights of this Commonwealth, and any person or persons so trespassing and doing damage, shall be liable to be indicted therefor in the court of Quarter Sessions of the county of Erie, and to be fined and imprisoned for each and every offence, by a fine not exceeding five hundred dollars, and an imprisonment Offenders to not exceeding six months, and shall be subject to pay to the be subject to said commissioner, for the use of the Commonwealth, three times the value of the property taken or destroyed, and the property taken by any trespasser in the hands of such trespasser, or in the hands of any purchaser from or under him, shall be liable to be replevied for the use of this Commonwealth, and the said commissioner shall be allowed all expenses which he shall actually and necessarily incur in the executing of this resolution, and to a reasonable daily pay, not exceeding one dollar and fifty cents, for the time by him actually and necessarily employed therein, towards the pay. Pay, &c. of ment whereof, the fines and forfeitures collected from persons trespassing as aforesaid, or so much thereof as may be necessary, shall be applied, and the balance, if any, remitted to the State Treasurer, and if such fines and forfeitures shall prove sufficient for such expenses and compensation, the said commissioner shall draw his warrant on the State Treasurer for such amount as may be reasonably due to him, as afore. Proviso. said: Provided, That such account shall be rendered to the Accounts to State Treasurer on oath, and shall be audited and allowed under oath, by the Auditor General before any such warrant shall be &c.

RESOLUTION

For the relief of John Kelker, late Deputy Marshal of the Eastern District of Pennsylvania, and for the relief of Jacob Heck, late Brigade Inspector, second brigade, eleventh division, Pennsylvania militia.

WHEREAS, a judgment was lately obtained in a Circuit Court for the county of Dauphin, at the suit of the Commonwealth, against John Kelker, late deputy marshal for the eastern district of Pennsylvania, for certain fines which had been collected from delinquents in said county, for non-performance of militia duty, during the late war with Great Britain; And whereas, in the settlement of the accounts of the said deputy marshal, he did not receive a credit for certain services rendered under his appointment, for which it seems reasonable he should be allowed, (amounting to a sum equal to or greater than the judgment so obtained:) And whereas, claims for similar services have been allowed by sundry acts of the Legislature to Peter Aurand and John Kendall, late deputy marshals for the county of Berks, and to Isaac Griffith, late deputy marshal for the county of Bucks: Therefore,

Resolved by the Senate and House of Representatives of the Commonwealth of Pennsylvania, in General Assembly met, That the said John Kelker, late deputy marshal of the eastern district of Pennsylvania, be, and he is hereby released and discharged from the payment of the said judgment so entered and remaining unsatisfied against him, in the suit aforesaid, and that the lands and goods of the said John Kelker shall from and after the adoption of this resolution be exonerated from any execution or executions which has or have been, or may be issued for the recovery of the said judgment: Provi

ded, That nothing in this resolution shall prevent or inter- Provise. fere with the recovery from the said John Kelker of all the Costs, &c. not costs, charges, and expenses which may have accrued in the included. prosecution of said suit, and the proceedings shall not be stayed until the said costs and charges shall be fully paid and satisfied.

RESOLUTION

how to be

Relative to the payment of interest on the first of August next. Resolved by the Senate and House of Representatives of the Commonwealth of Pennsylvania, in General Assembly met, That if there should be any deficiency in the fund for the Deficiency, payment of interest, on the first day of August next, the commissioners of the internal improvement fund are hereby authorized to supply such deficiency out of any moneys that may be in their hands, which sum or sums are to be repaid out of the funds pledged for the payment of interest.

Resolved, by the authority aforesaid, That it shall be the Supervisors duty of the supervisors of the highways, elected for the year of Somerset, one thousand eight hundred and thirty-three, for the town- Washington ship of Somerset, in the county of Washington, to collect, co-authorized to pay certain and they are hereby authorized and required to collect and balance to G, over, out of the road tax of the present year, unto Greer M'Ilvain.
