AN ACT

Declaring that part of Pine Creek, in Potter county, from the Forks above Big Elk Lick, to the Forks above William Ellsworth's, on said creek, a public highway.

SECT. 1. Be it enacted by the Senate and House of Repre sentatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That from and after the passage of this act, that part of Pine creek, in Potter county, from the first forks above Big Elk Lick, on said creek, to the forks above William Ellsworth's, on said creek, be and the same is hereby declared a public highway, for the passage of rafts, boats, and other craft; and it shall and may be lawful for the inhabitants desirous of using the navigation of said creek, to remove all natural and artificial obstructions from the bed or Removal of obstructions. channel of said creek, except damns for mills and other wa ter works, and also to erect such slopes at the mills or other dams in said creek, as may be necessary for the passage of rafts, boats, or other vessels: Provided, Such slopes be so Proviso. constructed as not to injure the works of such dams: And Of the slopes. provided also, That any person or persons owning or pos sessing lands on said creek, shall have liberty to construct any dam or dams across the same, agreeably and subject to all the restrictions and provisions of an act of the General Liberty to Assembly of this commonwealth, passed the twenty-third erect dame, day of March one thousand eight hundred and three, enti- &c. tled "An act to authorize any person or persons owning lands adjoining navigable streams of water, declared public highways, to erect dams upon such streams for mills, other water works."

AN ACT

Authorizing the inhabitants of North Sewickly township, Beaver county, to elect threc supervisors of the roads in said township.

SECT 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania, in General Assembly met, and it is hereby enacted by the authority of the same, That from and after the passage of this act it shall and may be lawful for the electors in North Sewickly township, Beaver county, to elect annually at their usual place of electing township officers, three qualified citizens for supervisors of the roads, subject to the same rules and regulations by which supervisors are by law regulated.

To enable the Governor to incorporate the Willardsburg turnpike road

company.

SECT. 1. Be it enacted by the Senate and House of Represen tatives of the Commonwealth of Pennsylvania, in General As sembly met, and it is hereby enacted by the authority of the same, That William Willard, junior, Elijah Depuy, and A. C. proper, if such enlargement shall be found necessary to fulfil the intentions of this act, and of purchasing, taking and holding to them and their successors and assigns, and of selling, transferring and conveying in fee simple, or for any lesser estate, all such lands, tenements, hereditaments and estate, real and personal, as shall be necessary to them in the prosecution of their works, and of suing and being sued, and of doing all and every other matter and thing which a corporation or body politic may lawfully do: Provided, That nothing contained in this act shall be construed to authorize the said corporation to issue notes in the nature of bank notes, or to endorse notes in their corporate capacity, or to make discounts, or to receive deposits after the manner of any bank or banks, and in case the said company shall at any time violate the provisions of this section, all and every their chartered privileges shall cease and determine.

SECT. S. And be it further enacted by the authority aforesaid, That the said commissioners, or a majority of them. appointed, not less than ten days from the publication of the first notice, at which time and place the subscribers shall proceed to organize the said corporation, and shall elect, by President, a majority of votes of the said subscribers, one president, 7 managers, seven managers, one treasurer, and such other officers as treasurer, &c they shall think necessary, to conduct the affairs of the said company, until the third Monday of December then next enOf the annual suing, on which day, and annually thereafter on said day, the said company shall hold their elections for officers; and the said company, when so organized, shall have power to make such by-laws, rules and regulations, not inconsistent with the constitution and laws of the United States, or of the constitution and laws of this state, as shall be necessary for the well ordering the affairs of said company, and to procure for said company a common seal, and the same to break, alter or renew, as often as the said company shall think proper: Provided, The said subscribers may vote by ballot, to be delivered in person, or by proxy duly authorized; but Ratio of votes no person shall have more than ten votes in his own right, at any election for officers, or determining any question which may arise at any meeting of the said company, whatever number of shares he or she may be entitled to, and that each person shall be entitled to one vote for every share by him or her held under that number.
