AN ACT

To incorporate the Philadelphia and Fall's Bridge Turnpike Road company.

SECT. 1. Be it enacted by the Senate and House of Repre sentatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That for the purpose of making a turnpike road according to the courses hereafter mentioned, the following

named persons are hereby appointed commissioners: Richard Peters, Samuel Breck, John J. Borie, Ellis Yarnall, William Meredith, Edward Coleman, John Britton and George Rundle, to do and perform the several things hereinafter mentioned, that is to say: they shall, on or before the first day of May next, procure one or more books, and in each of them enter as follows: We, whose names are hereunto subscribed, do promise to pay unto the president and managers of the Philadelphia and Falls bridge turnpike, road company, the sum of fifty. dollars for every share of said stock in said company set opposite to our respective names, in such manner and proportion, and at such times, as shall be determined by the president and managers of said company, it being understood that the following shall be, and they hereby are, established by law the principal points in said road: to commence at the intersection of the Lancaster turnpike, near the Permanent bridge, and opposite to the Blockley post-office; thence along the river road, keeping the bed of the present township road or otherwise, according to circumstances, up to Hardings tavern; thence as near the river as practicable, so as to avoid the ice and water freshets, or interference with the works of the Schuylkill Navigation company up to the Falls bridge, a distance of three miles, be it more or less; but in case the ground, or any other cir cumstance, should make it inexpedient to commence the said road near the Permanent bridge as aforesaid, then it shall be lawful to start from Hughes' tavern, about half a mile west of said bridge, and at the point where the Mantua road intersects the said Lancaster turnpike; thence through the village of Mantua along the road that leads from said turnpike down to the farm of Ellis Yarnall, and thence as near the river as may be consistent with the safety of the road in regard to ice and other freshets, and the security of the towing path of the Schuylkill Navigation company, to the Falls bridge aforesaid; having procured the books aforesaid, it shall be the duty of the president and managers to give notice, in one or more of the newspapers printed in Philadel phia, for one calendar month at least, of the times and places when and where the said books shall be kept open to receive subscriptions for the said stock of said company, at which respective times and places some one or more of the said commissioners shall attend, and permit and suffer all persons of lawful age, who shall offer, to subscribe in said books, in their own name, or in the names of other persons who shall duly authorize the same, for any number of shares in said stock; and the said books shall be kept open for the purpose aforesaid, at least six hours in every juridical day for the space of three days, if necessary, or until the said books Of the whole shall have five hundred shares subscribed, with which subscription it shall be lawful to commence said road; but should

the amount of that subscription be too small to complete the road, the number of shares to constitute the capital stock of this road may be extended to seven hundred shares; the subscription to said additional number shall be made in form and manner similar to that directed by this act, for taking the five hundred shares aforesaid; if, at the expiration of the three days aforesaid, during which the books are directed to be kept open, the number of five hundred shares shall not have been subscribed, the said commissioners shall adjourn from time to time, until the whole number of shares shall be subscribed, of which adjournment the said commissioners shall give such public notice as the occasion may require, and this mode of proceeding shall apply in like manner to the taking of the two hundred additional shares authorized by this act as aforesaid, in case the president and managers deem it proper thus to extend the capital stock of the said company; every person offering to subscribe in said books, in his own or any other name, he or she shall previously pay to the attending commissioners the sum of five dollars for every share to be subscribed, out of which shall be defrayed 85 to be the expenses attending the taking of such subscriptions and paid upon other incidental charges, and the remainder shall be paid time of sub. over to the treasurer of the said company, as soon as the scribing. same shall be organized, and the officers chosen, as hereinafter mentioned.

SECT. 3. And be it further enacted by the authority aforeOf the organ- said, That the commissioners aforesaid, as soon as conveniently may be after said letters patent shall be sealed and obcorporation. tained shall give notice in the public papers aforesaid, of the time and place by them to be appointed, not less than thirty days from the publication of the first notice, at which time and place, the said subscribers shall proceed to organize the said corporation, and shall choose by a majority of votes of the said subscribers by ballot, to be delivered in person or by proxy, duly authorized, one president and five managers, three whereof shall form a quorum when assembled for busitreasurer, &c. ness; one treasurer and such other officers as they shall think necessary to conduct the business of the said company, for one year, and until such other officers shall be chosen, and the said managers so chosen and their successors shall and may make such by-laws, rules, orders and regulations not inconsistent with the constitution and laws of this state or of the United States, as shall be necessary for the well ordering of the affairs of said company, and generally have like powers, authority and privileges necessary for carrying on and completing the said turnpike road, and be subject to all the duties, qualifications, restrictions, penalties, fines and forfeitures, and be entitled to like tolls and profits in proportion to the distance as are given and granted to the president, managers and company of the Strasburg and Fannetsthe Strasburg burg turnpike road company, by an act passed the twenty first of January, one thousand eight hundred and nineteen, except that the said company, shall be entitled to receive and collect tolls whenever they shall have perfected the said road for one mile and a half, and each successive section of one mile, and except also, that the said turnpike road shall not be less than thirty-three feet, or more than sixty feet wide, twenty feet of which at least shall be made of stone: Provided, That if the said company, shall not proceed to carry on the said work in four years after the passing of this act, or shall not within ten years afterwards complete the said road according to the true intent and meaning of this act, then in either of these cases, it shall and may be lawful for the Legislature of this commonwealth, to resume all and singular the rights, privileges, liberties and franchises by this act granted to the said company.

To authorize the Governor to incorporate a company to erect a toll bridge over Redbank creek, at or near where the road from Bedford to Franklin crosses said creek, in the county of Armstrong.

SECT. 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That James E. Browen, Archibald Dickey, jr. Fred- Stock com. erick Cristman, David Lawson, Alexander Duncan, Sydle missioners Lobaugh, George Means, Thomas Pollok, James Parker, appointed. Charles Evans, Samuel C.
