No. 118.

AN ACT

To authorize the sale of real estate.

SECT. 1. Be it enacted by the Senate and House of Repre sentatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That David Loy, of the county of Bedford, be, and he is hereby authorized to sell and convey all the interests of Elizabeth Stineman, Mary Stineman, and Nancy Stineman, minor children of Christian Stineman, in the undivided half part or moiety of six tracts of land, situate in Venango county, and that he shall have full power and authority to execute a deed or deeds in fee simple to the purchaser or purchasers for the same: Provided, That before the receipt of the purSurety to Or- chase money or any part thereof, the said David Loy shall phans court. first give bond with security to the Commonwealth of Penn

amount of purchase money, conditioned for the faithful ap-
plication of the purchase money, for the maintenance and
education of the minor children aforesaid, and the payment
of the residue, if any, to them or any person or persons au-
thorized to receive the same, on attaining their majority,
which said bond and security shall be approved by the Or-
phan's Court of Venango county, and the said bond shall be
deposited among the records of said court.

SECT. 2. And be it further enacted by the authority aforesaid, That Christiana Bowser, administratrix, and George Estate of M. Augustus Meeker, administrator of the estate of Mathias Bowser, Arm Bowser, deceased, late of the county of Armstrong in this Commonwealth, be, and they are hereby authorized and empowered to sell and convey the one undivided half part or moiety of five certain tracts of land situate in Venango county, in the Commonwealth aforesaid, of which the said Mathias Bowser, deceased, in his life time, was seized and possessed in fee: Provided, That the said Christiana Bowser, adminisSurety to Or. tratrix, and George Augustus Meeker, administrator as aforephans court. said, before they proceed to convey the said land shall enter into recognizance with sufficient security before the Orphan's Court of the county of Venango, conditioned for the faithful application of the proceeds of sale of said real estate, to the use of the heirs and legal representatives of the said Mathias Bowser, deceased, and for the payment of debts due by said estate, agreeably to the existing laws of this Commonwealth.

Estate of R. last will and testament of Richard McCall, late of the M'Call, Phila. city of Philadelphia, deceased, be, and he is hereby authorized and empowered to sell and convey, in fee simple or otherwise, the one third part of a certain lot of ground situate on Hudson's lane, in the district of Moyamensing and county of Philadelphia, and devised by the third clause of the will of the said Richard McCall, to the said Thomas Cadwalader in trust for certain purposes therein mentioned, and the deed or deeds of conveyance therefor executed by the said Thomas Cadwalader to the purchaser or purchasers, his or their heirs and assigns, shall be deemed and taken to pass and convey the said third part of the said lot of ground in the same manner, and to have the same effect as it this power to sell and convey the same had been given to him by the Application will of the said testator, the proceeds of the said sale to be of proceeds, held by the said trustee, in the same manner, and for the same persons and purposes, and with the same discretion as if the same had continued real estate: Provided, That the Approval of said sale shall be reported to, and approved by the Orphan's Court of the county of Philadelphia.

AN ACT

To improve the state road leading from the top of the Allegheny mountain, at the White Horse Tavern in Somerset county, to Connelsville, in Fayette county.

SECT. 1. A SUPPLEMENT

To an act entitled "An act to confer on certain associations of the citizens of this Commonwealth, the powers and immunities of corporations, or bodies politic in law," passed the sixth day of April, one thousand seven hundred and ninety-one.

SECT. 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania, in General Assembly met, and it is hereby enacted by the authority of the Provisions of same, That the provisions of the act to which this is a suporiginal act plement, be, and they are hereby extended to beneficial societies and associations, and to fire engine and hose compa

SECT. 2. And be it further enacted by the authority afore said, That the limitation contained in the proviso to the fourth Limitation in section of the act to which this is a supplement, be, and the proviso to 4th same is hereby repealed; and from and after the passage of section of original law this act, the corporations established by virtue of the act to repealed. which this is a supplement, and all such as may hereafter be established by virtue of the said act and the present supple. ment, and the successors thereof, respectively, shall be able and capable in law, according to the terms and conditions of the instrument upon which the said corporations respectively are as aforesaid formed and established, to take, receive, and hold all and all manner of lands, tenements, rents, annuities, franchises and hereditaments, and any sum and sums of money, and any manner and portion of goods and chattels given and bequeathed unto them respectively, to be employed and disposed of according to the objects, articles, and conditions of the instrument upon which said corporations respectively are as aforesaid formed and established, or according to the articles and by-laws of the said corporations respectively, or of the will and intention of the doners: Provided always nevertheless, That the clear yearly value or income of the real and personal estate held by the said corporations respectively, shall not at any time exceed the sum of two thousand dollars.
