AN ACT

To authorize the canal commissioners to settle and adjust the claims of John Evans, a contractor for the construction of the Swatara aqueduct.

SEOT. 1: Be it enacted by the Senate and House of Repre sentatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That the canal commissioners be and they are hereby directed to settle and adjust the claims of John Evans, a contractor for the construction of the Swatara aqueduct, in such way and manner as to them may appear equitable and just, which said settlement and adjustment shall be final and conclusive; and if any balance is found to be due the said John Evans, the Auditor General is hereby authorized to audit the same, in the way and manner other claims are presented and audited.

AN ACT

To annul the marriage contract of Jehu Hatfield and Harriet his wife.

SECT. 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That the marriage contract entered into by and between Jehu Hatfield and Harriet his wife, be and the same is hereby made void, and the parties released and discharged from the said contract, and from all duties and obligations arising therefrom, as fully, effectually and absolutely, as if they had never been joined in marriage.

To authorize Jacob Kern, administrator of the estate of George Palmer, deceased, to sell and convey certain real estate.

SECT. 1. Be it enacted by the Senate and House of Repre sentatives of the Commonwealth of Pennsylvania, in General Assembly met, and it is hereby enacted by the authority of the same, That Jacob Kern, administrator of the goods and Unimproved chattels, rights and credits of George Palmer, late of the lands." -county of Northampton, deceased, be, and he is hereby authorized to sell and convey all the unimproved lands of which the said George Palmer died seized and possessed, at public or private sale, as the said Jacob Kern shall deem most conducive to the interests of the heirs of said George Palmer, deceased, and to make and execute good and sufficient deeds to the purchasers, as well for the lands sold previous to the passage of this act, as well as for those to be sold in pursu

SECT. 1. Be it enacted by the Senate and House of Repre sentatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That from and after the passage of this act, Cheat river, from the mouth thereof, and up the said stream as far Virginia line. as the Virginia state line, be, and the same is hereby declared a public highway.

AN ACT

To authorize the Governor to incorporate the president, managers and company, of the Redbank and Clarion turnpike road company, in Armstrong county.

SECT. 1. Be it enacted by the Senate and House of Repre sentatives of the Commonwealth of Pennsylvania, in General Assembly met, and it is hereby enacted by the authority of the same, That Richard Reynolds, William Cull, George Means, Comm'rs apJohn M. Rankin, James Waterson, Alexander M'Cain, pointed to Matthew Howsey, Charles Evans, John M'Gee, James Pot- open books, ter, Philip Clover, John C. Corbet, John Cribbs, William &c. ers shall attend and permit and suffer all persons of law ful age, who shall offer to subscribe in the said book, in their own name or in the name of any other person, who shall duly authorize the same for any number of shares of the said stock, and the said book shall be kept open respectively, for the purpose aforesaid, for at least six hours in every juridical day, for the space of three days, and until the said book so opened shall have one hundred shares therein subscribed and if at the expiration of the said three days, the book aforesaid shall not have the number of shares aforesaid therein subscribed, the said commissioners respectively may adjourn from time to time, and transfer the books from place to place, until the whole number of shares shall be subscribed, of which adjournment and transfer the said commissioners shall give such notice as the occasion may require.

SECT. 2. And be it further enacted by the authority aforesaid, That whenever ten or more persons shall have subscribed fifty shares or more of said stock, the commissioners shall certify under their hands and seals, the names of the subscribers and the number of shares subscribed by each, to the Governor, and thereupon, it shall and may be lawful for the Governor, by letters patent, under his hand and the seal of the state, to create and erect the subscribers, and if the said subscription be not full at the time, then also those who shall afterwards subscribe to the number aforesaid into one body corporate and politic, by the name, style and title, of the president, managers and company of the Redbank and Clarion turnpike road, by the said name, the said subscribers shall have perpetual succession and all the privileges and franchises incident to a corporation, and shall be capable of taking and holding their said capital stock, the incrcase and profits thereof, and of enlarging the same from time to time, by new subscriptions in such manner and form & liabilities. as they shall think proper, if such enlargement shall be found necessary to fulfil the intent and meaning of this act, and of purchasing, taking and holding to them and their successors and assigns, and of selling, transferring and conveying in fee simple, or for any less estate, all such lands, tenements, hereditaments and estates, real and personal, as shall be necessary to them in the prosecution of their works, of suing and being sued, and doing all and every other matter or thing which a corporation or body politic may lawfully do.
