SEC. 15. It shall be unlawful for any person, under the penalties provided in section fourteen of this act, to kill or capture in any of the lakes, rivers or streams in this State, or any of their tributaries, more than fifty fish of any of the kinds hereinbefore mentioned in any one day, or to take with him therefrom or to have in his possession at any point away therefrom more than one hundred fish of said kinds at any one time. This act is ordered to take immediate effect. Approved April 29, 1903.

AN ACT to make appropriations for the State Public School for the fiscal years ending June thirtieth, nineteen hundred four, and June thirtieth, nineteen hundred five, and to provide a tax to meet the same.

The People of the State of Michigan enact:

SECTION 1. There is hereby appropriated for the current expenses of the State Public School, for the fiscal year ending June thirtieth, nineteen hundred four, the sum of thirty-five thousand dollars, and for the fiscal year ending June thirtieth, nineteen hundred five, the sum of thirty-five thousand dollars. SEC. 2. The further sum of seventeen thousand five hundred dollars is hereby appropriated by amounts and purposes as follows: Nine thousand four hundred dollars for general repairs and painting; one thousand dollars for a greenhouse; five hundred dollars for a hot water supply; four hundred sixtyseven dollars and ninety-seven cents to extend the electric light system, and one thousand thirty-two dollars and three cents to pay the deficit on putting in the electric light plant under public act one hundred thirty-nine of the year nineteen hundred one; one thousand two hundred dollars for a grain barn; seven hundred dollars for wire fencing on farm; four hundred dollars for under-draining and other improvements on cemetery; five hundred dollars for an ice house; one thousand dollars for bedding and other furniture for the cottages; and one thousand three hundred dollars for furniture and carpets for employees' Proviso as to and guests' rooms: Provided, That if the amount designated in this section for any one of the purposes stated be insufficient to complete the work or purchases, any surplus remaining after the completion of the other work or purchases specified in this section, may by obtaining the consent of the State Board of Corrections and Charities and Auditor General in writing before any expense in excess of the specific appropriation is incurred, be used in the account or accounts where such deficiency seems unavoidable, the intent of this proviso being, to make the entire seventeen thousand five hundred dollars available for

the purposes stated herein, if in the judgment of the State Board of Corrections and Charities and Auditor General it is deemed advisable to make the transfers for which provision is hereby made: Provided further, That the board of control of Proviso as to said school may obtain money under this section before July obtain. first, nineteen hundred three, in such amounts as they may, by requisition, certify to the Auditor General are necessary for immediate use, which amounts thus advanced shall be deducted from the total amount appropriated, when the appropriation becomes available.

SEC. 3. The several sums appropriated by the provisions of How paid. this act shall be paid out of the general fund in the State treasury, to the treasurer of the State Public School, at such times and in such amounts as the general accounting laws of the state prescribe, and the disbursing officer shall render his accounts to the Auditor General thereunder.

SEC. 4. The Auditor General shall incorporate in the state tax for the year nineteen hundred three, the sum of fifty-two rated in state thousand five hundred dollars, and for the year nineteen hundred four the sum of thirty-five thousand dollars, which, when collected shall be credited to the general fund to reimburse the same for the moneys hereby appropriated.

AN ACT to amend sections four, five, fourteen, twenty-one, twenty-four, twenty-five and twenty-six of act number eighty-seven of the Session Laws of eighteen hundred fiftyfive, entitled "An act relative to burying grounds," approved February twelfth, eighteen hundred fifty-five, being sections eight thousand three hundred sixty-five, eight thousand three hundred sixty-six, eight thousand three hundred seventy-five, eight thousand three hundred eighty-two, eight thousand three hundred eighty-five, eight thousand three hundred eighty-six and eight-thousand three hundred eighty-seven of the Compiled Laws of eighteen hundred ninety-seven.

three hundred eighty-two, eight thousand three hundred eighty-five, eight thousand three hundred eighty-six and eight thousand three hundred eighty-seven of the Compiled Laws of eighteen hundred ninety-seven, are hereby amended so as to read as follows:

SEC. 4. Any member of any corporation organized under this act, wishing to dispose of any right of burial owned by him, shall procure for the purchaser a grant of such right from said corporation; and at the same time such member shall also relinquish to such corporation all claim he may have to such right of burial.

SEC. 5. Any person owning a right of burial in ground controlled by a corporation organized under this act, and having the right to use the same, shall be deemed a member of the corporation, and shall have the right to vote at all corporate meetings, unless in arrears for assessments.

SEC. 14. The president, clerk, treasurer and superintendent of grounds of any corporation organized under this act shall receive such a compensation for their services as shall be allowed by a majority of the members of the corporation present at a corporate meeting, and no more: Provided, That if the members neglect to fix such compensation, the same may be fixed, from time to time, by the board of trustees.

SEC. 21. Whenever it may become necessary to vacate any vacate bury burying ground, the property of any corporation organized under this act, such corporation may, by a majority of its members present at any corporate meeting, direct the president and clerk of such corporation to petition the circuit court for the county in which such burying ground is situated, for leave to vacate the same; and such circuit court may make such order in the premises as shall be just and proper: Provided, No final order shall be made within six months from the time of filing such petition, and without due proof of publication of notice of such petition, for twelve successive weeks, in such newspaper as may have been designated by said court for that purpose.

SEC. 24. A majority of the members of any corporation organized under this act present at any corporate meeting, shall, when they deem it necessary, have power to vote an assessment upon the members of such corporation, which assessment shall be made by the board of trustees of such corporation, as near as may be, in proportion to the value of the respective rights of burial owned by such members.

SEC. 25. After an assessment has been made, as provided for in the next preceding section, such corporation shall cause a record to be made of such assessment, showing the day when the same is made, with a list of the names of all the members of such corporation, and the amount assessed to each member; copy of the assessment shall be furnished by the clerk to the treasurer of such corporation.

SEC. 26. Within one month from the time of making any Clerk to give assessment, the clerk of the corporation making the same, shall cause public notice of the same to be given, in such manner as the board of trustees shall direct, directing each member of such corporation to pay his assessment to the treasurer of such corporation within thirty days from the date of such notice; and such assessment shall be, and hereby is declared, a personal liability against such member and the payment thereof may be enforced by action of debt or assumpsit in the name of such corporation.

Lapeer or Oakland, excepting the river and Lake St. Clair, by seine, drag, pound or gill net, or any other device or means, except by hook and line, fish used or that may be used as bait; and to prescribe penalties for the violation of this act," approved April nineteenth, eighteen hundred ninety-three.

AN ACT
AN ACT for the protection of fish in the lake known as Rush
Lake situated in the Township of Lake, County of Huron,
State of Michigan.

The People of the State of Michigan enact:

SECTION 1. Hereafter it shall not be lawful to catch, kill or take, except destroy fish with seines or any species of continuous net or with any form of spear or trap or in manner whatsoever except with hook and line in the waters of Rush Lake, County of Huron, or in the tributary streams and outlets of said Rush Lake within said Township of Lake.

Penalty for violation.

SEC. 2. Any person violating any of the provisions of section one of this act shall be deemed guilty of a misdemeanor and upon conviction thereof before any court of competent jurisdiction shall be punished by a fine of not to exceed one hundred dollars or imprisonment in the county jail for a period not exceeding ninety days or both such fine and imprisonment in the discretion of the court.

This act is ordered to take immediate effect.
