RULES OF PRACTICE.

RAILROAD COMMISSION OF ALABAMA.

RULES OF PRACTICE.

I. REGULAR SESSIONS.

The regular session of the Commission for hearing contested cases will be held at it office in Montgomery, Alabama, on the first Monday in each month, and continue from day to day thereafter, if necessary, until the business of such meeting is finished. But if the day above designated for such meeting shall at any time fall upon an election day, or legal holiday, then the meeting shall be held upon the day following.

Special sessions for receiving, considering and action upon petitions, applications and communications, or any business of the Commission may be held at any time at the pleasure of the Commission.

II. SPECIAL SESSIONS.

Special sessions may be held at other places, when, in the judgment of the Commission, the public interest requires it.

III. COMPLAINTS AND PETITIONS.

All complaints, applications or petitions must be printed or written (or partly printed and partly written), setting forth succinctly the subject matter of complaint or application and can be either in the form of letter or petition. The name of the carrier against which complaint is made should be stated in full, and the address of the complainant or petitioner, together with the name and address of his attorney, if any, must appear upon the complaint or petition. All complaints or peti

tions must be signed by the complainant, petitioner, or counsel, and addressed to the Commission or any member thereof.

IV. SERVICE OF COMPLAINT OR PETITION.

The Commission will cause a copy of the complaint or petition to be served personally, or by mail, in its discretion, upon each carrier against which relief is sought, with notice to plead to or answer the same within the time specified by the Commission. Before serving notice on the party complained of to appear before the Commission, the Commission may negotiate with the defendant with the view of having the cause of the complaint removed without the expense of a formal hearing.

V. PLEADINGS AND ANSWERS.

A carrier complained against must plead or answer within such time as required by the Commission. The time prescribed in any case may be extended, upon good cause shown, by order of the Commission. All pleadings and answers must be filed with the Clerk of the Commission, at its office in Montgomery. All answers must admit or deny the truth of all material allegations of the complaint or petition and may set forth any additional fact material to the issue. If the carrier complained against shall make satisfaction of, or shall satisfactorily to the complainant or petitioner make adjustment of the demands contained in the complaint or petition before the case is finally disposed of by the Commission he shall obtain from the complainant or petitioner, a written acknowledgement of such satisfaction or adjustment setting forth the terms and conditions of such agreement or adjustment, and file same with the Commission on or before the day set for the hearing.
