with the faid feveral duties and fums of money collected and received by virtue thereof, the faid piers had been rebuilt, finished, and completed, and had been preferved, kept, and continued in good repair; but that nevertheless, for fame years then past, the entrance into the faid port of Whitby had been rendered very narrow and difficult, by reafon of a bank of fand which was then, and for fome time past had been gathering about the head of the weft pier of the faid harbour of Whitby, and would in time, if not prevented, intirely ftop and choak up the fame; and inasmuch as the faid fand-bed, and the further inreafe thereof, in the judgement and understanding of experienced perfons might and could only be remedied and prevented by lengthening and extending the faid weft pier one hundred yards further into the fea; therefore that the faid piers and harbour might be improved, and made as fecure for colliers and coafting veffels as might be, and for lengthening and extending the faid weft pier, it was enacted, That from and after the first day of June, one thousand feven hundred and thirty five, the faid luty of one farthing per chalder, granted by the faid act of the first year of the reign of her faid late majesty Queen Anne, and continued by the faid act of the feventh year of her reign (but which had ceased from the first day of May, one thousand feven hundred and twenty three) should be paid to the trustees nominated and appointed in or by virtue of the faid act of the feventh year of his late Majefty's reign for the term of thirty one years, to commence and be computed from the said first day of June, one thousand feven hundred and thirty five, for the purposes aforesaid; and the faid act of the first year of her faid late Majefty's reign, and all and every the claufes, provifions, penalties, matters, and things therein contained, touching the faid duty of one farthing per chalder thereby granted (fave and except as to the powers and authorities thereby vested in the trustees therein named, and to be named pursuant thereto, and a clause therein contained touching the ceafing of the faid duty on raifing fix thousand pounds, as therein mentioned) were revived and continued for the fame term of thirty one years, with feveral other powers and claufes relating to the faid duty, and work proposed to be done, and the regulating the faid harbour, as by the faid jeveral acts, relation thereunto refpectively being had, may more at large appear: and whereas purfuuant to the faid last-mentioned act of the eighth year of the reign of bis prefent Majefty, and by and with the feveral duties and fums of money collected and received by virtue thereof, and of the other acts aforefaid, the faid weft pier of the faid harbour of Whitby hath been lengthened one hundred yards, and terminated with a strong circular head, whereon is erected a commodious battery, with a firong parapet, and embrazures for five pieces of cannon, which protects the entrance of the faid harbour, as also such ships as may be obliged to take fhelter in the road from an enemy; but for carrying on the faid work, the trustees nominated and appointed in and by virtue of the faid several acts of the feventh year of his late Majefty, and eighth year of his prefent Majefly, have been neceffitated to borrow at times, feveral fums of money on the faid fund of one farthing per chalder, amounting to fix thousand two hundred pounds, which now remains charged thereon; and the faid trustees have employed the rest of theduties granted as afore

faid, as they arofe, in rebuilding and repairing other parts of the faid piers, and in getting up quarries at the mouth of the faid harbour, in order to deepen the channel; which has had fo good an effect, that it has encouraged the inhabitants of Whitby aforefaid, and others, to build in the faid barbour much larger fhips than were formerly used: and whereas the weft and eaft piers have been greatly shaken with the seas; and the marle, or foft rock, on which they were built, is worn away in feveral places, by the great quantity of fand feoured out of the faid harbour, which has occafioned their finking, and the walls thereof to bulge out; and the communication between the town and the west pier is in a great meafure interrupted; and it is abfolutely neceffary for the fecurity of the faid harbour, that the faid parts of the faid east and weft piers fhould be rebuilt, or repaired and raised; and it would be a great improvement of the faid harbour, and tend very much to the advantage and fafety of all colliers and coafting veffels, if the remaining part of the ftone rock at the entrance of the faid harbour was taken away, and the way repaired and made fufficient, from the faid town of Whitby to the faid weft pier, with proper moorings for fhips along the fame; but as the expence of the faid works cannot be provided for without fome additional duty, the faid perpetual fund granted by the faid act of the feventh year of his late Majesty's reign, producing yearly one hundred and forty pounds, or thereabouts; and the faid duty of one farthing per chalder will raife little if any thing more than will pay the principal monies borrowed thereon, and the intereft thereof new due, and which may incur during the remainder of the faid term of thirty one years: to the end therefore that the faid weft and east piers may be rebuilt or repaired and raised where needful, and the remaining part of the ftone rock at the entrance of the faid harbour may be taken away, and the way from the weft pier to the faid town of Whitby may be repaired and made fufficient, and proper moorings for fhips may be placed thereon, as fhall be judged expedient, and the faid harbour may be further improved; may it please your Majefty, that it may be enacted, &c.

An additional duty of one farthing a chalder laid on coals for 31 years. Powers given by the recited act, to be exercised by the trustees with regard to the prefent duty. Trustees may borrow money on the credit of the duties; and contract for the work and materials; and for the purchase of houfes and grounds, for making the way from the weft pier to the town more convenient. Owners refufing to treat, juftices to impanel a jury, who are to affefs the recompence. Upon payment of the money, the lands, &c. to veft in the trustees. The weft and east piers, &c. vefted in the trustees. Perfon to be appointed, who is to direct the moorings, &c. of hips. Veffels belonging to Great Yarmouth exempted from the duties.

T the parliament begun and bolden at Westminster, the tenth day of November, Anno Dom. 1747, in the twenty first year of the reign of our fovereign lord George the Second, by the grace of God, of Great Britain, France, and Ireland, King, defender of the faith, &c. And from thence continued by feveral prorogations to the feventeenth day of January, 1750. being the fourth feffion of this prefent parliament.

CAP. I.

An act for continuing and granting to his Majesty certain duties upon malt, mum, cyder, and perry, for the fervice of the year one thousand feven hundred and fifty one. EXP.

CAP. II.

An act for granting to his Majesty the fum of two millions one hundred thousand pounds, to be raised by annuities and a lottery, and charged on the finking fund, redeemable by parliament.

E your Majesty's most dutiful and loyal subjects, the commons of Great Britain in parliament affembled, being defirous to raise the neceffary fupplies which we have chearfully granted to your Majefty in the easiest manner we are able for the benefit of your fubjects, have freely and voluntarily given and granted, and by this act do give and grant unto your Majefty the fum of two millions one hundred thousand pounds, to be raised in fuch manner and form as is herein after directed; and to that end and purpose do most humbly beseech your Majesty that it may be enacted; and be it enacted by the King's moft excellent majesty, by and with the advice and confent of the lords fpiritual and temporal and commons in this present parliament affembled, and by the authority of the fame, That the annuities which by this act fhall be granted and made payable in refpect of the faid principal fum of two millions one hundred thousand pounds, until redemption thereof by parliament, in manner herein after mentioned, fhall be charged and chargeable upon, and payable out of the monies which shall from time to time arife and be remaining in the receipt of his Majefty's exchequer of or for the furpluffes, exceffes or overplus monies, commonly called the Sinking Fund; and the said furpluffes, exceffes or overplus monies are hereby appropriated for that purpose accordingly,

And for or towards raising the said sum or fums of money Natives or fonot exceeding in the whole the faid fum of two millions one reigners may hundred thousand pounds for the purposes aforefaid, it is here- pay to the by further enacted by the authority aforefaid, That it fhall and of the fouthmay be lawful to and for any perfon or perfons, natives or fo- fea company. reigners, bodies politick or corporate, to contribute, advance and pay unto the first or chief cashier or cafhiers of the governor and company of merchants of Great Britain trading to the South-Seas, and other parts of America, and for encouraging the fishery, commonly called the South-Sea Company, at or before the respective days and times by this act limited in that behalf, any fum or fums of money not exceeding one million four hundred 1,400,000 1. thousand pounds, in part of the faid whole fum of two millions for the purone hundred thousand pounds, for the abfolute purchase of any ities. certain annuity or annuities, to commence from the several and respective times herein after appointed for the payment of the several and respective fums by them fubfcribed or contributed, and to be paid and payable to fuch contributor or contributors, or fuch as he, fhe or they fhall nominate, his, her or their executors, administrators, fucceffors and affigns refpectively, in manner herein after mentioned, fo as such cashier or cashiers do first give security to the good liking of any three or more of the commiffioners of the treafury now being, or the high treasurer, or commiffioners of the treasury for the time being, for duly anfwering and paying into the receipt of his Majefty's exchequer, for the publick ufe, the monies fo to be advanced and contributed, and to account duly for the fame; which annuities before mentioned fhall be computed at the rate of three pounds per an- at the rate of num for every one hundred pounds, and proportionably for any 31. per cent. greater or lefs fum fo to be advanced and paid; and the pur- per ann. chafe-money for every fuch annuity at the rate aforefaid, is here

by appointed to be paid unto the faid cashier or cashiers as afore- Times for faid, at or before the refpective days and times herein after li- payment. mited; that is to fay, ten pounds per centum part thereof by way of depofit, on or before the fifteenth day of March, in the year of our Lord one thousand seven hundred and fifty, fifteen pounds per centum, other part thereof, on or before the fifteenth day of May one thousand seven hundred and fifty-one then next enfuing; fifteen pounds per centum, other part thereof, on or before the feventeenth day of June then next enfuing; twentyfive pounds per centum, other part thereof, on or before the twelfth day of August then next enfuing; ten pounds per centum, other part thereof, on or before the twenty-eighth day of October then next enfuing; ten pounds per centum, other part thereof, on or before the twentieth day of November then next enfuing; and the remaining fifteen pounds per centum, on or before the twentieth day of December then next following; all which annuities fo to be purchafed fhall be paid and payable at two of the most usual feafts or days of payment in the year; that is to fay, the feast of the nativity of Saint John the Baptift, and of the birth of our Lord Chrift, or within fix days after every of the

faid feast days; the first payment thereof to be computed and paid at the rate of three pounds per centum per annum, on the whole fum to be paid by fuch contributors for the purchase of any part of the faid annuities, from the said several and refpective times of paying and advancing the fame as aforefaid, unto the feast of the birth of our Lord Christ, which shall be in the year of our Lord one thousand feven hundred and fifty one, or within fix days after the said feast day: nevertheless the said annuities fhall be redeemable according to the purport and true meaning of a provifo or condition herein after contained in that behalf, and not otherwise; and the faid cashier or cashiers of Cafhier to give the faid governor and company for the time being is or are herereceipt for by authorized and required upon the advancing and paying to each payment, him or them any fuch fum or fums of money as aforefaid, forthwith to give a receipt in writing figned by himself or themselves which fhall be for each payment to the contributor or payer thereof (which reaffignable by ceipts fhall be affignable by indorsement thereupon, made at indorsement, any time before the faid twentieth day of December one thoufand feven hundred and fifty one, and no longer) and, from time to time, to pay into the receipt of his Majefty's exchequer, all the monies which he or they fhall receive of or for the faid fum not exceeding one million four hundred thousand pounds, as fast as he or they fhall receive the fame, or any part thereof, or within five days afterwards at the fartheft; and to account for all the monies so to be advanced and paid to him or them in his Majesty's court of exchequer, according to the due course thereof.

III. And it is hereby enacted, That in the office of the accomptant general of the faid governor and company for the time being, there fhall be provided and kept a book or books, in which there shall be fairly entered the names of all who shall be contributors for fuch annuities, after the rate of three pounds per centum per annum as aforefaid, and of all perfons by whofe hands the faid contributors fhall pay in any of the said fums upon this act, and alfo the fum fo paid; to which book or books it fhall be lawful for the faid refpective contributors, their executors, administrators, fucceffors and affigns, from time to time at all seasonable times to have refort, and to inspect the fame without any fee or charge; and the faid accomptant general for tranfmitted to the time being, fhall on or before the twenty fifth day of March one thousand seven hundred and fifty three, transmit an attested duplicate, fairly written on paper, of the said book or books into the office of the auditor of the receipt of his Majefty's exchequer, there to remain for ever.
