APPEALS.

The rules of the Supreme Court require the Court of Claims to
make findings of fact from the evidence submitted, which.
must be sent up as part of the record on appeal, but there
is no rule requiring exceptions to such evidence to be
made a part of said record on appeal. Gulf Refining Co.,

APPOINTMENT.

ARMY PAY.

I. Where a first lieutenant in a certain battery in the absence
of his captain is assigned in orders issued by competent
authority to command said battery, he exercises such
command by virtue of his seniority and is not entitled
to higher command pay under the act of April 26, 1898,
30 Stat. 365. Lanigan, 50.

II. Where a first lieutenant in one battery is assigned in orders
issued by competent authority to the command of another
battery, he is entitled to higher command pay under the
act of April 26, 1898, supra.

III. Where an officer of the Army has been retired by a retirement
board in a certain rank, and the action of the board has
been approved by the President, the court has no au-
thority to speculate as to what rank he might have
attained if the officer had not been retired. Parker, 75.
IV. The proviso to the act of June 4, 1920, 41 Stat. 761, 762,
repealing laws providing for extra-duty pay, which de-
clared that "nothing in this section shall operate to
reduce the pay which any enlisted man is now receiving."
