A Common Bargain and Sale of Lands.

HIS indenture, made the

THE

in the year of our Lord, &c. between B F. of, &c. of the one part, and C. D. of, &c of the other part, witneffeth, That the faid B. F for and in confideration of the fum of, &c. to him the faid B F in hand well and truly paid, the receipt whereof is hereby acknowledged; he the faid B F. bath granted, bargained and fold, and by thefe prefents oth grant, bargain and fell unto the fud CD. his heirs and affigns, all thofe meffuages &c. and alfo all trees, woods underwoods, tithes, commons and common of palture, ways, water courfes, profits, commodities, advantages, hereditaments and appurtenances whatfoever, to the faid meffuage, &c. above mentioned belonging, or in any wife appertaining: and the reverfion and reverfions, remainder and remainders, rents, iffues, and profits of the faid premifes, and of every part and parcel thereof; and all the eftate, right, title, intereft, claim and demand whatfoever of him the faid B. F. of, in and to the faid meffuages, &c. and premifes and every part thereof. To have and to hold the faid meffuages, &c. and all and fingular other the premises above mentioned, and every part and parcel thereof, with the appurtenances, unto the faid C. D his heirs and affigns, to the only proper use and behoof of the faid C. D. his heirs and affigns forever. And the faid B. F. for himself and his heirs, the faid meffuages, &c. and premifes, and every part thereof against him and his heirs, and against all and every perfon and perfons whatfoever, to the faid C. D. his heirs and affigns, fhall and will warrant and forever defend by these presents. In witness, &c. Signed, Sealed, &c.

OF BILLS OF SALE.

BARGAIN and fale transfers lands and tenements from one perfon to another; but a Bill of Sale only the property of goods. There must always be a valuable confideration where lands are conveyed by bargain and fale;

but a bill of fale of goods and chattels may be made without a valuable confideration, but must have livery and feizin. Bac. br. 17.

A Bill of Sale of Goods.

NOW all men by these prefents, that I, N. F. of, &c. for and in confideration of the fum of, &c. to me in hand paid by C. D. of, &c. at or before the fealing and delivery of thefe prefents, the receipt whereof I the faid N. F. do hereby acknowledge, have granted, bargained and fold, and by these prefents do grant, bargain and fell, unto the faid C. 1. his executors, adminiftrators and affigns, all the goods, houfehold ftuff, implements and furniture, particularly mentioned, expreffed and contained in the fchedule hereunto annexed, (Or thus, herein after particularly mentioned, that is to fay, one beditead) &c. all and fingular which faid premises, are now remaining, ftanding and being in a certain meffuage, or tenement fituate, &c. and now or late in the occupation of the faid N. F. To have and to hold all and fingular the faid goods, houfehold ftuff and furniture, and other the premifes above bargained and fold, or mentioned or intended fo to be, to the faid C. D. his executors, administrators and affigns forever. And I the faid N. F. for myfelf, my heirs, executors and adminiftrators, all and fingular the faid goods, &c. unto the faid C. D. his executors, adminiftrators and affigns against me the faid N. F. my executors and administrators, and against all and every other person and perfons whatfoever, fhall and will warrant and forever defend by these presents. Of all and fingular which faid goods, &c. I the faid N. F. have put the faid C. D. in full poffeffion, by delivering to him the faid C. D. one filver fpoon, at the fealing and delivery of thefe prefents, in the name of the whole premifes hereby bargained and fold, or mentioned or intended fo to be, unto him the faid C. D. as aforefaid.

E. in hand well and truly paid, at or before the fealing and delivery of thefe prefents, the receipt whereof the faid A. E. doth hereby acknowledge, hath granted, bargained and fold, and by thefe prefents doth grant, bargain and fell, unto the faid C. D. his executors, administrators and affigns, one fourth part, the whole into four parts equally to be divided, of all that fhip, or veffel, called, &c. of the burthen of, &c. together with one full fourth part, the whole to be divided as aforefaid, of all the mafts, fails, fail-yards, anchors, cables, ropes, cords, boats, oars, guns, gun-powder, fhot, tackle, apparel, ammunition, and furniture to the faid fhip belonging, or in any wife appertaining: To have and to hold, the faid fourth part of the faid fhip or veffel, and other the premises hereby granted, bargained, and fold, or mentioned, or intended fo to be, unto the faid E. 1). his executors, adminiftrators and affigns forever, as his and their own proper goods, and to and for his and their own proper ufe and ufes forever. And the faid A. E. doth hereby, for himself, his heirs, exe cutors, and adminiftrators, covenant, promife, grant and agree to and with the faid C. D. his executors, adminiftrators and affigns, that the faid A. E. at the time of the fealing and delivery of these prefents, is the true and lawful owner and proprietor of the faid fourth part of the faid thip or veffel, and premises hereby granted, bargained and fold, or mentioned, or intended fo to be, unto the faid C. D. his executors, adminiftrators and affigns, as aforefaid: And that he the faid C.D. at the time of the fealing and delivery hereof, hath in himself full power and good authority in law, to grant, bargain, and fell the faid fourth part of the faid fhip or veffel, and premifes above bargained and fold, or mentioned, or intended fo to be, unto the faid C. D. his executors, administrators, and affigns, in manner aforefaid: And also that it shall and may be lawful to and for the faid C. D. his executors, administra

tors and affigns, from time to time, and at all times hereafter, quietly and peaceably to have, hold. poffefs and enjoy, the faid fourth part of the faid fhip, and all other the premifes hereby granted, or mentioned, or intended fo to be, without the let, trouble, denial, moleftation, hindrance or disturbance whatsoever, of him the faid A. E. his executors, adminiftrators or affigns, or of any other perfon or perfons whatfo, ver, lawfully claiming or to claim by, from or under, him, them, or any of them and that freed and discharged of and from all former and other bargains, fales and incun brances made, done or committed by him the faid E. or any other perfon or perfons, by his order, confent, privity or procurement. K my executors, adminiftrators and affigns, fhall and will difp fe convert and employ the faid the faid voyage, to and for the beft and most advantage to the faid T. S. L.is executors, administrators and affigns, according to the best of my skill and knowledge: And also that I the faid J. K. my executors, adminiftrators or affigns, fhall and will within days next after my return from the faid voyage, or the arrival and difcharge of the faid fhip within the Fort of which fhall first happen, not only give and deliver, or caufe to be delivered, unto the faid T. S. his execu tors, administrators or affigns, a juft and true account of the difpofition and management of the faid adventure; but also well and truly pay and deliver, or caufe to be paid and delivered

unto the faid T. S. his executors, administrators or affigns, all fuch money and proceeds as fhall be due and coming to him the faid T. S. his executors, adminiftrators or affigns, from me the faid J. K. But if the faid fhip be loft, mifcarry, or be caft away in the faid voyage, then no account is to be given by me the faid J. K. for the adventure aforefaid.

OF BILLS AND NOTES FOR THE PAYMENT OF MONEY.

A Penal Bill for Payment of Money.

NOW all men by these prefents, that I, C. E of, &e. do owe unto E. G. of &c. the fum of five hundred dollars, to be paid unto the said E. G. his executors, adminiftrators or affigns, on or before, &c. next enfuing the day of the date hereof; for which payment well and truly to be made, I bind myself, my heirs, executors and administrators, to the faid E. G his executors, adminiftrators or affigns, in the penal fum of one thousand dollars, firmly by thefe prefents. In witness whereof, I have hereunto fet my hand and feal, the, Sc. in the year of, c. Sealed, c.

A Single Bill for the Payment of Money, i. e. a Bill without a Penalty.

NOW all men by these presents, that I, C. B. of, &c. do owe and am indebted to E G. of, &c. two hundred dollars, to be paid to the said E. G. his executors, administrators or affignis, on or before, &c.
