Minutes of Agreement on a Sale of Wheat.

EMORANDUM, It is agreed by and between E. F. of, &c. and G.H. of, &c. that he the faid G. H. in confideration of three hundred quarters of wheat fold to him this day, by the faid E.F. and by him agreed to be delivered to the faid G H. free of all charges and expenses whatsoever, on or before, &c. next, shall and will pay or cause to be paid to the faid E. F. or his affigns within three months after such delivery the sum of, &c. And the faid E. F. in confideration of the agreement aforefaid, of the faid G H. doth ~promise and agree on or before, &c. aforefaid, at his own proper expense, to send in and deliver to the faid G. H. or his afligns the faid three hundred quarters of wheat, fo fold to him as aforefaid, and that he the faid E. F. fhall and will warrant the fame to be good, clean and merchantable grain. In witnefs whereof, the parties above named have hereunto interchangeably fet heir hands, &c. in the year, &c.

·Minutes of Agreement between a Housekeeper and bis Lodger.

EMORANDUM, It is agreed by and between E. F. of, &c. and G. H. of, &c. as follows, viz. The faid E. F. in confideration of the rent herein after mentioned and agreed to be paid to him, hath letten to the faid G. H. one room up two pair of stairs forwards, part of the now dwelling houfe of the faid E. F. fituate, &c. together with the furniture at present standing therein, that is to say, one table, &c. To hold to the faid G. H. for the term of two years, to commence from, &c. at the yearly rent of, &c. to be paid quarterly, to wit, at, &c.

The faid G. H. in confideration hereof, agrees to pay the aforefaid yearly rent of, &c. at the times above limited for payment thereof; and at the end of the term or in cafe of any default in payment, fhall and will, on request of the faid E.F. or his affigns, immediately yield and deliver up to him or them the peaceable and quiet poffeffion of the faid room, together with the whole furniture, he, from the firft entrance thereon, there found and poffeffed, in good and fufficient plight and condition, reasonable wear and tear only excepted. OF ASSIGNMENTS.

A

SSIGNMENT is the transferring the intereft one hath in lands, goods or any other thing, to another. The perfon affigning is called the affignor, and he to whom the affignment is made the affignee.

If a perfon hath a term for years, he cannot affign it unlefs he be actually in poffeffion; and if he be not, the affignment must be executed upon the premises intended to be affigned. Co. Lit. 46, 47.

Upon an affignment of a leafe for years, the leffor may, at his election, charge either the leffee or affignee with the rent; but if he accept rent from the affignee knowing of the affign

ment, he hath determined his election, and cannot after wards charge the leffee for rent growing due. 3 Rep. 23.

An Affignment of a Bond.

Ŏ all people unto whom thefe prefents shall come, O. P. of &c. fends greeting. Whereas A. B. of, &c. in and by his bond or obligation, bearing date the day of ftands firmly bound unto the faid O. P. his executors, adminiftrators and affigns, in the penal fum of, &c. conditioned for the true payment of, &c. with legal intereft for the fame, at or, before, &c. a day now long fince paft, as in and by the faid bond or obligation and the condition there underwritten, may more fully appear Now know ye, that the faid O. P. for and in confideration of the fum of, &c. to him the faid O. P. in hand well and truly paid by L. M. of, &c. at or before the fealing and delivery of these prefents, the receipt whereof he the faid O. P. doth hereby acknowledge, hath granted, bargained, fold, affigned, transferred and fet over, and by thefe prefents doth grant,bargain, fell, affign and fet over, unto the faid L. M. his executors, administrators and affigns, the faid in part receipted bond or obligation with the condition there underwritten, and all principal and interest monies thereon due and owing, and all the right, title or intereft of him the faid O. P. in or to the fame. And the faid O. P. hath made, ordained, conftituted and appointed, and by these prefents doth make, conftitute and appoint the faid L. M. his executors, adminiftrators and affigns, his true and lawful attorney and attornies irrevocable for him, and in his name, and in the name of his executors and adminiftrators, but for the fole and proper ufe and behoof of the faid L. M. his executors, adminiftrators and affigns, to afk, demand and receive of and from the faid A. B, his heirs, executors and adminiftrators, the monies due on the faid bond, as aforefaid; and on non-payment thereof, to fue for, recover and receive the fame, and every part thereof, and on payment thereof, to deliver and cancel the faid bond, and give fufficient releafes and discharges. therefor; and one or more attorney or attornies under him or them to conftitute and appoint; and whatfoever the faid attorney or attornies fhall lawfully do in and about the premifes, the faid O. P. doth hereby ratify, confirm and allow.

And the faid O. P. for himself, his heirs, executors and adminiltrators, doth covenant, promife and agree, to and with the faid L. M. his executors, adminiftrators and affigns, and every of them by thefe prefents, that he the faid O. P. or any perfon or perfons on his behalf, hath not had or received the principal money and intereft due on the faid bond, or any part thereof; neither fhall he the faid O. P. receive or attempt to receive the fame; nor fhall he the faid O. P. in any wife release or discharge the fame, or any part thereof, but will own, ratify and allow of all lawful proceedings by his faid attorney or attornies for the recovery thereof; he the faid. L. M. his executors, adminiftrators and affigns, faving the faid O. P. his executors and adminiftrators, harmless and indemnified, of, from and against all cofts, charges and damages whatsoever, that may happen to him or them thereby. In witness, c.
