Articles of Marriage.

RTICLES of agreement of three parts, indented,, made, &c. between A. B. of, &c. of the first part, E. D. of, &c. daughter of, &c. of the fecond part, and C. D. of, &c. and E. F. of, &c. of the third part, as fol löweth :

Whereas the faid E. D. is féized to her and to her heirs in fee fimple, of and in certain lands, meffuages or tenements, with their appurtenances, fituate, lying and being, &c.. And whereas a marriage is fhortly intended to be had and folemnized between the faid A. B. and E. D. with whom the faid A. B. is to have and receive 7000 dollars, over and be-fides the lands, &c. abovementioned, as and for her marriage portion: It is therefore covenanted and agreed, by and between the faid parties to thefe prefents, in manner and form following, (that is to fay)

First, the faid A. B. for himself, his heirs, executors and adminiftrators, doth covenant and agree to and with the faid C. D. and E. F. their heirs and affigns, that they the faid A. B. and E. D. his intended wife, in cafe the faid intended marriage fhall be had and folemnized, by fome good and fufficient conveyance or conveyances in the law, fhall fettle and affure all thofe lands, meffuages or tenements, with the appurtenances whereof the the faid E. D. is feized. as aforefaid, to the ufe and behoof of the faid A. B and his affigns during the term of his natural life; and from and after the determination of that estate, then to the use and behoof of the faid C. D. and E. F. their heirs and affigns, during the natural life of the faid A. B. in truft, to preserve and support the contingent remainders herein after limited ; and from and after the deceafe of the faid A. B then to the use and behoof of the faid E. D. his faid intended wife, for and during the term of her natural life; and from and after her decease, then to the use and behoof of the heirs of the body of the faid E. D. by the faid A. B. lawfully to be

begotten; and for the default of fuch iffue, then to the use and behoof of the faid E. D. her heirs and affigns forever; and to and for no other ufe, intent or purpofe whatsoever.

And whereas the faid E. D. is alfo poffeffed of, or interested in, for the remainder of a term of ninety-nine years, (if the fhall fo long live) all that meffuage or tenement, with the appurtenances, fituate, &c. by virtue of a certain indenture of leafe thereof granted to the faid E. D. by L. M. of, &c. Now the said A. B. for himself, his heirs, executors and administrators, doth further covenant, grant and agree to and with the faid C. D. and E. F. their heirs and affigns, that they the faid A. B. and E. D. his faid intended wife (in cafe the faid marriage fhall take effect) shall and will, by like good and fufficient conveyances in the law, fettle and affure the faid meffuage or tenement, with the appurtenances, in fuch manner as that the fame may be held and enjoyed and the rents and profits thereof may be had, received and taken by the faid A. B. and his affigns, during fo many years of the faid term, as he fhall happen to live; and from and after his deceafe, then by the faid E. D. his faid intended wife, and her affigns, for and during fo many years. of the faid term as fhe fhall happen to live; and from and after her deceafe, then by fuch children of the faid E. D. by the faid A. B. to be begotten, in fuch manner as it may not be in the power of the faid A. B. to defeat fuch their. iffue and for default of fuch issue, then by the executors, adminiftrators or affigns of the faid E. D. and upon no other truft, and to and for no other ufe, intent or purpose whatfoever.

And forafmuch as the faid A. B. is not at prefent feized. or poffeffed of an estate fufficient to make a jointure for the faid E. D. his intended wife, equivalent to her fortune, the faid A. B. doth for himself, his heirs, executors and adminiftrators, covenant, grant and agree to and with the faid C. D. and E. F. their heirs and affigns that in cafe the faid intended marriage fhall take effect, (and left he the faid A. B fhould happen to die in the life-time of the faid E. D.) be the faid A. B. fhall and will by his laft will and teftament in writing, or otherwife, give and affure unto the said E. E it remembered, That on this agreed between A. B. of manner and form following, (to wit) the faid C. D. for the confiderations herein after mentioned, doth, for himself, his heirs, executors and administrators, covenant with the faid A. B. his executors, adminiftrators and affigns, that he the faid C. D. or his affigns, fhall and will within the space of

next after the date hereof, in a good and workmanlike manner, and according to the best of his knowledge and skill, at well and fubftantially erect, build, and finifh one houfe or meffuage, according to the draught or fcheme hereunto annexed, of the dimenfions following, viz. &c. and compofe the fame with fuch ftone or brick, timber and other materials, as the said A. B. or his affigns, shall find and provide for the fame. In confideration whereof, the said A. B. doth for himself, his executors and administrators, covenant with the faid C. D. his executors, adminiftrators and affigns, well and truly to pay unto the faid C. D. his executors, adminiftrators and affigns, the fum of dollars, in manner following (to wit) , part thereof, at the beginning of the faid work, more, another part thereof, when the faid work fhall be half done, and the remaining in full for the faid work, when the fame fhall be completely finished: And alfo that he the faid A. B. his executors, administrators or affigns, fhall and will, at his and their own proper expense, find and provide all the ftone, brick, tile, timber, and other materials neceffary for making and building of the faid houfe. To the true and faithful performance of the feveral articles and agreements above mentioned, the faid A. B. and C. D. do hereby refpectively bind themfelves, their heirs,. executors, and adminiftrators, each to the other, in the pe nal fum of dollars.

An Agreement for an hired Servant.

ARTICLES of

RTICLES of agreement indented, made, &c, between W. S. of, &c. of the one part, and W. M. of, &c. of the other part, as follows, (to wit)

The faid W. M. for the confideration hereunder mentioned, doth covenant, promife and agree to and with the faid W. S. his executors, administrators and affigns, by these prefents, in manner following, (that is to fay) That he the faid W. M. shall and will, for and during the term and time of years, to begin and be accounted from the date of thefe prefents, ferve, abide, and continue with the faid W. S as his covenant fervant, and diligently and faithfully, according to the best and utmost of his power, skill and knowledge, exercise and employ himself in, and do and perform all fuch service and business whatsoever, as well relating to the trade of a which the faid W. S. now useth, and in and about other business, matters and things whatfoever, as the faid W. S. fhall from time to time order, direct, and appoint, to and for the moft profit and advantage of the said W. S. that he can; and shall and will keep the fecrets of the faid W. S. relating to the faid trade and businefs; and likewise be just, true and faithful to the faid W S. in all matters and things, and no ways wrongfully to detain, embezzle, or purloin any monies, goods or things whatsoever, belonging to the faid W. S. And alfo fhall and will keep juft, true and faithful accounts in the books of the said W. S. of all goods bought and fold, monies received and paid, and of all other things whatfoever, relating to the bufinefs of the faid W. S. as fhall be committed to his care, management or difpofal; and from time to time pay all -monies which he shall receive of or belonging to or by order of the faid W. S. into his hands, and make and give up true and fair accounts of all his actions and doings in the faid employment, without fraud or delay, when and as often as he fhall be thereto required. And in confideration of the premises, and of the feveral matters and things by the said W. M. to be performed as aforefaid, the faid W. S. doth for himself, his executors and administrators, covenant, promife and agree, to and with the faid W. M. by thefe prefents, That he the faid W. S. shall and will find and provide unto and for the said W. M. in his dwelling-house, meat,

drink, washing and lodging; and alfo well and truly pay, or caufe to be paid unto the faid W. M. his executors, adminiftrators or affigns, by equal quarterly payments, the fum of

a year, for each and every year he fhall ferve the faid W. S. as aforefaid, and fhall allow unto the faid W. M. fuch reasonable expenfes in and about the business aforefaid, as he the faid W. S. fhall think fit: (And the faid parties do mutually covenant and agree to and with the other, viz. That if the faid W. S. fhall not be willing to continue the faid W. M. in his fervice after the expiration of the said years; or if the faid W. M. fhall not be willing to ferve and continue with the faid W. S. after the expiration of the faid years; in either of the faid cafes, the faid parties fhall and will give months notice of fuch their mind and intention, before the expiration of the faid term.)

HIS indenture of agreement, made and concluded A. D. by and between A. B. of &c. on one part, and C. D. of, &c. on the other part, Witneffeth,

That the faid A. B. for the confideration hereafter mentioned hath agreed to fell and convey, and doth by these prefents fell and convey to the faid C. D. his heirs and affigns, the fole right of printing, reprinting, publishing and vending a book whereof he the faid A. B. is author, entitled for the whole period that the fame is fecured to him by Act of the Congrefs of the United States, and more efpecially by an Act, entitled an "Act for the encouragement of learning, by fecuring the Copy of Maps, Charts or Books to the Author or Proprietor of faid Copies, during the time therein mentioned." And he the faid A. B. doth hereby covenant with the faid C. D. that before the publication of the faid book he depofited a printed copy of the title thereof in the Clerk's office of the District court wherein he the faid A. B. then refided, and did also publish a copy of the Record thereof within the time and in the manner directed by faid Act; and did alfo ludge a copy thereof in the office of the Secretary of State, as by faid Act is directed.
