mand whatsoever, which I the faid A. B, my executors or administrators, can, fhall or may have, or claim of, in or to the faid premises, or of or in any fum or fums of money, or other matter or thing whatfoever in the faid indentures of, &c. contained, mentioned and expreffed; fo that neither I the faid A. B; my executors or administrators, at any time hereafter, shall or will claim, challenge, or demand any intereft, property, benefit, or other thing, in any manner whatfoever, by reafon or means of the faid indentures, or any covenant therein contained; but thereof and therefrom, and of and from all actions, fuits and demands, which I, my executors or adminiftrators may have concerning t the fame, fhall be forever debarred by thefe prefents.. A Releafe of a Legacy.

NOW all men by these prefents, That whereas A. B. of, &c. made his laft will and teftament in writing, bearing date, &c. did, among other legacies therein concontained, give and bequeath unto me, C. D. of, &c. the fum or legacy of, &c. and of his faid will made and conftituted E. F. fole executor, as in and by the faid will may appear: Now know ye, that I the faid C. D. do hereby con fefs and acknowledge, that I have had and received of and from the faid E. F. the legacy or fum of, &c. fo as aforefaid given and bequeathed unto me by the faid A. B. And therefore I do by thefe prefents acquit, release and discharge the faid E. F. of and from all legacies, dues, duties and demands whatsoever, which I, my executors or administrators may have, claim, challenge, or demand of or against the said E. F. his executors or administrators, by virtue of the faid laft will and teftament of, or out of the estate of the faid A. B. deceased as aforefaid. In witness, &c.

A Release from a Legatee upon his coming to Age.

NOW all men by these prefents, That whereas A. B. of, &c. made his laft will and teftament in writing, bearing date, &c. and among other legacies therein contained, did give and bequeath unto me, C. B. of, &c. his fon,

the annual fum of, &c. to be paid me quarterly, until I should attain the age of one and twenty years; and of his faid will conftituted E. F. and G. H. joint executors, as in and by the faid will may appear: And whereas the faid E. F. and G. H. did jointly accept of the faid executorship and truft, and I the faid C. B. have attained my faid age of twentyone years: And whereas the faid E. F. and G. H. have made up an account with me the faid C. B. of all monies received and paid by the faid E. F. and G. H. and of all tranf actions in purfuance of the faid executorship and truft; and have not only paid me the faid C. B. the balance of fuch accounts, but alfo delivered unto me all writings, and papers belonging to the eftate of the faid deceafed A. B.

know ye, that I the faid C. B. being fully fatisfied in the premifes, have remifed, releafed and forever quitclaimed, and by these prefents do remife, release and forever quitclaim unto the faid E. F. and G. H. and each of them, their and each of their executors and adminiftrators, all reckonings and accounts, fum and fums of money by them had or received in purfuance of the faid truft, or by means of their being executors to the faid A. B. as aforefaid; and also of and from all other reckonings, accounts, and demands whatsoever, from the beginning of the world, to the day of the date of thefe prefents. In witness, &c.

A Releafe of the Equity of Redemption to an Estate mortgaged.

O all people to whom thefe prefents fhall come, I, A. B. of, &c. fend greeting. Whereas, I the faid A. B. by a certain mortgage deed, dated the day of for the confideration of did grant, bargain, fell and convey to C. D. of, &c. [Here defcribe the premises.] To have and to hold the fame unto the faid C. D. &c. [as in the faid deed] upon the condition following, viz. Provided notwithstanding, (Here infert the condition.) And whereas I the faid A. B. am fully fatisfied that the faid monies fo due to the faid C. D. is the full value of (or nearly the value, or as much as I can get for) the faid mortgaged premifes, and I am not able to redeem the fame :

-Therefore know ye, That I the faid A. B. in confideration thereof, and alfo for the further confideration of the fum of

, to me paid before the delivery of thefe prefents, and for the quieting the faid C. D. in the poffeffion and enjoyment of the faid (premifes) and for extinguishing all right of equity of redemption of the fame, have remifed, releafed and forever quitclaimed, and do by these prefents, for myself, my executors and administrators, remife, release, and forever quitclaim unto the faid C. D. his heirs and affigns, the said provifo or condition in the said mortgage deed recited as above, and all benefit and equity of redemption of the faid (premifes) by virtue of any law allowing or providing for the fame, or whereby he might otherwife have the benefit of the fame, notwithstanding.

And I the faid A. B. for the confiderations aforefaid, do for myself, my heirs, executors, and adminiftrators, hereby grant, bargain, fell, release, convey and confirm unto him, the faid C. D. his heirs and affigns, the faid (premises) with all the privileges and appurtenances thereunto belonging. have and to hold the fame, to the said C. D. his heirs and affigns forever. And I do for myself, &c, covenant with the faid C. D. his heirs and affigns, that he and they shall and may from henceforth quietly and peaceably have, hold, use, occupy and enjoy all (the faid premises) with the appurtenances thereof, without any let, hindrance, moleftation or interruption from me the faid A. B. my heirs or affigns, an of all and every other perfon or perfons whatsoever, claiming, from, by or under me, or them or any of them. In witness, Sc..

A Releafe of Dower..

NOW all men by these prefents, That I, A. B. widow and relict of B. B. late of, &c. deceased, for and in confideration of the fum of, &c. to me the faid A. B. by C. B. of, &c. fon of the faid B. B. deceased, well and truly paid, the receipt whereof I do hereby acknowledge, have remised, released, and forever quitclaimed, and by these pref ents do remife, releafe, and forever quitclaim unto the faid C. B. all and all manner of dower, and right and title of dower whatfoever, which I the faid A. B. now have, may,, might, fhould, or of right ought to have or claim of, in or ⚫ut of all and every the manors, meffuages, lands, tenements,

and hereditaments which were belonging to the faid B. B. my late husband, at any time, during the coverture between him and me the said A. B. fituate, &c. or elsewhere: And also all manner of action or actions, writ and writs of dower whatsoever; fo as neither I the said A. B. nor any other perfon for me or in my name, any manner of dower, or writ of action of dower, or any right or title of dower, of or in the faid manors, lands, tenements, and hereditaments, or of or in any part or parcel thereof, at any time hereafter shall or may have, claim, or profecute against the faid C. A Releafe of Errors.

NOW all men by thefe prefents, That I A. B. of, &c. have remised, releafed, and forever quitclaimed, and by these prefents do remife, release and forever quitclaim unto C. D. of, &c. all and all manner of error and errors, caufe and caufes of error, mifprifions, mifentries, defects and wrongful pleading and proceedings whatsoever, made, committed, omitted or done, in, about, or concerning one judgment for the fum of, &c. together with all cofts of fuit by the faid C. obtained againft me in the court of, &c. at in

term last past; and alfo all writs of error or errors whatsoever concerning the fame. In witness, &c.

OF SURRENDER BY DEED.

SURRENDER, fur fum redditio, or rendering up, is of a nature directly oppofite to a release; for as that operates by the greater eftates defcending upon the lefs, a furrender is a falling of the lefs eftate unto a greater. It is "defined, a yielding up of an estate for life or years to him that hath the immediate reverfion or remainder, wherein the particular eftate may merge or drown, by mutual agreement between them. It is done by these words, "hath furrendered, granted and yielded up." Blackftone's Comm.

To make a good furrender by deed, these things are quired, viz. that the furrenderer must have an estate in poffeffion in the land, &c. furrendered; the furrender must be made to him that hath the next estate in remainder or reverfion, without any eftate coming between ; and the furrenderee must have a greater eftate in his own right, in the thing furrendered, than the furrenderer. ·Co. Lit. 338.

The furrenderer must be in poffeffion; and the furrenderee must have a higher eftate, in which the estate furrendered may merge; therefore tenant for life cannot furrender to him in remainder for years. · Blackftone's Comm.

A Deed of Surrender to a Perfon having the Re verfion in Fee.

NOW all men by these presents, That I, A.B. of, &c. for and in confideration of the fum of, &c. to me in hand paid by C. D. of, &c. the receipt whereof I do hereby acknowledge, have furrendered, granted and yielded up, and by thefe prefents do furrender, grant and yield up, unto the faid C. D. his heirs and affigns, All that meffuage, &c. (here defcribe the premises) and the reverfion and reverfions, remainder and remainders, rents, iffues and profits of all and fingular the faid premifes: To have and to hold the faid meffuage, &c. and all and fingular other the premises above granted and furrendered, and every part and parcel thereof, with the appurtenances, unto the faid C. D. his heirs and affigns, to the only proper use and behoof of him the faid C. D. his keirs and affigns forever. In witness, Sc.

A Surrender of a Term of Years.·

NOW all men by these prefents, That whereas I, A. B. of &c. am poffeffed of and interested in one meffuage, &c. the remainder of a certain term of years, the reverfion whereof doth belong to C. D. of, &c. Now know ye, that I the faid A. B. for and in confideration of the fum of, &c. to me in hand well and truly paid by the faid C. D. at or before the fealing and delivery of thefe prefents, the receipt whereof I the faid A. B. do hereby acknowledge, have granted, furrendered and yielded up, and by thefe prefents do grant, furrender and yield up, unto the faid C. D. his
