D. late of, &c, deceased, That the goods and chattels belonging to faid deceafed's eftate, are not fufficient by the fum of one thousand dollars to anfwer the juft debts which the faid deceased owed at the time of his death (and to pay the legacies bequeathed by bis laft will and teftament.) Ordered, That the faid A. B.

be and he is hereby empowered and licensed to make fale of all or any part of the houses, lands or tenements of the faid deceased, fo far as fhall be neceffary to fatisfy the said debts (and legacies) with incidental charges.

The faid A. B. previous to fixing on the time and place of faid fale, to take the oath by law prefcribed, and to give thirty days publick notice of the fame, by pofting up notifications thereof, in the town or plantation where the lands lie, as well as where the faid deceased person laft dwelt, and in the two next adjoining towns, as alfo in the fhire town of the county, whofoever will give most to have the preference in fuch fale.

N. B. A general receipt will discharge all debts except fuch as are on fpeciality, i. e. bonds, bills, and other inftruments that may properly be called acts or deeds, viz. Thofe that require to be executed in a folemn manner, where the fealing and delivery are the most effential parts of the act, and on that account can only be destroyed by fomething of equal force, viz. fome other fpeciality, fuch as a general releafe, &c. Neither will it discharge indorfeable promiffory notes, or inland bills.
