If no power of fubftitution is defired to be given, the whole that relates to it, to be omitted; the place of abode, and quality of each witnefs, to be written against his name.

The acknowledgment may be taken before any judge of a court of the United States, or of a fuperior court of law or equity in any state, or of a county court, or before the mayor or other chief magiftrate of any place; or before a notary publick.

In the acknowledgment, if the feal of a court or corpora tion is to be affixed, the words caufed to be,' may precede the word affixed,' the blank immediately following to be filled with a defignation of the feal; as that it is the feal of a certain court, naming it; or, the feal of a certain corporation, naming it; or, the feal of office of the party before whom the acknowledgment is taken, if he has one; or, if he has none, with the words ' my feal.'

If there be no publick or official feal to the acknowledgment, proof of the execution of the power must be made by oath or affirmation of one of the witneffes, to be taken before fome perfon, duly authorized at the place where the transfer is to be made.

Power of Attorney to receive Principal and Inter-eft of the Publick Debt.

CCORDING to an act of Congrefs, paffed April 28, 1795, entitled, "An act in addition to an aft, entitled An act making further provifion for the fupport of Publick Credit and for the Redemption of the Publick D.bt," the faid debt or stock will be reimbursed and paid in manner fol lowing, viz.

1. By dividend to be made on the laft day of March, June and September for that year, and from that year, 1797, to 1818, inclufive, at the rate of 14 per cent. upon the original capital..

2 By dividend to be made on the laft day of December for faid year 1796, and from the year 1797, to the year 1817, inclufive, at the rate of 3 per cent. upon the original. capital. And

3. By a dividend to be made on the laft day of December, 1818, of fuch fun as will be then adequate, according to the contract, for the final redemption of the faid flock.

All diftinction between payments on account of interest and principal, being thereby abolished, it has become neceffary to vary accordingly the powers of attorney for receiving dividends.

The following form is eftablished for that purpofe, viz.

KNOW all men by thefe prefents, That I, A. B. of, &c.. in do make, conftitute and appoint C. D. of, &c. my true and lawful attorney, for me and in my name, to receive the dividends which are, or fhall be payable according to law, . on the (here defcribing the ftock) ftanding in my name in the books of (here defcribing the books of the treafury or the commiffioner of Loans, where the flock is credited) from (here infert the commencement and expiration of time for which the

F. of my attorney, for me and in my name and ftead in the capacity aforefaid, and for the ufe of the widow, heirs, legatees, devifees and creditors of the faid deceafed, to afk, demand, recover and receive, from all and every perfon or.. perfons whomfoever the fame fhall or may concern, all and fingular fums of money, debts, goods and effects whatsoever, and wherefoever they may be found due, payable or in any way belonging to the faid deceafed in his life time and to me in the capacity aforefaid, and in my name to give receipts and discharges for the fame: To pay whatever may be found le gally due from faid eftate to any perfon or perfons whatfoever, and take discharges for the fame: To fettle with the heirs, legatees and devifees of the deceased for their respective legacies, devifes, fhares or proportions of faid eftate, and to pay and affign to them whatever may be the will of faid deceafed, or legally coming to them refpectively: To commence and profecute to final judgment and execution, any ac-. tion or actions he fhall judge neceffary or proper to commence against any perfon or perfons, and to reply to and defend any

canfe or action that may by any perfon or perfons be brought against me in the capacity aforefaid, relating to or concerning faid will or eftate, or the fettlement thereof; and for thofe purposes to appear for and reprefent me before any judge or court before whom any fuch cause or action may be brought or pending: To fubmit any matter in difpute to reference or arbitration, and to fettle an account or accounts with the judge, or any court of probate, of all his proceedings herein: And generally to take and ufe all due means for the execu tion of the faid will and fettlement of the eftate aforefaid, according to the fame, and to the laws of the Commonwealth and in the premises to act, tranfact, determine and accom. plish whatever I myself could, might or ought, as fully and effectually to all intents and purposes as though I were perfonally prefent, although the matter fhould require more fpecial authority than is herein comprifed, and to fubftitute and appoint one or more attornies under him, if he fhall judge it neceffary Hereby ratifying and confirming whatever my faid attorney or his fubftitutes fhall lawfully do or caufe to be done in and about the premifes by virtue of thefe prefents.
