D. his heirs and affigns, that I am lawfully feized in fee of the premifes, that they are free of all incumbrances, that I have good right to fell and convey the fame to the faid C. D. to hold as aforefaid, and that I will warrant and defend the fame to the faid C. D. his heirs and affigns forever, against the lawful claims and demands of all perfons.

Provided nevertheless, That if I the faid A. B. my heirs, executors, or administrators, fhall well and truly pay to the faid C. D. his heirs, executors, administrators or affigns, the full and juft fam of on or before the

That previous to the intended fale, I took the oath by law prefcribed, and gave publick notice thereof, according to the directions of the law in fuch cafes made and provided and that the faid C. D. offered moft for the faid premifes, and the fame was thereupon ftruck off to him, for the fum aforefaid, at a publick vendue held at the houfe of on the day of, &c. the by and between A B. of, &c. of one part, C. D. of, &c. of another part, E. F. of, &c. of another part, and G. H. of, &c. of the other part, Witneffeth, That whereas they the faid A. B. C. D. E. F. and G. H. are feized in fee fimple, and have and hold as tenants in common in equal fhares, &c.

(Here infert the premises, or description of the eftate to be dvided.)

And whereas the faid parties have concluded to hold and enjoy their respective parts thereof in feveralty,

It is therefore covenanted, granted and agreed, by and between all and every of the faid parties, for himfelf and herfelf, and for his, her and their heirs, executors and adminif trators, and they do hereby feverally and refpectively covenant, grant and agree to and with the others, their feveral and refpective heirs and affigns, that a partition of the fame fhall be and is hereby made and determined in manner following; that is to fay,

1. That he the faid A. B. his heirs and affigns, fhall and may from henceforth have, hold, poffefs and enjoy, in feveralty, &c. (Here defcribe the part to be fet off to A. B.)

And the faid C. D. F. F. and G. H. for themselves, their heirs, executors and adminiftrators, do by these prefents, grant, releafe, and confirm the fame to the faid A. B. his heirs and affigns forever, as and for the faid A. B.'s full fhare, part and proportion of, in and to the faid, &c. To have and to hold the fame, with all the privileges and ap purtenances thereof, to him the faid A. B. his heirs and affigns forever, in feveralty as aforefaid, and to his and their only use and behoof forever: And the faid C. D. E. F. and G. H. do feverally by thefe p efents, for themselves and administrators, covenant and grant, to and with the faid A. B. his heirs and affigns, That he and they fhall and may from henceforth forever, peaceably and. quietly have, hold, ufe, occupy, poffefs and enjoy the fame free, and difcharged of all right, title, intereft, claim and demand whatsoever of the faid C. D. E. F. and G. H. or either of them or of their heirs or affigns, or of any perfon or perfons, claiming from, by or under them or any of them.

That the faid C. D. his heirs and affigns, fhall and may from henceforth have, hold, poffefs and enjoy in feveralty. (Here defcribe the part to be fet off to C. D.)

And the faid A. B. E F. and G. H. for themselves, &c. (Here go on as before, in the relcafe to, and covenants with A. B)

3. That the faid E. F. his heirs and affigns, fhall and may from henceforth have, hold, poffefs and enjoy in feveralty. (Here defcribe the part to be fet off to F. F.)

And the faid A. B. C. D. and G. H. for themselves, &c. Here go on as before, in the release to, and covenant with A.B.) 4. That the faid G. H. his heirs and affigns, shall and may from henceforth have, hold, poffefs and enjoy in feveralty. (Here defcribe the part fet off to G. H.)

And the faid A. B. C. D. and E. F. for themselves, &c. (Here go on as before, in the releafe to, and covenant with A.B.)

In witnefs whereof, the faid A. B. C. D. E. F. and G. H. (and alfo M B. wife of the faid A. B. and H. F. wife of the faid E. F. or as the cafe may be in token of their free confent hereto) have hereunto interchangeably fet their hands and feals the day and year above written.

I. That the faid A. B. his heirs and affigns, fhall and may from henceforth have, hold, poffefs and enj y in feveralty, &c.

2. That the faid C. D. his heirs and affigns, fhall and may from henceforth have, hold, poffefs and enjoy in fev. eralty, &c.

3 That the faid E. F. his heirs and affigns, fhall and may from henceforth have, hold, poffefs and enjoy in feveralty, &c.

4.

That the faid G. H. his heirs and affigns, fhall and may from henceforth have, hold, poffefs and enjoy in feveralty, &c.

And to each of the faid parties, his heirs and affignis forever, the other three for themfelves, their heirs, executors and adminiftrators refpectively, do by thefe prefents grant, releafe, and confirm, the, &c fet off to him as aforefaid, as and for his full fhare, part and proportion of, in, and to the faid To have and to bold the fame, with all the privileges and appurtenances thereof, to him and his heirs and affigns forever, in feveralty as aforefaid, and to his and their only use and behoof forever.
