Ordinances.

BY-LAWS AND ORDINANCES.

40. The Commissioners in addition to any power to make by-laws and ordinances elsewhere in this Act conferred, shall have power to make by-laws in respect to all matters coming within the following classes of subjects and may from time to time amend or repeal such by-laws, that is to say, for:-

(1) Regulating its own proceedings and preserving order at meetings of the Commissioners.

(2) Regulating and controlling the acquisition, operation and maintenance of all or any of the matters or things set forth in the next preceding section.

(3) Regulating the management and providing for the security of public property of any kind belonging to the village, and providing for the permanent improvement of the village in all matters as well ornamental as useful.

(4) For the government and procedure of meetings of the electors of the village at village meetings.

(5) making regulations for preventing persons under fifteen years of age from walking or being on any street of the village after nine o'clock at ni ght.

(6) The removal of all filth and incumbrances on the streets, sidewalks, roads and alleys within the village and preventing persons from throwing or depositing any dirt, filth or rubbish thereon.

(7) The prevention of persons loitering on or about the steps or entrances of stores or shops or on streets, highways or other public places.

(8) For regulating, controlling or prohibiting the use or occupation of buildings, halls, rooms or other places of public meetings, entertainments amusements or other gatherings with a view to the prevention of accidents therein, but not including any of the matters in respect of which the Governor-inCouncil is authorized by "The Theatre, Cinemato

graphs and Amusement's Act" as amended to make regulations.

(9) Preserving peace, health and good government within the village and preventing and punishing crime, vice, drunkenness, immorality and indecency on public streets and highways and other public places.

(10) Providing for any other purpose, matter or thing specifically within the powers, duties or control of the Commissioners.

41. (1) The by-laws and ordinances for the By-laws and foregoing purposes or any of them, when not incon- have force of sistent with any law of the Province and when approved of by the Governor-in-Council, shall have the force of law.

(2) Notwithstanding the approval of any such By-laws may by-law as aforesaid or of any amendment thereof the be revoked. Governor-in-Council may subsequently revoke the approval of the same and after such revocation such by-law shall cease to have any force or effect.

42. The production of a copy of said by-laws and Certified copy ordinances so approved and certified by the Clerk evidence. under his hand and the seal of the Commissioners to be a true copy of the by-law passed by the Commissioners and approved by the Governor-in-Council, shall without proof of the official character of such Clerk or of his signature or of the said seal be sufficient evidence of such by-law.

43. The Commissioners may prescribe a penalty Penalty. not exceeding fifty dollars, inclusive of costs, for the violation of any by-law made under the provisions of this Act, and may provide that in default of payment of such penalty the offender may be imprisoned with or without hard labor for such period as the Commissioners in such by-law prescribes. A Stipendiary or other Magistrate may impose the whole or such part of the penalty or punishment fixed by by-law as he deems fit.

44. (1) For the purpose of raising the necessary funds to carry into effect, complete and maintain the works and services contemplated by this Act, the Commissioners may when authorized by a meeting of the electors make and issue under the provisions of the Municipal Debentures Act, 1914, as amended, from time to time, or otherwise as they may deem expedient, debentures in the forms specified in the schedule to this Act, with coupons attached, in sums of one hundred dollars each or any multiple thereof, bearing interest at a rate not exceeding seven per centum per annum payable half yearly and redeemable at periods not exceeding forty years from the date of issue thereof; provided that the whole amount of such debentures shall not exceed the sum of twentyfive thousand dollars.

(2) Such debentures shall be signed by the Commissioners and countersigned by the Clerk of the Commissioners, and shall bear an impress of the seal of the Commissioners and shall be a lien upon and form a charge against the real and personal property within the village. The Municipality of which such village forms a part, by a two-thirds vote of the Council of such Municipality, are empowered to guarantee the payment of the interest and principal of any debentures issued under the provisions of this section.

(3) The Commissioners may from time to time if so authorized by a meeting of the electors effect temporary loans from any chartered bank or Trust. Company in Nova Scotia for the purpose of defraying the annual current expenditure of the village incurred for the purposes set forth in this Act, and the interest on such loans shall be added to the current expenses for the year; provided that such loan or loans shall not in the aggregate at any time exceed five thousand dollars.

(4) When the amount authorized to be borrowed in the preceding sub-section is borrowed the power to borrow shall cease until the said loan or loans

have been reduced when the power may again be exercised.

45. For the purposes of this Act, and for the pur- Sinking fund. pose of raising a fund to retire a portion of said debentures, the Commissioners shall invest as a sinking fund in each and every year after the issue of such debentures such sum as may be determined at an annual meeting, but not however to be less than one per centum of the debentures issued and outstanding and the interest accruing therefrom shall also be so invested.

46. The money accruing from the annual income Annual infrom all sources shall be appropriated and applied first propriated and to discharge the current expenses incurred in carrying out the requirements of this Act, secondly towards the payment of the half-yearly interest due on the debentures issued under the authority of this Act, and an amount towards the payment of the half-yearly interest due on the debentures issued under the authority of this Act and an amount towards the sinking fund hereinafter provided for; and in case the whole income shall not be sufficient for the purposes before mentioned the deficiency shall be made up by an assessment on the real and personal property within the village, according to the Municipal Assessment Rolls applicable to the said village for the current year; if there is a surplus remaining after providing for the said expenses, interest and sinking fund, the same shall be carried forward to the credit of the next ensuing year.

47. The Commissioners shall prepare a rate roll Rate Roll. showing the assessment made for the purposes of this Act, and shall furnish the same signed and certified by them to the Clerk of the Municipality of which such village forms part on or before the first day of March in each year, and the amount rated therein upon each ratepayer shall be collected as part of the Municipal rates and taxes, with the same remedies for nonpayment.

Money collect- 49. The money levied and collected under the Commissioners. provisions of this Act shall be paid over by the Treasurer of the Municipality to the Commissioners on or before the first day of December in each year.

POLICE CONSTABLES.

50. Every police constable appointed under the provisions of this Act shall have power to serve and execute all process issued by Justices of the Peace and Stipendiary Magistrates in civil and criminal matters, and to perform all acts and duties now incumbent on constables in civil and criminal matters.

51. 1. Every police constable appointed under the provisions of this Act may take into his custody without warrant any loose, idle, or disorderly person whom he finds:

(a) disturbing the public peace, or

(b) between the hours of 7 o'clock in the afternoon and 6 o'clock in the forenoon lying or lurking in any highway, yard or other place in the village, and not giving a satisfactory account of himself.

2. Such police constable may also at any time of the day or night take into custody without warrant any person who is found:

(a) drunk or feigning to be drunk, or making any loud bawling, yelling, screaming, singing or shouting in any public street, thoroughfare or alley, road or by-road of the village; or

(b) incommoding peaceful passers-by, or loitering on the streets or highways, or in the doorways or windows of shops or dwellings on the streets or highways; or,

(c) obstructing people by standing across the footpaths or sidewalks, and having been ordered
